                   A  BILL  FOR  AN  ACT

RELATING TO SPECIAL PURPOSE REVENUE BONDS FOR MEDICAL WASTE
   FACILITY PROJECT DEVELOPMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that it is in the public
 
 2 interest to encourage the development of facilities for the safe
 
 3 and proper disposal of various waste streams including medical
 
 4 waste.  The legislature further finds that HEED, Inc., a Hawaii
 
 5 corporation, is engaged in the development on Molokai of a plasma
 
 6 waste conversion facility for the safe and proper disposal of
 
 7 medical waste and thereby serves the public.
 
 8      The legislature further finds that HEED, Inc., may be
 
 9 assisted through the issuance of special purpose revenue bonds
 
10 because it is an industrial enterprise pursuant to part V,
 
11 chapter 39A, Hawaii Revised Statutes, and the financing thereof
 
12 is assistance to an industrial enterprise.
 
13      The legislature finds and declares that the issuance of
 
14 special purpose revenue bonds under this Act is in the public
 
15 interest and for the public health, safety, and general welfare
 
16 of the State.
 
17      SECTION 2.  The legislature finds and determines that the
 
18 activities and facilities of HEED, Inc., constitute a project as
 
19 defined in part V, chapter 39A, Hawaii Revised Statutes.

 1 Pursuant to part V, chapter 39A, Hawaii Revised Statutes, the
 
 2 department of budget and finance, with the approval of the
 
 3 governor, is authorized to issue in one or more series special
 
 4 purpose revenue bonds in a total amount not to exceed $5,000,000,
 
 5 for the express purpose of assisting HEED, Inc., in the
 
 6 establishment of a plasma waste conversion facility on Molokai
 
 7 for the disposal of various waste streams including medical
 
 8 waste; provided that:
 
 9      (1)  Prior to the issuance of any permit for the plasma
 
10           waste conversion facility, an informational briefing
 
11           shall be held to inform the citizenry of all aspects of
 
12           the facility's operations;
 
13      (2)  That informational briefing shall be followed by a
 
14           public hearing to gather as much additional public
 
15           input as possible;
 
16      (3)  The department of health shall cite the language in
 
17           this Act within the body of any permits issued for
 
18           plasma waste conversion of various waste streams
 
19           including medical waste so that the legislature's
 
20           conditions and limitations are not separated from the
 
21           permit or permits, and, in addition, shall ensure that
 
22           those conditions and limitations set forth by the
 
23           legislature extend throughout the life of the facility;

 1           and
 
 2      (4)  This facility shall be available to members of the
 
 3           public, including hospitals, medical clinics,
 
 4           laboratories, and other health care providers serving
 
 5           the public.
 
 6      SECTION 3.  The special purpose revenue bonds issued under
 
 7 this Act shall be issued pursuant to part V, chapter 39A, Hawaii
 
 8 Revised Statutes, relating to the authority to issue special
 
 9 purpose revenues bonds to assist industrial enterprises.
 
10      SECTION 4.  The authorization to issue special purpose
 
11 revenue bonds under this Act shall lapse on December 31, 2004.
 
12      SECTION 5.  This Act shall take effect on July 1, 1999.
