                     A BILL FOR AN ACT

RELATING TO PAWN BROKERS AND SECONDHAND DEALERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 486M-1, Hawaii Revised Statutes, is
 
 2 amended by adding a new definition to be appropriately inserted
 
 3 and to read as follows:
 
 4      ""Government issued identification" means:
 
 5      (1)  A passport issued by the United States of America;
 
 6      (2)  A drivers license issued pursuant to any state or
 
 7           District of Columbia law;
 
 8      (3)  An identification card issued by any state or local
 
 9           government or the Bureau of Indian Affairs; or
 
10      (4)  An identification card issued by any branch of the
 
11           Armed Forces of the United States of America."
 
12      SECTION 2.  Section 486M-2, Hawaii Revised Statutes, is
 
13 amended to read as follows:
 
14      "�486M-2  Record of transactions.  Every dealer, or the
 
15 agent, employee, or representative of the dealer shall,
 
16 immediately upon receipt of any article, record the following
 
17 information, on a form authorized by the chief of police in each
 
18 county:
 
19      (1)  The name and address of the dealer;
 
20      (2)  The name, residence address, date of birth, and the age

 1           of the person from whom the article was received; 
 
 2      (3)  The date and time the article was received by the
 
 3           dealer; 
 
 4      (4)  The signature of the person from whom the article was
 
 5           received; 
 
 6      (5)  The Hawaii drivers license number, or if the person
 
 7           does not possess a Hawaii drivers license, the number
 
 8           of and description of any government issued
 
 9           identification which bears a photograph of the person
 
10           from whom the article was received; 
 
11      (6)  A complete and accurate description of the article
 
12           received, including all markings, names, initials, and
 
13           inscriptions; 
 
14      (7)  A reasonable estimate of the fineness and weights of
 
15           the precious and semiprecious metals and precious and
 
16           semiprecious gems received; and 
 
17      (8)  The price paid by the dealer for each article.
 
18      Upon request and at the discretion of the chief of police of
 
19 each county, copies of all completed forms required by this
 
20 section shall be surrendered, mailed, or electronically inputted
 
21 and transmitted via modem or by facsimile transmittal to the
 
22 chief of police or to the chief of police's authorized
 
23 representative.  The method of submittal to the chief of police

 1 shall be at the option of the dealer." 
 
 2      SECTION 3.  This Act does not affect rights and duties that
 
 3 matured, penalties that were incurred, and proceedings that were
 
 4 begun, before its effective date. 
 
 5      SECTION 4.  New statutory material is underscored.
 
 6      SECTION 5. This Act shall take effect upon its approval.
