                   A  BILL  FOR  AN  ACT

ESTABLISHING A COMMISSION TO CELEBRATE THE ONE-HUNDREDTH
   ANNIVERSARY OF THE ARRIVAL OF THE KOREANS TO HAWAII.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that members of the Korean
 
 2 community have contributed significantly and substantially to
 
 3 Hawaii.  Since the arrival of the first Koreans to Hawaii in
 
 4 1903, the rich culture and proud heritage of the Korean people
 
 5 have been and continues to be a positive influence upon life in
 
 6 Hawaii.  The year 2003 will mark the one-hundredth anniversary of
 
 7 their arrival in Hawaii.  In recognition of the great
 
 8 contributions of Koreans to our diverse and multicultural
 
 9 society, a celebration to commemorate their arrival and
 
10 subsequent achievements in Hawaii is appropriate.  
 
11      The purpose of this Act is to provide for the celebration of
 
12 the centennial anniversary of the Korean people in Hawaii.
 
13      SECTION 2.  There is established a temporary commission to
 
14 be known as the Korean centennial celebration commission which
 
15 shall have charge of all arrangements for the commemoration of
 
16 the centennial anniversary of the arrival of the first Koreans to
 
17 Hawaii.  The commission shall be placed within the office of the
 
18 governor for administrative purposes and shall cease to operate

 1 after December 31, 2003.
 
 2      The centennial celebration shall be immune from civil
 
 3 liability that may occur in the implementation of the
 
 4 celebration.
 
 5      SECTION 3.  The commission shall consist of fifteen members
 
 6 of the Korean community to be appointed by the governor without
 
 7 regard to section 26-34, Hawaii Revised Statutes.  The members
 
 8 shall represent government, labor, business, culture and the
 
 9 arts, and the community at large.  The governor shall designate
 
10 the chair of the commission from among the appointed members.  An
 
11 individual appointed to another commission is eligible to be
 
12 appointed as a member of this commission.   
 
13      The members shall not receive compensation for their
 
14 services but shall be reimbursed for necessary expenses,
 
15 including travel expenses, incurred in the performance of their
 
16 duties under this Act.
 
17      Any member of the commission shall be immune from civil
 
18 liability for any act done in connection with the performance of
 
19 their duties as provided in section 26-35.5, Hawaii Revised
 
20 Statutes.
 
21      SECTION 4.  The commission shall:
 
22      (1)  Prepare an overall program to celebrate the centennial
 
23           anniversary of the arrival of the Korean people in

 1           Hawaii, their significant contributions to the
 
 2           development of this State, and their culture and
 
 3           heritage;
 
 4      (2)  Identify a nonprofit organization that will be
 
 5           responsible for any moneys received or expended for the
 
 6           centennial anniversary celebration; and
 
 7      (3)  Develop, plan, and coordinate the various program
 
 8           activities that are to be scheduled throughout the year
 
 9           of the celebration and shall encourage the
 
10           participation of all segments of the Korean community.
 
11      In fulfilling its responsibilities, the commission shall
 
12 consult, cooperate with, and seek advice from appropriate Korean
 
13 organizations and agencies.
 
14      SECTION 5.  The commission may seek grants from public and
 
15 private sources and may accept donations to finance the projects,
 
16 programs, and activities of the centennial anniversary
 
17 celebration.  Any funds received by the commission shall be
 
18 turned over to the nonprofit organization responsible for any
 
19 moneys received or expended for the centennial anniversary
 
20 celebration.
 
21      Chapter 42F, Hawaii Revised Statutes, shall apply to any
 
22 grant or subsidy made pursuant to this Act by the legislature.
 
23      All property acquired by the commission shall be deposited

 1 for preservation in the Hawaii state public library system,
 
 2 museums, and public archives or shall otherwise be disposed of as
 
 3 directed by the commission.
 
 4      SECTION 6.  At the end of its term, the commission shall
 
 5 submit to the governor a final report of all its activities,
 
 6 including an accounting of all moneys received and disbursed.
 
 7 The report shall include a description of:
 
 8      (1)  The production, publication, and distribution of books,
 
 9           films, and other educational materials on the life and
 
10           experiences of Koreans in Hawaii;
 
11      (2)  Conferences, convocations, lectures, and seminars; and
 
12      (3)  Traveling exhibits, other exhibits, ceremonies,
 
13           theatrical productions, and other special events
 
14           commemorating the anniversary.
 
15      SECTION 7.  This Act shall take effect on July 1, 2000.
