Pedestrian Safety


DESCRIPTION:
Requires vehicles approaching a crosswalk on a two-lane roadway
from either direction to slow down and stop when a pedestrian has
entered the two-lane road while maintaining that all vehicles
must yield to pedestrians on all roads when the pedestrian is

                   A  BILL  FOR  AN  ACT

RELATING TO THE STATEWIDE TRAFFIC CODE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291C-72, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  When traffic-control signals are not in place or not
 
 4 in operation, the driver of a vehicle shall yield the right of
 
 5 way, slow[ing] down or stop[ping] if need be to [so] yield, to a
 
 6 pedestrian crossing the roadway within a crosswalk when the
 
 7 pedestrian is upon the half of the roadway upon which the vehicle
 
 8 is traveling, or when the pedestrian is approaching so closely
 
 9 from the opposite half of the roadway as to be in danger[.];
 
10 provided that on a two-lane roadway, the vehicle shall slow down
 
11 and stop to yield regardless of which half of the roadway the
 
12 pedestrian is upon."
 
13      SECTION 2.  Statutory material to be repealed is bracketed.
 
14 New statutory material is underscored.
 
15      SECTION 3.  This Act shall take effect upon its approval.
