REPORT TITLE:
Campaign Spending 


DESCRIPTION:
Clarifies that terms of office used to set contribution limits
are unaffected by factors causing the terms of office to be
shorter than usual.  Requires candidates who withdraw or cease to
be candidates to return private contributions to the donors
within 4 years, and in the event of death, requires residual
contributions to escheat to the Hawaii election campaign fund or

                   A  BILL  FOR  AN  ACT

RELATING TO ELECTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 11-204, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a) (1)  No person[, other than a candidate for the
 
 4           candidate's own campaign, political party, political
 
 5           committees established and maintained by a national
 
 6           political party,] or any other entity shall make
 
 7           contributions to:
 
 8          [(1)] (A)  A candidate seeking nomination or election to
 
 9                a two-year office or to the candidate's committee
 
10                in an aggregate amount greater than $2,000 during
 
11                an election period;
 
12          [(2)] (B)  A candidate seeking nomination or election to
 
13                a four-year statewide office or to the candidate's
 
14                committee in an aggregate amount greater than
 
15                $6,000 during an election period; and
 
16          [(3)] (C)  A candidate seeking nomination or election to
 
17                a four-year nonstatewide office or to the
 
18                candidate's committee in an aggregate amount
 
19                greater than $4,000 during an election period.

 1           These limits shall not apply to a loan made to a
 
 2           candidate by a financial institution in the ordinary
 
 3           course of business.
 
 4      (2)  For purposes of this section, the length of term of an
 
 5           office shall be the usual length of term of the office
 
 6           as unaffected by reapportionment, a special election to
 
 7           fill a vacancy, or any other factor causing the term of
 
 8           the office the candidate is seeking to be less than the
 
 9           usual length of term of that office."
 
10      SECTION 2.  Section 11-214, Hawaii Revised Statutes, is
 
11 amended by amending subsection (a) to read as follows:
 
12      "(a)  All candidates who withdraw or cease to be candidates,
 
13 or committees directly associated with such candidates,
 
14 individuals who receive contributions but fail to file for
 
15 nomination, or committees or parties which discontinue their
 
16 activities covered in this subpart, shall return all residual
 
17 private contributions to the donors of such contributions within
 
18 four years if their identities are known, provided that if the
 
19 identity of any donor is not known, or the donor cannot be found,
 
20 such contribution shall escheat to the Hawaii election campaign
 
21 fund[.] or may be donated to a nonprofit organization of the
 
22 candidate's choice.  In the event of a death of a candidate, the
 
23 candidate's committee, if any, shall return all residual private

 1 contributions to the donors of such contributions, provided that
 
 2 any residual contributions not returned to the donors within
 
 3 sixty days of the candidate's death shall escheat to the Hawaii
 
 4 election campaign fund or may be donated to a nonprofit
 
 5 organization of the candidate's choice."
 
 6      SECTION 3.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 4.  This Act shall take effect upon approval.
