                   A  BILL  FOR  AN  ACT

RELATING TO CONTROLLED SUBSTANCES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 329-14, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  Any of the following opiates, including their isomers,
 
 4 esters, ethers, salts, and salts of isomers, esters, and ethers,
 
 5 unless specifically excepted, whenever the existence of these
 
 6 isomers, esters, ethers, and salts is possible within the
 
 7 specific chemical designation:
 
 8     [(1)  Acetylmethadol;
 
 9      (2)  Allylprodine;
 
10      (3)  Alphacetylmethadol;
 
11      (4)  Alphameprodine;

 4 to:
 
 5     [(1)  Dronabinol (synthetic), in sesame oil and encapsulated
 
 6           in a soft gelatin capsule in a United States Food and
 
 7           Drug Administration approved drug product; and
 
 8      (2)] Nabilone."
 
 9      SECTION 4.  Section 329-18, Hawaii Revised Statutes, is
 
10 amended to read as follows:
 
11      "�329-18  Schedule III.(a)  The controlled substances
 
12 listed in this section are included in schedule III.
 
13      (b)  Stimulants.  Unless listed in another schedule, any
 
14 material, compound, mixture, or preparation which contains any
 
15 quantity of the following substances having a stimulant effect on
 
16 the central nervous system, including their salts, isomers, and
 
17 salts of isomers, whenever the existence of these salts, isomers,
 
18 and salts of isomers is possible within the specific chemical
 
19 designation:
 
20      (1)  Those compounds, mixtures, or preparations in dosage
 
21           unit form containing any stimulant substance listed in
 
22           schedule II, and any other drug of the quantitative
 
23           composition or which is the same except that it
 
24           contains a lesser quantity of controlled substances;

10      (1)  Any compound, mixture, or preparation containing
 
11           amobarbital, secobarbital, pentobarbital, or any salt
 
12           thereof and one or more other active medicinal
 
13           ingredients which are not listed in any schedule;
 
14      (2)  Any suppository dosage form containing amobarbital,
 
15           secobarbital, pentobarbital, or any salt of any of
 
16           these drugs and approved by the Food and Drug
 
17           Administration for marketing only as a suppository;
 
18      (3)  Any substance that contains any quantity of a

12      (1)  Not more than 1.8 grams of codeine, or any of its
 
13           salts, per 100 milliliters or not more than 90
 
14           milligrams per dosage unit, with an equal or greater
 
15           quantity of an isoquinoline alkaloid of opium;
 
16      (2)  Not more than 1.8 grams of codeine, or any of its
 
17           salts, per 100 milliliters or not more than 90
 
18           milligrams per dosage unit, with one or more active,
 
19           nonnarcotic ingredients in recognized therapeutic
 
20           amounts;
 
21      (3)  Not more than 300 milligrams of dihydrocodeinone
 
22           (Hydrocodone), or any of its salts, per 100 milliliters
 
23           or not more than 15 milligrams per dosage unit, with a

 1           fourfold or greater quantity of an isoquinoline
 
 2           alkaloid of opium provided that these narcotic drugs
 
 3           shall be monitored pursuant to section 329-101;
 
 4      (4)  Not more than 300 milligrams of dihydrocodeinone
 
 5           (Hydrocodone), or any of its salts per 100 milliliters
 
 6           or not more than 15 milligrams per dosage unit, with
 
 7           one or more active, nonnarcotic ingredients in
 
 8           recognized therapeutic amounts provided that these
 
 9           narcotic drugs shall be monitored pursuant to section
 
10           329-101;
 
11      (5)  Not more than 1.8 grams of dihydrocodeine, or any of
 
12           its salts, per 100 milliliters or not more than 90
 
13           milligrams per dosage unit, with one or more active,
 
14           nonnarcotic ingredients in recognized therapeutic
 
15           amounts;
 
16      (6)  Not more than 300 milligrams of ethylmorphine, or any
 
17           of its salts, per 100 milliliters or not more than 15
 
18           milligrams per dosage unit, with one or more
 
19           ingredients in recognized therapeutic amounts;
 
20      (7)  Not more than 500 milligrams of opium per 100
 
21           milliliters or per 100 grams, or not more than 25
 
22           milligrams per dosage unit, with one or more active
 
23           nonnarcotic ingredients in recognized therapeutic

 1      (8)  Not more than 50 milligrams of morphine or any of its
 
 2           salts, per 100 milliliters or per 100 grams with one or
 
 3           more active, nonnarcotic ingredients in recognized
 
 4           therapeutic amounts.
 
