                     SENATE CONCURRENT
                        RESOLUTION

REQUESTING THE DEPARTMENT OF HEALTH TO DEVELOP AND IMPLEMENT A
   FIVE-YEAR STATEWIDE, COMPREHENSIVE STRATEGIC PLAN FOR
   SERVICES AND SUPPORTS FOR INDIVIDUALS WITH DEVELOPMENTAL
   DISABILITIES OR MENTAL RETARDATION.



 1       WHEREAS, the State Planning Council on Developmental
 2   Disabilities estimated that there are approximately 12,040
 3   individuals with developmental disabilities in Hawaii; and
 4   
 5       WHEREAS, of the 12,040 individuals with developmental
 6   disabilities, over 2,400 are served by the Department of Health
 7   (DOH), Developmental Disabilities Division; and
 8   
 9       WHEREAS, the DOH Developmental Disabilities Division is
10   mandated to "develop, lead, administer, coordinate, monitor,
11   evaluate, and set direction for a comprehensive system of
12   supports and services for persons with developmental
13   disabilities or mental retardation within the limits of state
14   and federal resources allocated or available" for the purposes
15   of chapter 333F, Hawaii Revised Statutes; and
16   
17       WHEREAS, Act 341, Session Laws of Hawaii (SLH) 1987,
18   established chapter 333F to improve services and the overall
19   quality of life for persons with developmental disabilities or
20   mental retardation; and
21   
22       WHEREAS, Act 341, SLH 1987, required the DOH, in
23   coordination with the State Planning Council on Developmental
24   Disabilities and other related private and public agencies, to
25   jointly develop and implement a statewide plan for services;
26   and
27   
28       WHEREAS, the DOH Developmental Disabilities Division,
29   developed a five-year program plan entitled, "A Plan for
30   Services for Persons with Developmental Disabilities or Mental
31   Retardation, 1990-1994" (1990-1994 plan); and
32   
33       WHEREAS, the 1990-1994 plan was the last plan developed by
34   the DOH Developmental Disabilities Division; and

 2       WHEREAS, since the 1990-1994 plan was developed, over the
 3   last four years there have been significant changes in the
 4   developmental disabilities service system, including:
 5   
 6       (1)  The targeted closure of Waimano Training School and
 7            Hospital;
 8   
 9       (2)  Client-centered plans and budgets;
10   
11       (3)  Self-determination of individuals and their families;
12   
13       (4)  Maximization of federal dollars;
14   
15       (5)  State-provided case management services; and
16   
17        (6)  A waitlist for Medicaid home and community-based
18             services for individuals with developmental
19             disabilities or mental retardation;
20   
21   and
22   
23        WHEREAS, it is in the DOH's best interest to develop a
24   statewide, comprehensive strategic plan to set direction for
25   the way that services and supports will be provided to
26   individuals with developmental disabilities or mental
27   retardation; now, therefore,
28   
29        BE IT RESOLVED by the Senate of the Twentieth Legislature
30   of the State of Hawaii, Regular Session of 1999, the House of
31   Representatives concurring, that the DOH develop and implement
32   a five-year statewide, comprehensive strategic plan for
33   services and supports for individuals with developmental
34   disabilities or mental retardation; and
35   
36        BE IT FURTHER RESOLVED that the DOH, in developing the
37   plan, solicit input from individuals with developmental
38   disabilities or mental retardation, parents or family members
39   of individuals with developmental disabilities or mental
40   retardation, private and public agencies, the State Planning
41   Council on Developmental Disabilities, the University of Hawaii
42   Center on Disability Studies, and the Protection and Advocacy

 1   Agency of Hawaii; and
 2   
 3        BE IT FURTHER RESOLVED that the Department of Human
 4   Services participate in the development and implementation of
 5   the plan; and
 6   
 7        BE IT FURTHER RESOLVED that the DOH include collective
 8   bargaining exclusive representatives of its employees in the
 9   development and implementation of the plan; and
10   
11        BE IT FURTHER RESOLVED that the statewide, comprehensive
12   strategic plan include but not be limited to:
13   
14        (1)  An assessment of the current system, including:
15   
16             (a)  Organization;
17   
18             (b)  Current and future staff and fiscal resources;
19   
20             (c)  Current and future services to be provided by
21                  the State;
22   
23             (d)  Current and future services to be provided by
24                  the private sector; and
25   
26             (e)  A breakdown of budget estimates for (b) through
27                  (d); 
28   
29        (2)  A vision for and a philosophy of the future of
30             developmental disabilities services in Hawaii; and
31   
32        (3)  Outcome-based measures that include outcome
33             statements, target areas, performance targets,
34             milestones, and strategies to address:
35   
36             (a)  The provision of long-term care services;
37   
38             (b)  The waitlist for services;
39   
40             (c)  Self-determination of individuals with
41                  developmental disabilities or mental
42                  retardation; and

 2             (d)  The maximization of finances, state and federal
 3                  moneys, and other resources;
 4   
 5   and
 6   
 7        BE IT FURTHER RESOLVED that the Department of Health is
 8   requested to submit to the Legislature a progress report on the
 9   development of a statewide, comprehensive strategic plan no
10   later than twenty days prior to the convening of the Regular
11   Session of 2000; and
12   
13        BE IT FURTHER RESOLVED that the Director of Health is
14   requested to submit to the Legislature a statewide,
15   comprehensive strategic plan and schedule of implementation no
16   later than twenty days prior to the convening of the Regular
17   Session of 2001; and
18   
19        BE IT FURTHER RESOLVED that the Director of Health is
20   requested to submit to the Legislature a report on the plan and
21   its implementation, including recommendations for statutory
22   amendments, if any, prior to the convening of the Regular
23   Sessions of 2002, 2003, 2004, 2005, and 2006; and 
24   
25        BE IT FURTHER RESOLVED that certified copies of this
26   Concurrent Resolution be transmitted to the Director of Health,
27   Director of Human Services, the Executive Director of the State
28   Planning Council on Developmental Disabilities, the Director of
29   the University of Hawaii Center on Disabilities Studies, and
30   the Executive Director of the Protection and Advocacy Agency of
31   Hawaii.
