                     A BILL FOR AN ACT

RELATING TO EMPLOYMENT COMPENSATION IN THE JUDICIARY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to amend Act 65,
 
 2 Session Laws of Hawaii 1999, which provided a four per cent
 
 3 increase in judicial salaries for each year over the two-year
 
 4 period beginning July 1, 1999.  This Act provides a judicial
 
 5 salary increase of eleven per cent in each of the two referenced
 
 6 years.
 
 7      SECTION 2.  Section 602-2, Hawaii Revised Statutes, is
 
 8 amended to read as follows:
 
 9      "�602-2 Salary, supreme court justices.  Effective July 1,
 
10 1999, the salary of the chief justice of the supreme court shall
 
11 be [$98,571] $105,206 a year and the salary of each associate
 
12 justice of the supreme court shall be [$97,531] $104,096 a year.
 
13 Effective July 1, 2000, the salary of the chief justice of the
 
14 supreme court shall be [$102,514] $116,779 a year and the salary
 
15 of each associate justice of the supreme court shall be
 
16 [$101,432] $115,547 a year."
 
17      SECTION 3.  Section 602-52, Hawaii Revised Statutes, is
 
18 amended to read as follows:

 1      "�602-52  Salary.  Effective July 1, 1999, the salary of the
 
 2 chief judge of the intermediate appellate court shall be
 
 3 [$94,931] $101,321 a year and the salary of each associate judge
 
 4 shall be [$93,371] $99,656 a year.  Effective July 1, 2000, the
 
 5 salary of the chief judge of the intermediate appellate court
 
 6 shall be [$98,728] $112,466 a year and the salary of each
 
 7 associate judge shall be[$97,106] $110,618 a year."
 
 8      SECTION 4.  Section 603-5, Hawaii Revised Statutes, is
 
 9 amended to read as follows:
 
10      "�603-5 Salary of circuit court judges.  Effective July 1,
 
11 1999, the salary of each circuit court judge of the various
 
12 circuit courts of the State shall be [$90,251] $96,326 a year.
 
13 Effective July 1, 2000, the salary of each circuit court judge of
 
14 the various circuit courts of the State shall be [$93,861]
 
15 $106,922 a year." 
 
16      SECTION 5.   Section 604-2.5, Hawaii Revised Statutes, is
 
17 amended to read as follows:
 
18      "�604-2.5  Salary of district judges.  Effective July 1,
 
19 1999, the salary of each district court judge of the various
 
20 district courts of the State shall be [$85,051] $90,776 a year.
 
21 Effective July 1, 2000, the salary of each district court judge
 
22 of the various district courts of the State shall be [$88,453]
 
23 $100,761 a year.

 1      Whenever the chief justice appoints a district court judge
 
 2 of any of the various district courts of the State to serve
 
 3 temporarily as a circuit court judge of any of the various
 
 4 circuit courts of the State, the judge shall receive per diem
 
 5 compensation for the days on which actual service is rendered
 
 6 based on the monthly rate of compensation paid to a circuit court
 
 7 judge.  For the purpose of determining per diem compensation in
 
 8 this section, a month shall be deemed to consist of twenty-one
 
 9 days."
 
10      SECTION 6.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 7.  This Act, upon approval, shall take effect
 
13 retroactive to July 1, 1999.
