REPORT TITLE:
State Parks Special Fund


DESCRIPTION:
Establishes the state parks special fund.  Transfers the
unexpended balance of the 'aina ho'omalu special fund calculated
as of the close of business on June 30, 2000, to the credit of
the state parks special fund.  Appropriates funds from the state
parks special fund to be expended by the department of land and

                   A  BILL  FOR  AN  ACT

RELATING TO STATE PARKS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 184, Hawaii Revised Statutes, is amended
 
 2 by adding to part I a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�184-     State parks special fund.  (a)  There is
 
 5 established within the state treasury a fund to be known as the
 
 6 state parks special fund.  All proceeds collected by the state
 
 7 parks programs involving park user fees, any leases or concession
 
 8 agreements, the sale of any article purchased from the department
 
 9 to benefit the state parks programs, or any gifts or
 
10 contributions, shall be deposited into this fund; provided that
 
11 proceeds derived from the operation of Iolani Palace shall be
 
12 used to supplement its educational and interpretive programs.
 
13      (b)  The department shall expend the moneys from the state
 
14 parks special fund for the following purposes:
 
15      (1)  Permanent and temporary staff positions;
 
16      (2)  Planning and development of state parks programs,
 
17           including the aina hoomalu state parks program;
 
18      (3)  Construction, repairs, replacement, additions, and
 
19           extensions of state parks facilities;

 1      (4)  Operation and maintenance costs of state parks and
 
 2           state parks programs; and
 
 3      (5)  Administrative costs of the division of state parks."
 
 4      SECTION 2.  Section 184-32, Hawaii Revised Statutes, is
 
 5 repealed.
 
 6      ["[�184-32]  Aina hoomalu special fund.(a)  There is
 
 7 established within the state treasury a special fund to be known
 
 8 as the aina hoomalu special fund.  All proceeds collected by the
 
 9 state parks program involving park user fees or any leases or
 
10 concession agreements shall be deposited into this fund, provided
 
11 that proceeds derived from the operation of Iolani Palace shall
 
12 be used to supplement its educational and interpretive programs.
 
13      (b)  The department shall expend the moneys from the aina
 
14 hoomalu special fund after July 1, 1992.  The funds shall be used
 
15 for the following purposes:
 
16      (1)  Permanent staff positions;
 
17      (2)  Planning and development of interpretive programs;
 
18      (3)  Construction of interpretive facilities;
 
19      (4)  Repairs, replacements, additions, and extensions;
 
20      (5)  Operation and maintenance costs of programs; and
 
21      (6)  Administrative costs of the division of state parks."]
 
22      SECTION 3.  The director of finance shall transfer the
 
23 unexpended balance, including encumbrances and accrued

 1 liabilities, of the aina hoomalu special fund calculated as of
 
 2 the close of business on June 30, 2000, to the credit of the
 
 3 state parks special fund.  Encumbered moneys shall continue to be
 
 4 encumbered until paid out or released from prior encumbrances.
 
 5      SECTION 4.  There is appropriated out of the state parks
 
 6 special fund the sum of $500,000 or so much thereof as may be
 
 7 necessary for fiscal year 2000-2001 to be expended by the
 
 8 department of land and natural resources for the purposes of the
 
 9 state parks special fund.
 
10      SECTION 5.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 6.  This Act shall take effect on June 29, 2000,
 
13 except that sections 2 and 4 shall take effect on July 1, 2000.
