                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL FEES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  (a)  Notwithstanding any law to the contrary,
 
 2 there is established a pilot project at any public school whereby
 
 3 seventy per cent of the net receipts collected by a school from
 
 4 rental fees for usage of facilities by private organizations or
 
 5 individuals shall be deposited with that school for its own use
 
 6 rather than deposited into the State's general fund.  These
 
 7 moneys include but are not limited to classroom, parking lot,
 
 8 auditorium, and dining room rental fees.
 
 9      The remaining thirty per cent of the net receipts shall be
 
10 allocated to the district office to assist schools that service
 
11 type 1 and type 2 users.  Type 1 users are organizations such as
 
12 the Parent, Teacher, Student Association; school community-based
 
13 councils; DOE inservice workshops; A+ programs; and primary and
 
14 general elections.  Type 2 users are organizations such as
 
15 federal, state, and county agencies; non-profit community
 
16 organizations; youth athletic teams; private pre-school and after
 
17 school programs endorsed by the DOE; public hearings and
 
18 meetings; and other educational or recreational activities
 
19 approved by the school where no fees are assessed or collected.

 1      (b)  Rental fees collected, deposited, and expended at a
 
 2 school shall be:
 
 3      (1)  In accordance with the department of education's rules;
 
 4           and
 
 5      (2)  Approved by the department of education.
 
 6      (c)  Each school shall set its own rental fee schedule and
 
 7 shall not be subject to the department of education's fee
 
 8 schedule or rental fees, for usage of facilities during the pilot
 
 9 project; provided that type 1 and type 2 users shall be subject
 
10 to the department of education's fee schedule.  A school may
 
11 reduce rental fees in view of any improvements made by a renter.
 
12      SECTION 2.  The department of education shall report to the
 
13 legislature the total rental fees collected and how the moneys
 
14 were expended pursuant to this pilot project no later than twenty
 
15 days prior to the convening of the regular sessions of 2001 and
 
16 2002.
 
17      SECTION 3.  This Act shall take effect upon its approval and
 
18 shall be repealed on June 30, 2002.
