                     HOUSE  RESOLUTION

  REQUESTING THE BOARD OF EDUCATION TO STUDY THE MERITS OF
    TRANSFERRING CONTROL OF ALL PUBLIC EDUCATIONAL
    INSTITUTIONS LOCATED ON UNITED STATES DEPARTMENT OF
    DEFENSE FACILITIES AND ALL OTHER PUBLIC EDUCATIONAL
    INSTITUTIONS ATTENDED PREDOMINATELY BY STUDENTS RESIDING
    ON U.S. DEPARTMENT OF DEFENSE FACILITIES, TO THE U.S.
    DEPARTMENT OF DEFENSE.



 1        WHEREAS, the federal impact aid law requires the United
 2   States Department of Defense to make such arrangements as may
 3   be necessary to provide free public education to all children
 4   who reside on U.S. Department of Defense facilities in those
 5   instances where there are no tax revenues available from a
 6   state or any of the state's political subdivisions to pay for
 7   the education of these children; and
 8   
 9        WHEREAS, in cases such as these in other states, the U.S.
10   Department of Defense is obligated to operate schools for
11   children who reside on certain U.S. Department of Defense
12   facilities; and
13   
14        WHEREAS, in Hawaii, however, the Board of Education
15   provides for the establishment, support, and control of and
16   formulates statewide educational policy for all public schools
17   on U.S. Department of Defense facilities--even those attended
18   exclusively or predominately by children residing on these
19   facilities; and
20   
21        WHEREAS, some parents of children who reside on U.S.
22   Department of Defense facilities in Hawaii have publicly voiced
23   their unhappiness with the quality of the State's public
24   schools and system of public education in general; and
25   
26        WHEREAS, these parents and their children are entitled to
27   experience the same quality of public schools and system of
28   public education that they are entitled to under the federal
29   impact aid law when there are no tax revenues available from a
30   state or any of the state's political subdivisions to pay for
31   the education of their children; and
32   
33        WHEREAS, the parents of children who reside on U.S.
34   Department of Defense facilities are also entitled to have

 1   exclusive jurisdiction over the establishment, support, and
 2   control of all schools on U.S. Department of Defense
 3   facilities, including the formulation of policies for these
 4   schools; now, therefore,
 5   
 6        BE IT RESOLVED by the House of Representatives of the
 7   Twentieth Legislature of the State of Hawaii, Regular Session
 8   of 1999, that the Board of Education is requested to study the
 9   merits of transferring organizational and managerial control of
10   all public educational institutions located on United States
11   Department of Defense facilities and all other public
12   educational institutions that are attended predominately by
13   students residing on U.S. Department of Defense facilities,
14   including any equipment or furniture appurtenant thereto or
15   contained therein, to the U.S. Department of Defense pursuant
16   to the federal impact aid law; and
17   
18        BE IT FURTHER RESOLVED that the Board of Education study
19   the merits of establishing two school complexes to service
20   areas in the proximity of military establishments.  The first
21   complex would be established around Wheeler Intermediate
22   School, which would serve as the intermediate and high school
23   for the Schofield Barracks/Wheeler Army Air Field area.  The
24   second complex would be established around Radford High School,
25   which would serve as the intermediate and high school for the
26   Pearl Harbor/Hickam Air Force Base area; and
27   
28        BE IT FURTHER RESOLVED that the Board of Education study
29   the merits of providing for the establishment, support, and
30   control of an intermediate school facility in Mililani-mauka to
31   replace Wheeler Intermediate School, which would be transferred
32   to the U.S. Department of Defense; and
33   
34        BE IT FURTHER RESOLVED that the Board of Education submit
35   its findings and recommendations to the Legislature not less
36   than twenty days prior to the convening of the Regular Session
37   of 2000; and
38   
39        BE IT FURTHER RESOLVED that certified copies of this
40   Resolution be transmitted to the Chairperson of the Board of
41   Education, the Superintendent of Education, the Commander-in-
42   Chief, Pacific Command, and the United States Secretary of
43   Defense.
