                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE DEPARTMENT OF EDUCATION TO DEVELOP A PHYSICAL
    EDUCATION PROGRAM FOR SPECIAL EDUCATION STUDENTS.



 1        WHEREAS, the United States Congress passed the
 2   "Individuals with Disabilities Education Act," finding that
 3   "disability is a natural part of the human experience and in no
 4   way diminishes the right of individuals to participate in or
 5   contribute to society"; and 
 6   
 7        WHEREAS, Congress further found that "improving
 8   educational results for children with disabilities is an
 9   essential element of our national policy of ensuring equality
10   of opportunity, full participation, independent living, and
11   economic self-sufficiency for individuals with disabilities";
12   and 
13   
14        WHEREAS, currently there are special education students in
15   every school in this State; and 
16   
17        WHEREAS, physical education is an important and necessary
18   component of the public school curriculum that should be taught
19   to all students; and 
20   
21        WHEREAS, currently, there is no physical education program
22   specifically designed to meet the physical fitness needs of
23   special education students; and 
24   
25        WHEREAS, as a result, special education students are not
26   receiving the most effective physical education in the Hawaii
27   public schools; now, therefore,
28   
29        BE IT RESOLVED by the Senate of the Twentieth Legislature
30   of the State of Hawaii, Regular Session of 1999, the House of
31   Representatives concurring, that the Department of Education is
32   requested to develop a physical education program for special
33   education students; and
34   
35        BE IT FURTHER RESOLVED that the Superintendent of
36   Education is requested to report on the Department's progress

 1   to the Legislature twenty days before the convening of the
 2   Regular Session of 2000; and 
 3   
 4        BE IT FURTHER RESOLVED that a certified copy of this
 5   Concurrent Resolution be transmitted to the Department of
 6   Education and the Superintendent of Education.
