         State.  Empowers the commission to authorize new
         retail service stations and determine whether
         they may be operated by a petroleum utility;
         restrict price increases when prices rise above a
         certain percentage over a benchmark market, as
         determined by rules adopted by the commission;
         decide when a utility may convert a station from
         one operated by a dealer to one operated by a
         utility, and vice versa; and decide when a
         utility may close a station, to prevent
         communities from being underserved.

  94     RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM        LAB,FIN
         Provides a military service credit of up to 4
         years to qualified retirants of the ERS.

         Requires the Public Utilities Commission to
         establish rules ensuring that the cost of fuel
         for state vehicles is based on the mainland rack
         price.

         Clarifies existing penalty provisions applied to
         contractors who violate Chapter 104, HRS, which
         deals with the wages and hours of employees on
         public works.

         Clarifies that the penalty applied to employers
         for unjustified wage withholding will be equal to
         the amount of unpaid wages and interest at a rate
         of six per cent per year from the date the wages
         were due.

         Amends the Whistleblowers' Protection Act by
         expanding areas of protected conduct and the
         types of reportable violations.  Also strengthens
         the remedies available to whistleblowers and
         increases penalties for violators.

 104     RELATING TO THE PUBLIC EMPLOYEES HEALTH FUND        LAB,FIN
         Enables the Employer-Union Trust Concept
         Committee to continue its work to proceed with
         conversion to an employer-union trust concept for
         administering public employee and retiree health
         benefits.

         Prohibits Fire Protection Services from accepting
         employment applications from persons older than
         32 years of age.

         system.  Requires the land use commission, the

         Eliminates limitations on long-term health
         insurance premium payments with respect to
         medical deductions from income when computing
         taxable income.

         Authorizes a county transient accommodations tax.
         Lowers the rate of the state transient
         accommodations tax.  Eliminates distribution of
         state transient accommodations revenues to

         Establishes a 3% rate of general excise tax for
         amounts received by licensed taxpayers from other

         Establishes a ban on the importation, storage,
         sale and use of aerial common fireworks, except

         Provides that counties may establish by
         ordinance, supplemental maintenance, safety, or
         security services assessment districts.  Exempts
         boards or associations created pursuant to the
         establishment of the assessment districts from
         the public procurement code.  Sets time limits on
         the initiation of actions disputing the
         establishment and administration of the
         assessment districts.

         Defines local resident in the State procurement

         OF THE HAWAII CONSTITUTION, TO CHANGE THE
         ELIGIBILITY REQUIREMENTS FOR MEMBERSHIP IN THE

         Proposes an amendment to Article III, section 6,
         of the State Constitution to require that, prior
         to filing nomination papers for the primary
         election, a candidate for state legislative
         office shall be a qualified voter in the district
         that the candidate seeks to represent.(ConAm)

 165     RELATING TO ELECTIONS                               JHA
         Amends the definition of contribution to include
         gifts to committees.  Provides that political
         parties shall be subject to the same contribution
         limits applicable to persons and other entities.
         Reduces the amount of contributions that may be
         made to a political party in any two year
         election period from $50,000 to $6,000.

         Requires reporting in addition to any other
         reports required by law, of campaign
         contributions aggregating in excess of $500, made
         or received within the period of 15 calendar days

         Establishes a graduated licensing procedure for

         Insurance Program.

         Establishes the tobacco agreement special fund to
         consist of half of the amount paid to the state
         by the tobacco companies pursuant to the tobacco
         agreement.  Specifies that the special fund is to
         be used for programs to provide tobacco use
         prevention services and health-related
         initiatives.

 176     RELATING TO TOBACCO TAX                             HLT,CPC/JHA,FIN
         Provides that the excise tax on cigarettes shall
         be imposed and collected through the use of
         stamps purchased by wholesalers and dealers, and
         affixed to cigarette packages. Includes
         provisions for civil and criminal penalties, and
         for forfeitures of cigarettes, to be enforced by
         the police departments, liquor commissions,
         attorney general, and prosecuting attorneys.
         Mandates repeal of the law in 2005 upon a finding
         by the state auditor that the law has not reduced
         the loss of tax revenue due to the illegal sale
         of untaxed cigarettes.
