DESCRIPTION:
Deems a request for approval granted if the insurance
commissioner takes no action on the request within thirty
calendar days. Eliminates the public hearing requirement for

                   A  BILL  FOR  AN  ACT

RELATING TO INSURANCE. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 431, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to article 2 to be appropriately
 
 3 designated and to read as follows:
 
 4      "�431:2-    Approval; when deemed effective.  Unless
 
 5 specifically exempted from this section, any approval required by
 
 6 law shall be deemed granted on the thirtieth calendar day
 
 7 following the filing of the request for approval if the
 
 8 commissioner does not take any affirmative action to grant or
 
 9 deny the approval within thirty calendar days of the request."
 
10      SECTION 2.  Section 431:14-120, Hawaii Revised Statutes, is
 
11 amended by amending subsection (a) to read as follows:
 
12      "(a)  The commissioner shall review filings as soon as
 
13 reasonably possible after they have been made to determine
 
14 whether they meet the requirements of this article.  [When all
 
15 the requirements of this article are met, the commissioner shall
 
16 hold public hearings on workers' compensation rate filings that
 
17 result in increases or decreases.  The public hearing notice
 
18 shall be mailed to the insurer, rating organization, or advisory
 
19 organization that made the filing and filed with the office of

 1 the lieutenant governor at least six calendar days before the
 
 2 hearing.  The public hearing notice requirement shall be exempt
 
 3 from section 92-41.]"
 
 4      SECTION 3.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 4.  This Act shall take effect upon its approval.
