                     HOUSE  CONCURRENT
                        RESOLUTION

  REQUESTING THE GOVERNOR TO CONVENE A TASK FORCE TO ESTABLISH
    CRITERIA BY WHICH ALL STATE DEPARTMENTS AND THEIR ATTACHED
    AGENCIES SHALL RANK ALL PURCHASES OF SERVICES THAT ARE
    ISSUED BY THOSE DEPARTMENTS OR AGENCIES.


 1        WHEREAS, the Legislature finds that there is a need to
 2   establish criteria with which to evaluate and rank all
 3   purchases of service; and
 4   
 5        WHEREAS, in 1997, the Legislature enacted Act 190 to
 6   improve the process used to expend state funds for grants,
 7   subsidies, and purchases of services, particularly the process
 8   used to purchase health and human services from organizations
 9   and individuals in the community available and qualified to act
10   on behalf of the State in responding to the health and human
11   service needs of its citizens; and
12   
13        WHEREAS, that Act separated the processes used by state
14   agencies to expend appropriations of state funds for grants and
15   subsidies from that of paying for and providing purchases of
16   services on the agencies' behalf.  The Legislature's intent was
17   that all state agencies use the same single process to obtain
18   and pay for health and human services to ensure the fair and
19   equitable treatment of all persons who apply to, and are paid
20   to provide those services on the agencies' behalf; and
21   
22        WHEREAS, although the Legislature finds that Act 190
23   resulted in a simpler, standardized process for the use of
24   state agencies and providers and has improved information-
25   sharing, planning, and service delivery efforts, the
26   Legislature nevertheless finds that tough economic times and
27   fiscal realities mandate the need to prioritize the awarding of
28   these purchase of service contracts; and
29   
30        WHEREAS, in particular, there is a need to establish
31   criteria with which to evaluate and rank all purchases of
32   service in order to determine which contracts need to be
33   reduced first; and
34   
35        WHEREAS, the Legislature finds, for example, that

 1   different state departments may have different priorities,
 2   which may not coincide with the priorities of another
 3   department.  There is a need to establish a statewide set of
 4   criteria that apply to all purchases of services.  Once the
 5   criteria are in place, all state departments and their attached
 6   agencies could then evaluate and rank their respective
 7   purchases of services according to those criteria; and
 8   
 9        WHEREAS, there is a need for the establishment of a task
10   force within the Office of the Governor to develop criteria by
11   which to rank all purchases of services, and to require all
12   departments to evaluate and rank their purchases of services
13   according to those criteria; now, therefore,
14   
15        BE IT RESOLVED by the House of Representatives of the
16   Twentieth Legislature of the State of Hawaii, Regular Session
17   of 1999, the Senate concurring, that the Governor is requested
18   to convene a task force within the Office of the Governor to
19   establish criteria by which all state departments and their
20   attached agencies may be directed to rank all purchases of
21   services that are issued by those departments or agencies; and
22   
23        BE IT FURTHER RESOLVED that the task force is requested to
24   consist of the Governor and ten members appointed by the
25   Governor from lists of nominees submitted by the Director of
26   Health, the Director of Human Services, the Superintendent of
27   Education, the President of the University of Hawaii, the
28   Director of Labor and Industrial Relations, the Attorney
29   General, the Director of Public Safety, and the Chief Justice.
30   Each list is requested to contain at least one nominee from the
31   islands of Kauai, Oahu, Maui, Molokai, Lanai, and Hawaii, three
32   of whom shall be from private agencies and three of whom shall
33   be from government agencies other than the agency making the
34   nominations.  In appointing the membership of the task force,
35   the Governor is requested to ensure that each island listed in
36   this paragraph is represented on the task force, and that the
37   gender and ethnic composition of the task force reflects--as
38   nearly as possible--the gender and ethnic composition of the
39   State.  Not less than three members of the task force are
40   requested to be from private agencies.  It is further requested
41   that the task force be chaired by the Governor; and

 1        BE IT FURTHER RESOLVED that the Department of Budget and
 2   Finance and other appropriate executive agencies are requested
 3   to provide staff assistance to the task force upon request; and
 4   
 5        BE IT FURTHER RESOLVED that the task force is requested to
 6   consult with the Community Council established in section
 7   103F-202, Hawaii Revised Statutes, regarding the establishment
 8   of criteria; and
 9   
10        BE IT FURTHER RESOLVED that the members of the task force
11   are requested to serve without compensation, but the Governor
12   is requested to reimburse the task force members for expenses,
13   including travel expenses, necessary for the performance of
14   their duties; and
15   
16        BE IT FURTHER RESOLVED that the task force is requested to
17   distribute copies of the criteria established pursuant to this
18   Concurrent Resolution to all state executive departments and
19   their attached agencies that issue purchases of services.  Upon
20   receiving the criteria, those state departments and their
21   attached agencies are requested to:
22   
23        (1)  Evaluate each of the purchases of services issued by
24             that department or attached agency that will require
25             funding for the upcoming fiscal year, whether those
26             purchases of services are for the continuation of
27             funding from previous years or are new purchases of
28             services, and rank them according to the criteria;
29   
30        (2)  Submit a report of the evaluation and ranking
31             performed under paragraph (1) to the task force by
32             September 1, 2000;
33   
34   and
35   
36        BE IT FURTHER RESOLVED that the task force is requested to
37   report to the Legislature no later than twenty days before the
38   convening of the Regular Session of 2001 regarding the criteria
39   established to rank purchases of services and the ranking of
40   purchases of services according to those criteria by state
41   departments and their attached agencies, including any findings
42   and recommendations regarding those criteria and rankings; and

 2        BE IT FURTHER RESOLVED that certified copies of this
 3   Concurrent Resolution be transmitted to the Governor, the
 4   Director of Health, the Director of Human Services, the
 5   Superintendent of Education, the President of the University of
 6   Hawaii, the Director of Labor and Industrial Relations, the
 7   Attorney General, the Director of Public Safety, and the Chief
 8   Justice.
