                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL LUNCH.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to set the price of
 
 2 school lunch in proportion to the total cost of operating the
 
 3 school food services program, and to allow the department of
 
 4 education to adjust the price to maintain this proportion.
 
 5      SECTION 2.  Section 302A-405, Hawaii Revised Statutes, is
 
 6 amended by amending subsection (a) to read as follows:
 
 7      "(a)  The price for the school lunch shall be [no more than
 
 8 $1 per child;] set by the department to ensure that moneys
 
 9 received from the sale of the lunches shall be up to one-third of
 
10 the cost of preparing the school lunch, rounded to the nearest
 
11 twenty-five cents, adjusted during the first year of the fiscal
 
12 biennium.  The price for the school lunch shall be based on the
 
13 average cost of preparing the school lunch over the three years
 
14 preceding the second year of the fiscal biennium; provided that
 
15 the department by rule shall provide a lower rate or free lunches
 
16 to children based on their economic need."
 
17      SECTION 3.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 4.  This Act shall take effect on July 1, 2001.
