                    SENATE  CONCURRENT
                        RESOLUTION
  URGING HAWAII'S CONGRESSIONAL DELEGATION TO SUPPORT EFFORTS TO
   ENFORCE THE SPIRIT AND INTENT OF PUBLIC LAW 99-190.



 1        WHEREAS, Hawaii is in a severe economic downturn that has
 2   lasted for several years; and
 3   
 4        WHEREAS, developing employment opportunities is critical
 5   to Hawaii's economic recovery which is made more difficult by
 6   Hawaii's isolation and unique economy; and
 7   
 8        WHEREAS, Public Law 99-190, the Department of Defense
 9   Appropriations Act of 1986, Section 8078, as amended, provides
10   that contracts awarded by the Department of Defense that are
11   performed in whole or in part in a noncontiguous state (Hawaii
12   or Alaska) that has an unemployment rate in excess of the
13   national average as determined by the Secretary of Labor, shall
14   include a provision requiring the contractor to employ
15   residents of the state in which the contract or part of it is
16   to be performed; and
17   
18        WHEREAS, the United States Department of Defense is aware
19   of the economic downturn in Hawaii and the increasing reliance
20   on military contracts and has worked to abide by Public Law
21   99-190, Section 8078, as demonstrated by a steady increase in
22   percentage of contracts awarded to local prime contractors by
23   the Army and Navy from 64 percent to 72 percent in the past
24   three fiscal years; and
25   
26        WHEREAS, in fiscal year 1998, 72 percent, or $148 million
27   out of $206 million, of military contracts in the State was
28   awarded to local prime contractors and local subcontractors
29   benefitted from all contracts awarded; and
30   
31        WHEREAS, this trend is attributable to increasingly
32   competitive Hawaii contractors who are more in tune with
33   federal contracting requirements, and a more sensitive
34   Department of Defense open to local talent and needs; and  
35   
36        WHEREAS, more needs to be done to support Hawaii's
37   contractors and trades men and women, and to continue to

 1   enhance our working relationship with the military to improve
 2   the percentage and share of military contracts that are awarded
 3   to Hawaii contractors; now, therefore,
 4   
 5        BE IT RESOLVED by the Senate of the Twentieth Legislature
 6   of the State of Hawaii, Regular Session of 1999, the House of
 7   Representatives concurring, that Hawaii's congressional
 8   delegation support efforts to enforce the spirit and intent of
 9   Public Law 99-190; and
10   
11        BE IT FURTHER RESOLVED that certified copies of this
12   Concurrent Resolution be transmitted to the Majority Leader of
13   the United States Senate; the Speaker of the United States
14   House of Representatives; Hawaii's Congressional Delegation;
15   the Secretary of Defense; and the Secretary of Labor.
