Collective Bargaining


DESCRIPTION:
Repeals the law allowing collective bargaining agreements to
preempt all contrary local ordinances, executive orders,
legislation, or rules adopted by the State, a county, or any

                   A  BILL  FOR  AN  ACT

RELATING TO COLLECTIVE BARGAINING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 89-19, Hawaii Revised Statutes, is
 
 2 repealed.
 
 3      ["§89-19  Chapter takes precedence, when.  This chapter
 
 4 shall take precedence over all conflicting statutes concerning
 
 5 this subject matter and shall preempt all contrary local
 
 6 ordinances, executive orders, legislation, or rules adopted by
 
 7 the State, a county, or any department or agency thereof,
 
 8 including the departments of human resources development or of
 
 9 personnel services or the civil service commission."]
 
10      SECTION 2.  This Act shall not be applied so as to impair
 
11 any collective bargaining agreement existing as of the effective
 
12 date of this Act in a manner violative of either the Hawaii
 
13 Constitution or Article I, section 10, of the United States
 
14 Constitution.
 
15      SECTION 3.  Statutory material to be repealed is bracketed.
 
16      SECTION 4.  This Act shall take effect upon its approval.