 5      (f)  The department of public safety may except by rule any
 
 6 compound, mixture, or preparation containing any stimulant or
 
 7 depressant substance listed in subsections (b) and (c) from the
 
 8 application of all or any part of this chapter if the compound,
 
 9 mixture, or preparation contains one or more active medicinal
 
10 ingredients not having a stimulant or depressant effect on the
 
11 central nervous system, and if the admixtures are included
 
12 therein in combinations, quantity, proportion, or concentration
 
13 that vitiate the potential for abuse of the substances which have
 
14 a stimulant or depressant effect on the central nervous system.
 
15      (g)  Any anabolic steroid.  The term "anabolic steroid"
 
16 means any drug or hormonal substance chemically and
 
17 pharmacologically related to testosterone (other than estrogens,
 
18 progestins, and corticosteroids) that promotes muscle growth, and
 
19 includes:
 
20      (1)  Boldenone;
 
21      (2)  Clostebol (4-Chlorotestosterone);
 
22      (3)  Dehydrochlormethyltestosterone;
 
23      (4)  Dihydrotestosterone (4-dihydrotestosterone);

 1      (5)  Drostanolone;

 1           term "anabolic steroid" does not include an anabolic
 
 2           steroid which is expressly intended for administration
 
 3           through implants to cattle or other nonhuman species
 
 4           and which has been approved by the Secretary of Health
 
 5           and Human Services for nonhuman administration.  If any
 
 6           person prescribes, dispenses, or distributes an
 
 7           anabolic steroid intended for administration to
 
 8           nonhuman species for human use, the person shall be
 
 9           considered to have prescribed, dispensed, or
 
10           distributed an anabolic steroid within the meaning of
 
11           this paragraph.
 
12      (h)  Hallucinogenic substances, including but not limited
 
13 to: Dronabinol (synthetic), in sesame oil and encapsulated in a
 
14 soft gelatin capsule in a United States Food and Drug
 
15 Administration approved drug product."
 
16      SECTION 5.  Section 329-20, Hawaii Revised Statutes, is
 
17 amended to read as follows:

15 salts of such isomers whenever the existence of such salts,
 
16 isomers, and salts of isomers is possible within the specific
 
17 chemical designation:
 
18      (1)  Diethylpropion;
 
19      (2)  Phentermine;
 
20      (3)  Pemoline (including organometallic complexes and
 
21           chelates thereof).
 
22      (e)  Other substances.  Unless specifically excepted or
 
23 unless listed in another schedule, any material, compound,

 1 mixture, or preparation which contains any quantity of the

 4      (2)] Pentazocine.
 
 5      (f)  The department of public safety may except by rule any
 
 6 compound, mixture, or preparation containing any depressant
 
 7 substance listed in subsection (b) or any stimulant listed in
 
 8 subsection (d) from the application of all or any part of this
 
 9 chapter if the compound, mixture, or preparation contains one or
 
10 more active medicinal ingredients not having a depressant or
 
11 stimulant effect on the central nervous system, and if the
 
12 admixtures are included therein in combinations, quantity,
 
13 proportion, or concentration that vitiate the degree of danger or
 
14 probable danger of the substances which have a depressant or
 
15 stimulant effect on the central nervous system.
 
16      (g)  Narcotic drugs.  Unless specifically excepted or unless
 
17 listed in another schedule, any material, compound, mixture, or
 
18 preparation containing any of the following narcotic drugs, or
 
19 their salts calculated as the free anhydrous base or alkaloid, in
 
20 limited quantities as set forth below:
 
21      (1)  Not more than one milligram of difenoxin and not less
 
22           than twenty-five micrograms of atropine sulfate per
 
23           dosage unit (modafinil); and

 1      (2)  Dextropropoxyphene (alpha-(+)-4-dimethylamino-1, 2-
 
 2           diphenyl-3-methyl-2-propionoxybutane)."
 
