                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL FACILITIES.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Hawaii's future lies in its ability to provide
 
 2 its youth and young adults with a quality educational system.
 
 3 Over the years, the State has demonstrated its commitment to this
 
 4 goal by establishing new policies and increasing funding to
 
 5 support the educational needs of Hawaii's people.  However, one
 
 6 critical aspect of our educational system, which is sometimes
 
 7 overlooked, is the physical structure needed to provide students
 
 8 with an environment conducive to proper learning.
 
 9      The legislature finds that the State has invested over
 
10 $1,700,000,000 in the construction of school facilities for the
 
11 department of education and the University of Hawaii.  Through
 
12 the department of accounting and general services, and the
 
13 University of Hawaii, repair, maintenance, and improvement
 
14 services are performed to assure the health and safety of our
 
15 students.  Within the past six years, however, the severe
 
16 downturn in the State's economy has made it difficult to fund
 
17 repair, maintenance, and improvements at required levels.
 
18      The deferral of repair, maintenance, and improvement
 
19 projects is a short-sighted strategy, because any postponement of
 
20 relatively inexpensive work actually costs the State untold

 1 millions of dollars in future obligations.  To assure safe,
 
 2 structurally sound, and aesthetic educational facilities and to
 
 3 be fiscally responsible, the State needs to fund this repair,
 
 4 maintenance, and improvement backlog.
 
 5      The legislature finds and determines that the quality of
 
 6 public education in the State is related to the condition of its
 
 7 public educational facilities.  The physical facilities used by
 
 8 the department of education and the University of Hawaii provide
 
 9 the centerpiece around which all other educational activities
 
10 exist.  Adequate financing of repairs, maintenance, and
 
11 improvement is necessary to keep educational facilities
 
12 functional, architecturally sound, aesthetically pleasing, and in
 
13 compliance with building and safety codes to support quality
 
14 instruction, research, student, and community service programs.
 
15      The legislature further finds and determines that it is in
 
16 the best interest of the State to allocate tax revenues for the
 
17 purposes of repairing, maintaining, and improving the physical
 
18 facilities used by the department of education and the University
 
19 of Hawaii for public education.
 
20      Accordingly, the purpose of this Act is to appropriate
 
21 general funds for repair, maintenance, and improvement projects
 
22 to improve school facilities at the primary, secondary, and
 
23 college levels.  The general funds appropriated in this Act shall

 1 be used solely to manage, plan, design, repair, replace,
 
 2 maintain, renovate, and construct other related improvements to
 
 3 public education facilities under the management, control, and
 
 4 direction of the department of accounting and general services
 
 5 and the University of Hawaii.  The funds may be used for
 
 6 improvements including but not limited to, reroofing, mechanical
 
 7 and electrical systems, renovations, resurfacing, repainting,
 
 8 recarpeting, waterproofing, facility audits, and other general
 
 9 repair projects.
 
10      SECTION 2.  (a)  The expenditure of appropriations made
 
11 under this Act for any project with an estimated total cost of
 
12 less than $100,000 shall be exempt from the provisions of chapter
 
13 103D, Hawaii Revised Statutes; provided that:
 
14      (1)  Insofar as it is practical and based on specifications
 
15           developed by the respective expending agency, adequate
 
16           and reasonable competition of no fewer than three
 
17           quotations shall be solicited for each project;
 
18      (2)  Considering all factors, including quality, warranty,
 
19           and delivery, the award shall be made to the vendor
 
20           with the most advantageous quotation; and 
 
21      (3)  The procurement requirements shall not be artificially
 
22           divided or parceled so as to avoid competitive bidding
 
23           or competitive proposals.

 1      (b)  A separate contract file shall be maintained for each
 
 2 project funded under this Act.  Each contract file shall contain
 
 3 the following:
 
 4      (1)  All quotations received for the project;
 
 5      (2)  An explanation, if known, whenever fewer than three
 
 6           quotations are received; and
 
 7      (3)  A justification on the selection of the vendor.
 
 8      SECTION 3.  There is appropriated out of the general
 
 9 revenues of the State of Hawaii the sum of $30,000,000 or so much
 
10 thereof as may be necessary for fiscal year 2000-2001 for repair,
 
11 maintenance, and improvement projects for the department of
 
12 education.  
 
13      The sum appropriated shall be expended by the department of
 
14 accounting and general services for the purposes of this Act.
 
15      SECTION 4.  There is appropriated out of the general
 
16 revenues of the State of Hawaii the sum of $15,000,000 or so much
 
17 thereof as may be necessary for fiscal year 2000-2001 for repair,
 
18 maintenance, and improvement projects for the University of
 
19 Hawaii system. 
 
20      The sum appropriated shall be expended by the University of
 
21 Hawaii for the purposes of this Act.
 
22      SECTION 5.  Any unexpended or unencumbered balances of the
 
23 appropriations made by sections 3 and 4 of this Act to be

 1 expended in fiscal year 2000-2001 shall not lapse on at the end
 
 2 of fiscal year 2000-2001; provided that any unencumbered balances
 
 3 of the appropriations under section 3 and 4 of this Act as of the
 
 4 close of business on June 30, 2002, shall lapse as of that date.
 
 5      SECTION 6.  This Act shall take effect on July 1, 2000.
