                     HOUSE  RESOLUTION

  HONORING THE STATE COMMISSION TO PROMOTE UNIFORM LEGISLATION.



 1        WHEREAS, the members of Hawaii's State Commission to
 2   Promote Uniform Legislation, appointed pursuant to Chapter 3,
 3   Hawaii Revised Statutes, are Hawaii's commissioners to the
 4   National Conference of Commissioners on Uniform State Laws; and
 5   
 6        WHEREAS, the National Conference of Commissioners on
 7   Uniform State Laws is a confederation of state interests that
 8   arose out of the desire for the improvement and uniformity of
 9   state law and for better interstate relationships.  The sole
10   purpose of the uniform law commissioners has always been
11   service to state government and improvement of state law; and
12   
13        WHEREAS, the National Conference of Commissioners on
14   Uniform State Laws has produced and worked for the adoption of
15   a wide variety of comprehensive legislative solutions to basic
16   state problems that are not appropriate for federal
17   legislation; and
18   
19        WHEREAS, the work of the uniform law commissioners, who
20   first convened in 1892, has made valuable contributions to the
21   improvement of state law in a great many subject areas,
22   including in that impressive body of work, the Uniform
23   Commercial Code, the Uniform Probate Code, the Uniform
24   Reciprocal Enforcement of Support Act, the Uniform Child
25   Custody Jurisdiction Act, and the Uniform Anatomical Gift Act,
26   which have been adopted by most if not all states; and
27   
28        WHEREAS, even with acts that have not been wholly adopted,
29   the texts consistently contribute to the improvement of the law
30   and have served as valuable references for state legislatures
31   in their effort to improve the quality of state law; and
32   
33        WHEREAS, as a participating member of the National
34   Conference of Commissioners on Uniform State Laws since 1910,
35   Hawaii has benefited significantly from the work of the uniform
36   law commissioners by adopting over 50 uniform and model acts;

 1        WHEREAS, some of the other uniform and model laws produced
 2   by the National Conference of Commissioners on Uniform State
 3   Laws that Hawaii has adopted, include the Uniform Arbitration
 4   Act, the Uniform Controlled Substances Act, the Uniform
 5   Custodial Trust Act, the Uniform Division of Income for Tax
 6   Purposes Act, the Uniform Enforcement of Foreign Judgments Act,
 7   the Uniform Rules of Evidence, the Uniform Foreign Money Claims
 8   Act, the Uniform Fraudulent Transfers Act, the Uniform
 9   Interstate Family Support Act, the Uniform Limited Liability
10   Company Act, the Uniform Parentage Act, the Uniform Partnership
11   Act, the Uniform Premarital Agreements Act, the Uniform
12   Principal and Income Act, the Uniform Prudent Investor Act, the
13   Residential Landlord and Tenant Code, the Uniform Transfers to
14   Minors Act, the Uniform Unclaimed Property Act, the Model
15   Information Practices Code, the Model Land Sales Practices Act,
16   and the Model Contribution Among Tortfeasors Act; and
17   
18        WHEREAS, the states have chosen to support and maintain
19   the National Conference of Commissioners on Uniform State Laws
20   because it strengthens the states in a federal system of
21   government and provides the only nonfederal institution the
22   states have for solving interstate problems; and
23   
24        WHEREAS, the work of the National Conference of
25   Commissioners on Uniform State Laws could not have been
26   accomplished by the State of Hawaii or any state working alone;
27   and
28   
29        WHEREAS, the members of Hawaii's State Commission to
30   Promote Uniform Legislation are Mr. Hiroshi Sakai, Chair, Ms.
31   Lani Ewart, Vice-Chair, and Mr. Robert Toyofuku, Ms. Elizabeth
32   Kent, and Mr. Ken Takayama.  Mr. Maurice Kato serves as
33   Executive Secretary and is an associate member of the state
34   commission, while Mr. John Chanin, a former member of the state
35   commission, continues as a life member of the National
36   Conference; and
37   
38        WHEREAS, Hawaii's commissioners donate countless hours of
39   work each year, pro bono to the State Commission and the
40   National Conference of Commissioners on Uniform State Laws,
41   working with over 300 other uniform law commissioners
42   throughout the United States, the District of Columbia, Puerto
43   Rico, and the United States Virgin Islands; and

 1        WHEREAS, several members of the state commission have
 2   devoted many years of valuable service to the endeavors of the
 3   commission and the National Conference.  Mr. Sakai and Mr.
 4   Chanin are life members of the National Conference having
 5   served as commissioners from Hawaii for over thirty years,
 6   while Mr. Toyofuku and Ms. Ewart are also life members having
 7   served for over twenty years.  Ms. Ewart has the added
 8   distinction of being the first and to date the only woman in
 9   the 107-year history of the National Conference to be elected a
10   life member; and
11   
12        WHEREAS, Hawaii's commissioners are actively involved in
13   current efforts to develop new uniform legislation, and are
14   presently serving on drafting committees involving such diverse
15   subjects as disclaimers of property interests, a model punitive
16   damages law, the licensing and regulation of money transmitters
17   to prevent money laundering, and a new Uniform Commercial Code
18   article on contracts for sales of computer information; now,
19   therefore,

21        BE IT RESOLVED by the House of Representatives of the
22   Twentieth Legislature of the State of Hawaii, Regular Session
23   of 1999, that this body honors and recognizes the work of the
24   State Commission to Promote Uniform Legislation and its
25   members, and their contributions to the development and
26   improvement of law in Hawaii and this nation through the
27   National Conference of Commissioners on Uniform State Laws; and
28   
29        BE IT FURTHER RESOLVED that certified copies of this
30   Resolution be transmitted to the members of the State
31   Commission to Promote Uniform Legislation.
