                   A  BILL  FOR  AN  ACT

RELATING TO THE METROPOLITAN PLANNING ORGANIZATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 279E-7, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§279E-7[]]  Functions of the Metropolitan Planning
 
 4 Organization.  The functions of each Metropolitan Planning
 
 5 Organization shall include:
 
 6      (1)  [Serve] Serving in an advisory capacity to the
 
 7           legislature, the legislative body of the county, and
 
 8           the appropriate state and county agencies in carrying
 
 9           out continuous, comprehensive and cooperative
 
10           transportation planning and programming for the county
 
11           as required by federal laws and rules.
 
12      (2)  [Obtain] Obtaining information and plans from the
 
13           appropriate county and state agencies to formulate a
 
14           short-range six-year transportation plan for the county
 
15           and an annual update of that plan, and a master multi-
 
16           modal long-range transportation plan for the county in
 
17           order to advise the legislature, the legislative body
 
18           of the county, and other appropriate agencies regarding
 
19           those plans.

 1      (3)  [Review] Reviewing the capital improvement programs of
 
 2           both the county and state for urbanized and rural areas
 
 3           of the county as they concern transportation.
 
 4      (4)  [Integrate] Integrating transportation planning for the
 
 5           county with a statewide transportation planning program
 
 6           authorized by Act 218, SLH 1974.
 
 7      (5)  [Develop] Developing recommendations to the state
 
 8           legislature and the legislative body of the county
 
 9           regarding transportation policy matters.
 
10      (6)  [Act] Acting as liaison with the intermodal planning
 
11           group of the secretary of transportation.
 
12      (7)  [Coordinate] Coordinating the mathematical modeling
 
13           essential to the transportation planning process of the
 
14           county.
 
15      (8)  [Ensure] Ensuring a continuing, comprehensive
 
16           transportation planning process carried on
 
17           cooperatively by the State and the county.
 
18      (9)  [Develop] Developing a formula for the distribution of
 
19           metropolitan planning funds which shall consider but
 
20           not necessarily be limited to population, status of
 
21           planning, and metropolitan area transportation needs,
 
22           and submit this formula for approval by the secretary
 
23           of transportation.

 1     (10)  [Receive] Receiving and [distribute,] distributing, as
 
 2           necessary, federal funds under Section 112 of the
 
 3           Federal-Aid Highway Act of 1973, the Urban Mass
 
 4           Transportation Act of 1964, as amended, Section 13 of
 
 5           the Airport and Airway Development Act of 1970, as
 
 6           amended, and Section 5 of the Urban Mass Transportation
 
 7           Act of 1964, as amended.
 
 8     (11)  [Receive] Receiving and [distribute,] distributing, as
 
 9           necessary, such other funds as may become available to
 
10           support metropolitan transportation.
 
11     (12)  [Advise] Advising on plans, projects and programs
 
12           requiring action by the state legislature or the
 
13           legislative body of the county which have been
 
14           submitted for review to the MPO.
 
15     (13)  [Undertake] Undertaking such other functions as may
 
16           become appropriate in an advisory capacity to ensure a
 
17           joint planning process between the county and the
 
18           State, and advise appropriate legislative bodies and
 
19           agencies, as necessary[.];
 
20     (14)  [If the MPO finds that it is necessary to have a
 
21           citizens' advisory group to present technical or other
 
22           expert opinions or facts to the MPO then such a group
 
23           may be formed.] Forming a citizens' advisory group to

 1           present technical or other expert opinions or facts to
 
 2           the MPO; and
 
 3      (15) Forming a professional advisory committee composed of
 
 4           professionals associated with transportation on Oahu
 
 5           and appointed by the policy committee of the MPO."
 
 6      SECTION 2.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect upon its approval.
