                   A  BILL  FOR  AN  ACT

RELATING TO GOVERNMENT SERVICES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the people of the
 
 2 State demand that government improve productivity, efficiency,
 
 3 and structure in providing government services.  Improvement in
 
 4 these areas can be accomplished by establishing and maintaining
 
 5 clear goals and objectives for all governmental services.
 
 6      The legislature further finds that Hawaii's school-to-work
 
 7 opportunities system lacks a clear mission, goals, and outcome
 
 8 measures.  In addition, Hawaii's school-to-work effort is nowhere
 
 9 near statewide implementation.
 
10      The legislature also finds that partnerships between schools
 
11 and businesses have not received much guidance from the Hawaii
 
12 school-to-work office.  In addition, the auditor found that
 
13 controls over school-to-work expenditures are weak and
 
14 implementation of safety inspection requirements are poor.
 
15      The purposes of this Act are:  (1) to require the Hawaii
 
16 school-to-work opportunities executive council to establish a
 
17 clear mission statement, specific goals of the program, methods
 
18 of appraising outcomes, and methods to control expenditures; (2)
 
19 to require proper implementation of Act 343, Session Laws of

 1 Hawaii 1997; and (3) to determine the effectiveness of safety
 
 2 studies.
 
 3      SECTION 2.  Act 343, Session Laws of Hawaii 1997, is amended
 
 4 by amending section 302A-   of section 2 to read as follows:
 
 5      "§302A-   Powers of the council.  The powers of the Hawaii
 
 6 school-to-work opportunities executive council shall include, but
 
 7 not be limited to:
 
 8      (1)  Establishing and setting the general directions and
 
 9           policy for the Hawaii school-to-work opportunities
 
10           system, its council, and executive director;
 
11      (2)  Appointing, supervising, and if necessary, discharging
 
12           the executive director, not subject to chapters 76 and
 
13           77;
 
14      (3)  Establishing rules and procedures regarding its
 
15           membership and operations;
 
16      (4)  Approving expenditure plans and award grants/contracts;
 
17      (5)  Ratifying the establishment of all necessary standing
 
18           and ad hoc committees; [and]
 
19      (6)  Engaging in such activities as may be necessary or
 
20           desirable to implement the functions of the School-to-
 
21           Work Opportunities Act of 1994, and of the council
 
22           [or], through delegation to the executive director[.];
 
23      (7)  Establishing a mission statement that contains clear

 1           definitions and implementation strategies, goals, and
 
 2           methods of measuring results for the school-to-work
 
 3           opportunities system;
 
 4      (8)  Establishing controls over school-to-work expenditures
 
 5           so that federal moneys serve only as seed money to
 
 6           initiate implementation of a comprehensive statewide
 
 7           school-to-work opportunities system.  These controls
 
 8           shall additionally:
 
 9           (A)  Establish the role of the fiscal agent and methods
 
10                of supervising the expenditures of state funds
 
11                through partnerships;
 
12           (B)  Provide standards for maintaining an annual
 
13                physical inventory;
 
14           (C)  Provide rules to ensure that funds shall be used
 
15                only for the implementation of the statewide
 
16                school-to-work opportunities system; and
 
17           (D)  Establish a grant review process that provides
 
18                control, consistency, and guidance; and
 
19      (9)  Providing for the implementation of sections 302A-429
 
20           to 302A-431 and 302A-440 in a manner that meets their
 
21           intended purpose, clarifies the coverage of workers'
 
22           compensation, and ensures the safety of students in the
 
23           work-based learning situations.  Toward this end, the

 1           council shall:
 
 2           (A)  Plan work site safety inspections to be timely
 
 3                developed and implemented; and
 
 4           (B)  Determine the effectiveness of work-site safety
 
 5                surveys that may serve as a risk management
 
 6                mechanism for workers' compensation purposes."
 
 7      SECTION 3.  The Hawaii school-to-work opportunities
 
 8 executive council shall submit to the legislature by June 30,
 
 9 1999, a comprehensive report which shall include a response to
 
10 section 302A-   (7) to (9), of Act 343, Session Laws of Hawaii
 
11 1997, section 2, added by this Act.
 
12      SECTION 4.  Statutory material to be repealed is bracketed.
 
13 New statutory material is underscored.
 
14      SECTION 5.  This Act shall take effect upon its approval.
