REPORT TITLE:
Agriculture


DESCRIPTION:
Allows authorized federal agencies to act on behalf of the
department of agriculture (DOA), to a limited extend, and enforce
statutes and administrative rules regarding the movement of
restricted items into the State or within the State.  Makes
housekeeping amendments to include the seeds law under chapter
150, Hawaii Revised Statutes (HRS) and the plant and non-domestic
animal quarantine law under chapter 150A HRS, among the chapters
to which the DOA's various duties in section 141-1, HRS, are

                   A  BILL  FOR  AN  ACT

RELATING TO AGRICULTURE.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 141-1, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�141-1  Duties in general.  The department of agriculture
 
 4 shall:
 
 5      (1)  [Information and statistics.]  Gather, compile, and
 
 6           tabulate, from time to time, information and statistics
 
 7           concerning:
 
 8           (A)  Entomology and plant pathology[.]: Insects,
 
 9                scales, blights, and diseases injurious, or liable
 
10                to become injurious, to trees, plants, or other
 
11                vegetation, and the ways and means of
 
12                exterminating pests and diseases already in the
 
13                State and preventing the introduction of those not
 
14                yet here;and
 
15           (B)  General agriculture[.]:  Fruits, fibres, and
 
16                useful or ornamental plants and their
 
17                introduction, development, care, and manufacture
 
18                or exportation, with a view to introducing,
 
19                establishing, and fostering new and valuable
 
20                plants and industries[.];

 1      (2)  [Cooperation with other organizations.]  Encourage and
 
 2           cooperate with the agricultural extension service and
 
 3           agricultural experiment station of the University of
 
 4           Hawaii and all private persons and organizations doing
 
 5           work of an experimental or educational character coming
 
 6           within the scope of the subject matter of chapters 141,
 
 7           142, and 144 to [149A,] 150A, and avoid, as far as
 
 8           practicable, duplicating the work of those persons and
 
 9           organizations;
 
10      (3)  [Agreements with other organizations.]  Enter into
 
11           contracts, cooperative agreements, or other
 
12           transactions with any person, agency, or organization,
 
13           public or private, as may be necessary in the conduct
 
14           of the department's business and on such terms as the
 
15           department may deem appropriate; provided that the
 
16           department shall not obligate any funds of the State,
 
17           except the funds that have been appropriated to the
 
18           department[;].  Pursuant to cooperative agreement with
 
19           any authorized federal agency, employees of the
 
20           cooperative agency may be designated to carry out, on
 
21           behalf of the State the same as department personnel,
 
22           specific duties and responsibilities under chapters

 1           141, 142, 150A, and rules adopted pursuant to those
 
 2           chapters, for the effective prosecution of pest
 
 3           control, and animal disease control, and regulation of
 
 4           import into the State and intrastate movement of
 
 5           regulated articles;
 
 6      (4)  [Library.]  Secure copies of the laws of other states,
 
 7           territories, and countries, and other publications
 
 8           germane to the subject matters of chapters 141, 142,
 
 9           and 144 to [149A,] 150A, and make laws and publications
 
10           available for public information and consultation;
 
11      (5)  [Buildings and apparatus.]  Provide buildings, grounds,
 
12           apparatus, and appurtenances necessary for the
 
13           examination, quarantine, inspection, and fumigation
 
14           provided for by chapters 141, 142, and 144 to [149A;]
 
15           150A; for the obtaining, propagation, study, and
 
16           distribution of beneficial insects, growths, and
 
17           antidotes for the eradication of insects, blights,
 
18           scales, or diseases injurious to vegetation of value
 
19           and for the destruction of injurious vegetation; and
 
20           for carrying out any other purposes of chapters 141,
 
21           142, and 144 to [149A;] 150A;
 
22      (6)  [Further legislation.]  Formulate and recommend to the
 
23           governor and legislature additional legislation

 1           necessary or desirable for carrying out the purposes of
 
 2           chapters 141, 142, and 144 to [149A;] 150A;
 
 3      (7)  [Annual reports.]  Publish at the end of each year a
 
 4           report of the expenditures and proceedings of the
 
 5           department and of the results achieved by the
 
 6           department, together with other matters germane to
 
 7           chapters 141, 142, and 144 to [149A,] 150A, and which
 
 8           the department may deem proper;
 
 9      (8)  [Planning and development.]  Administer a program of
 
10           agricultural planning and development, including the
 
11           formulation and implementation of general and special
 
12           plans, including but not limited to the functional plan
 
13           for agriculture; administer the planning, development,
 
14           and management of the agricultural park program; plan,
 
15           construct, operate, and maintain the state irrigation
 
16           water systems; review, interpret, and make
 
17           recommendations with respect to public policies and
 
18           actions relating to agricultural land and water use;
 
19           assist in research, evaluation, development,
 
20           enhancement, and expansion of local agricultural
 
21           industries; and serve as liaison with other public
 
22           agencies and private organizations for the above
 
23           purposes.  In the foregoing, the department of

 1           agriculture shall act to conserve and protect
 
 2           agricultural lands and irrigation water systems,
 
 3           promote diversified agriculture, increase agricultural
 
 4           self-sufficiency, and ensure the availability of
 
 5           agriculturally suitable lands."
 
 6      SECTION 2.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect upon its approval.
