                   A  BILL  FOR  AN  ACT

RELATING TO THE STATE INTERNET PORTAL.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Findings and purpose.  The legislature finds
 
 2 that the expansion of the Internet has fundamentally transformed
 
 3 society and the conduct of business.  In order to better serve
 
 4 citizens and businesses in the new economy, government must
 
 5 expand access to information and provide government services over
 
 6 the Internet, while ensuring Internet access points for everyone
 
 7 in order to reduce the "digital divide".
 
 8      The State has entered into a contract with a vendor to
 
 9 establish, develop, operate, maintain, and expand an Internet
 
10 portal for the purpose of increasing electronic access and
 
11 commerce among Hawaii residents, businesses, and government
 
12 entities.  At no cost to the State, the portal manager will
 
13 provide all necessary hardware, software, portal infrastructure,
 
14 administration, operation, systems analysis, programming,
 
15 delivery of services, training, marketing, collection and
 
16 distribution of payments, and a help desk.  With a portal manager
 
17 in place, additional electronic government applications should be
 
18 made available on a regular basis, with the state library system
 
19 providing primary access for citizens seeking Internet access.

 1 In addition, electronic government services should be expanded
 
 2 through partnerships with entities such as the University of
 
 3 Hawaii and the department of education.
 
 4      All statutory fees collected by the portal manager on behalf
 
 5 of a government agency will be remitted in full to the government
 
 6 agency.  All charges for value added electronic services will be
 
 7 retained by the portal manager to pay for the core and ongoing
 
 8 costs of operating the portal as well as applications development
 
 9 costs associated with the deployment of standard and premium
 
10 services.
 
11      The purpose of this Act is (1) to establish a mechanism for
 
12 oversight of the portal manager and authorize the setting of
 
13 charges for value added electronic services that will be
 
14 collected by the portal manager; and (2) assist the public
 
15 library system in providing access to the Internet portal.
 
16      SECTION 2.  Definitions.  As used in this Act, unless the
 
17 context otherwise requires:
 
18      "Committee" means the Access Hawaii Committee.
 
19      "Government agency" means any government agency that stores,
 
20 gathers, or generates public information, including all branches
 
21 of government, all executive departments, boards, and commissions
 
22 of the State or counties, and all public corporations created by
 
23 the legislature.

 1      "Internet" means the global information system that is
 
 2 logically linked together by a globally unique address space
 
 3 based on the Internet Protocol (IP), or its subsequent
 
 4 extensions; and that is able to support communications using the
 
 5 Transmission Control Protocol/Internet Protocol (TCP/IP) suite,
 
 6 or its subsequent extensions, or other IP-compatible protocols;
 
 7 and that provides, uses, or makes accessible, either publicly or
 
 8 privately, information to users.
 
 9      "Internet portal" means the centralized electronic
 
10 information system by which public information is provided via
 
11 dial-in modem or continuous link to the public through
 
12 subscription or through public libraries.
 
13      "Portal manager" means the entity or person engaged to
 
14 manage and operate the Internet portal on behalf of the State of
 
15 Hawaii.
 
16      "Value added electronic services" means services including,
 
17 but not limited to:
 
18      (1)  Providing periodic, continual, and ongoing access to
 
19           information maintained by a government agency without
 
20           requiring separate requests for information as it is
 
21           created;
 
22      (2)  Compiling data or performing other research services;
 
23      (3)  Permitting the electronic filing of reports, renewals,

 1           or applications; or
 
 2      (4)  The ability to transact business over the Internet
 
 3           portal.
 
 4      SECTION 3.  Any statute to the contrary notwithstanding,
 
 5 government agencies may charge for value added electronic
 
 6 services provided through the portal manager.
 
 7      SECTION 4.  Access Hawaii committee; establishment;
 
 8 membership; chairperson.(a)  There is established within the
 
 9 office of the governor, on a special and temporary basis, the
 
10 Access Hawaii Committee, until June 30, 2003, at which time the
 
11 committee shall cease to exist.
 
12      (b)  The committee shall consist of not more than eleven
 
13 voting ex officio members, or their designated representatives,
 
14 as follows:
 
15      (1)  The governor's special advisor for technology
 
16           development;
 
17      (2)  The administrator of the information and communication
 
18           services division in the department of accounting and
 
19           general services;
 
20      (3)  The administrator of the state procurement office;
 
21      (4)  The director of the office of information practices;
 
22      (5)  The directors of not more than three government
 
23           agencies using or planning to use the services of the

 1           portal manager; and
 
 2      (6)  The chief information officers of the four counties.
 
 3      (c)  The governor's special advisor for technology
 
 4 development shall serve as the chairperson of the committee.
 
 5      SECTION 5.  Duties of the committee.  (a)  The committee
 
 6 shall provide oversight of the portal manager including:
 
 7      (1)  Review of the annual strategic plan and periodic
 
 8           reports on potential new applications and services
 
 9           submitted by the portal manager;
 
10      (2)  Review and approval of all charges to portal users;
 
11      (3)  Review and approval of service level agreements
 
12           negotiated by government agencies with the portal
 
13           manager;
 
14      (4)  Review of annual financial reports and audit of the
 
15           portal manager;
 
16      (5)  Review of annual customer satisfaction surveys
 
17           conducted by the portal manager; and
 
18      (6)  Review of performance measures of the portal submitted
 
19           as part of the service management plan for portal-wide
 
20           indicators and application specific indicators.
 
21      (b)  The committee shall assist the Hawaii state public
 
22 library system in providing access to the Internet portal and
 
23 advice on the following:

 1      (1)  Being an avenue for distribution of access for the
 
 2           public to the Internet for purposes of education and
 
 3           information;
 
 4      (2)  Installing Internet access computers, routers, and
 
 5           lines; and
 
 6      (3)  Providing Internet training in at least half of the
 
 7           public libraries.
 
 8      (c)  In the event of a conflict with chapter 92F, the
 
 9 provisions of chapter 92F shall control questions of
 
10 interpretation.
 
11      SECTION 6.  Annual report.  The committee shall submit an
 
12 annual report on the operations of the portal and assistance
 
13 provided to the Hawaii state public library system to the
 
14 legislature no later than twenty days prior to the convening of
 
15 each regular legislative session.
 
16      SECTION 7.  There is appropriated out of the general
 
17 revenues of the State of Hawaii the sum of $250,000, or so much
 
18 thereof as may be necessary for fiscal year 2000-2001, to provide
 
19 funding for the Hawaii state public library system for Internet
 
20 access computers and connections, digitalization equipment, and
 
21 Internet kiosks to provide the general public greater access to
 
22 information on the Internet.
 
23      SECTION 8.  The sum appropriated shall be expended by the

 1 Hawaii state public library system for the purposes of this Act.
 
 2      SECTION 9.  This Act shall take effect upon its approval.