 3      SECTION 6.  Section 329-42, Hawaii Revised Statutes, is
 
 4 amended by amending subsection (a) to read as follows:
 
 5      "(a)  It is unlawful for any person knowingly or
 
 6 intentionally:
 
 7      (1)  To distribute as a registrant a controlled substance
 
 8           classified in schedule I or II, except pursuant to an
 
 9           order form as required by section 329-37;
 
10      (2)  To use in the course of the manufacture or distribution
 
11           of a controlled substance a registration number that is
 
12           fictitious, revoked, suspended, or issued to another
 
13           person;
 
14      (3)  To [acquire or] obtain [possession of a controlled
 
15           substance by misrepresentation, fraud, forgery,
 
16           deception, or subterfuge;] or attempt to obtain any
 
17           controlled substance or procure or attempt to procure
 
18           the administration of any controlled substance:
 
19           (A)  By fraud, deceit, misrepresentation, embezzlement,
 
20                theft;
 
21           (B)  By the forgery or alteration of a prescription or
 
22                of any written order;

 1           (C)  By furnishing fraudulent medical information or
 
 2                the concealment of a material fact; or
 
 3           (D)  By the use of a false name, patient identification
 
 4                number, or the giving of false address;
 
 5      (4)  To furnish false or fraudulent material information in,
 
 6           or omit any material information from, any application,
 
 7           report, or other document required to be kept or filed
 
 8           under this chapter, or any record required to be kept
 
 9           by this chapter;
 
10      (5)  To make, distribute, or possess any punch, die, plate,
 
11           stone, or other thing designed to print, imprint, or
 
12           reproduce the trademark, trade name, or other
 
13           identifying mark, imprint, or device of another or any
 
14           likeness of any of the foregoing upon any drug or
 
15           container or labeling thereof so as to render the drug
 
16           a counterfeit substance;
 
17      (6)  To misapply or divert to the person's own use or other
 
18           unauthorized or illegal use or to take, make away with,
 
19           or secrete, with intent to misapply or divert to the
 
20           person's own use or other unauthorized or illegal use,
 
21           any controlled substance that shall have come into the
 
22           person's possession or under the person's care as a
 
23           registrant or as an employee of a registrant who is

 1           authorized to possess controlled substances or has
 
 2           access to controlled substances by virtue of the
 
 3           person' employment; or
 
 4      (7)  To make, distribute, possess, or sell any prescription
 
 5           form, whether blank, faxed, computer generated,
 
 6           photocopied, or reproduced in any other manner without
 
 7           the authorization of the licensed practitioner."
 
 8      SECTION 7.  Section 329-69, Hawaii Revised Statutes, is
 
 9 amended to read as follows:
 
10      "[[]�329-69[]]  Subpoena powers.  Subject to the privileges
 
11 which witnesses have in the courts of this State, the director of
 
12 public safety or the director's designated subordinate is
 
13 empowered pursuant to and in accordance with the rules of court
 
14 to subpoena witnesses, examine them under oath and require the
 
15 production of books, papers, documents or objects where the
 
16 director of public safety reasonably believes the information
 
17 sought is relevant or material to enforcement of this [part.]
 
18 chapter.  Books, papers, documents, or objects obtained pursuant
 
19 to exercise of these powers may be retained by the director of
 
20 public safety or the director's designate for [a reasonable
 
21 period of time] forty-eight hours for the purpose of examination,
 
22 audit, copying, testing, or photographing.  Upon application by
 
23 the director of public safety, obedience to the subpoenas may be

 1 enforced by the circuit court in the county where the person
 
 2 subpoenaed resides or is found in the same manner as a subpoena
 
 3 issued by the clerk of a circuit court."
 
 4      SECTION 8.  Statutory material to be repealed is
 
 5 bracketed, except bracketed material contained within the name
 
 6 of the new substances listed in section 329-14(b), Hawaii Revised
 
 7 Statutes, in section 1 of this Act is not to be repealed.  New
 
 8 statutory material is underscored.
 
 9      SECTION 9.  This Act shall take effect upon its approval.
