Agribusiness Development


DESCRIPTION:
Carries over to fiscal year 2000-2001, any unexpended or
unencumbered funds at the close of fiscal year 1999-2000, for
expenses incurred in the performance of the duties of the
agribusiness development corporation board.  Allows the use of
such funds for grants for the development of an agricultural
subdivision in the Hamakua district on the island of Hawaii.

                   A  BILL  FOR  AN  ACT

RELATING TO AGRICULTURE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that with the decline of
 
 2 large-scale sugar operations in Hawaii, there is great need for
 
 3 the revitalization and diversification of agriculture.  In
 
 4 recognition of this need, the agribusiness development
 
 5 corporation (ADC) was established in 1994 to assist in this
 
 6 purpose.
 
 7      By Act 117, Session Laws of Hawaii 1999, the legislature
 
 8 appropriated $400,000 for ADC, with the intent that these funds
 
 9 be used for the planning, design, and construction of an
 
10 agricultural subdivision in the Hamakua district on the island of
 
11 Hawaii, which was one of the areas severely affected by the
 
12 decline of the sugar industry.  However, this appropriation has
 
13 not yet been utilized for this purpose and these funds are now in
 
14 danger of lapsing.  Therefore, the legislature finds it necessary
 
15 to extend the appropriation to June 30, 2001, which will allow
 
16 ADC to expend any heretofore unencumbered funds without having to
 
17 make a new appropriation.
 
18      The purpose of this Act is to:
 
19      (1)  Carry over to fiscal year 2000-2001, any unexpended or
 
20           unencumbered funds at the close of fiscal year 1999-

 1           2000, for expenses incurred in the performance of the
 
 2           duties of the ADC board; and
 
 3      (2)  Allow the use of such funds for grants for the
 
 4           development of an agricultural subdivision in the
 
 5           Hamakua district on the island of Hawaii.
 
 6      SECTION 2.  Act 117, Session Laws of Hawaii 1999, is amended
 
 7 by amending section 4 to read as follows:
 
 8      "SECTION 4.  There is appropriated out of the general
 
 9 revenues of the State of Hawaii the sum of $400,000 or so much
 
10 thereof as may be necessary for fiscal year 1999-2000 for the
 
11 expenses incurred in the performance of the duties of the
 
12 agribusiness development corporation board[.]; provided that:
 
13      (1)  Any unexpended or unencumbered funds at the close of
 
14           fiscal year 1999-2000 may be expended or encumbered
 
15           during fiscal year 2000-2001, and shall not lapse until
 
16           June 30, 2001; and
 
17      (2)  The agribusiness development corporation may use
 
18           $250,000 for grants for the development of an
 
19           agricultural subdivision in the Hamakua district on the
 
20           island of Hawaii.
 
21      The sum appropriated shall be expended by the department of
 
22 agriculture for the purposes of this Act."

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect on June 29, 2000.
