                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE STATE TO DISALLOW STATE EMPLOYEES FROM DRIVING
    HOME STATE-OWNED VEHICLES.
 


 1        WHEREAS, according to the State Department of Accounting
 2   and General Services Motor Pool Branch, the State owns 4,500
 3   vehicles that are used by state employees in the course and
 4   scope of their work; and
 5   
 6        WHEREAS, the State allows employees assigned a state-owned
 7   vehicle to drive the vehicle to and from home and their
 8   worksites, which increases the risk of an accident and the
 9   exposure of the State to liability for the accident; and
10   
11        WHEREAS, the cost to the State in case of an accident
12   involving a state-owned vehicle would have a detrimental effect
13   on the State's already over-burdened budget; and
14   
15        WHEREAS, even if those state employees do not use the
16   vehicles for personal use at home during evenings, weekends,
17   and holidays, the mere parking of state vehicles at their
18   residences increases liability exposure; and
19   
20        WHEREAS, according to the Department of Accounting and
21   General Services, only four-wheel drive vehicles are authorized
22   for travel between the employee's home and worksite, but there
23   have been reports of sedans being driven to and from work; and
24   
25        WHEREAS, more extensive monitoring by the Department of
26   Accounting and General Services is necessary in order to ensure
27   that the State's risk of liability is addressed; and
28   
29        WHEREAS, the legislature needs more information on the
30   cost of liability when state vehicles are taken home by state
31   employees; now, therefore,
32   
33        BE IT RESOLVED by the Senate of the Twentieth Legislature
34   of the State of Hawaii, Regular Session of 1999, the House of
35   Representatives concurring, that the Department of Accounting

 1   and General Services is requested to disallow state employees
 2   from driving home state-owned vehicles at night and on weekends
 3   and holidays, unless the nature of their work makes it vitally
 4   important that they do so, or in the case of an emergency; and
 5   
 6        BE IT FURTHER RESOLVED that the Department of Accounting
 7   and General Services conduct a study of state-owned vehicles
 8   which shall include but not be limited to the:
 9   
10        (1)  Total number of state-owned vehicles and of that
11             number, how many are assigned for the exclusive use
12             by an employee; 
13   
14        (2)  Categories of employees who are allowed to drive
15             state-owned vehicles;
16   
17        (3)  Nature of the work of those employees who drive
18             state-owned vehicles and for what reasons an employee
19             may take the state-owned vehicle home; and 
20   
21        (4)  History of costs incurred by the State as a result of
22             damages occuring during the time when a state-owned
23             vehicle was driven to and from or parked at a State
24             employee's residence;
25   
26   and
27   
28        BE IT FURTHER RESOLVED that the Department of Accounting
29   and General Services report its findings and progress to the
30   Legislature no later than twenty days prior to the convening of
31   the Regular Session of 2000; and
32   
33        BE IT FURTHER RESOLVED that a certified copy of this
34   Concurrent Resolution be transmitted to the Comptroller.
