                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE LIMITED INVOLVEMENT OF SCHOOL PRINCIPALS IN
    COMPLYING WITH THE FELIX-WAIHEE CONSENT DECREE.



 1        WHEREAS, on October 25, 1994, the federal court approved a
 2   consent decree requiring the state government to create an
 3   appropriate and coordinated system of educational and mental
 4   health services for children and adolescents up to age twenty
 5   with disabilities by June 30, 2000; and
 6   
 7        WHEREAS, the requirements to comply with the consent
 8   decree have placed an undue burden upon the principal of each
 9   public school and reduced their efforts to administer the
10   demands for regular education; and
11   
12        WHEREAS, an Operations Manager was established in August,
13   1997, with delegated authority to coordinate educational and
14   mental health services between the Departments of Education and
15   Health; now, therefore,
16   
17        BE IT RESOLVED by the Senate of the Twentieth Legislature
18   of the State of Hawaii, Regular Session of 1999, the House of
19   Representatives concurring, that the Department of Education
20   develop and approve the Individualized Education Program,
21   Individual Family Service Plan, Individual Treatment Plan, and
22   Modification Plan in an expeditious manner with as little
23   involvement of the principal as possible except for complicated
24   and unusual cases; and 
25   
26        BE IT FURTHER RESOLVED that the Operations Manager must
27   concur with the modifications proposed by the Department of
28   Education to streamline the approval process for the above-
29   mentioned program and plans; and
30   
31        BE IT FURTHER RESOLVED that a copy of the adopted
32   modifications be submitted to the legislature before the start
33   of the 1999-2000 school year; and
34   
35        BE IT FURTHER RESOLVED that certified copies of this
36   Concurrent Resolution be transmitted to the Department of
