                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislative reference bureau is requested to
 
 2 conduct a study on how independent schools can work together to
 
 3 create a consortium to finance the construction and renovation of
 
 4 educational facilities at independent not-for-profit elementary
 
 5 schools, secondary schools, universities, and colleges.  The
 
 6 study shall include the following:
 
 7      (1)  Conducting a survey of how other states finance the
 
 8           construction and renovation for both private sectarian
 
 9           and private non-sectarian elementary, secondary, and
 
10           post-secondary schools;
 
11      (2)  Researching and determining applicable federal and
 
12           state caselaw on this issue; and
 
13      (3)  Working with the Hawaii Association of Independent
 
14           Schools and other stakeholders to determine their
 
15           interests in using special purpose revenue bonds to
 
16           finance construction and renovation of their
 
17           facilities.
 
18 The legislative reference bureau shall submit to the legislature,
 
19 no later than twenty days prior to the regular session of 2001, a

 1 comprehensive report on this study.
 
 2      SECTION 2.  This Act shall take effect upon its approval.
