                     HOUSE  CONCURRENT
                        RESOLUTION

  ENCOURAGING THE DEPARTMENT OF EDUCATION AND THE UNIVERSITY OF
    HAWAII TO CLAIM THEIR FAIR SHARE OF THE CEDED LAND
    REVENUES.



 1        WHEREAS, section 5(f) of the Admission Act established the
 2   public land trust for five purposes:  the support of public
 3   schools, the betterment of conditions of native Hawaiians, for
 4   the development of farm and home ownership, the making of
 5   public improvements, and for the provision of lands for public
 6   use; and
 7   
 8        WHEREAS, the Admission Act clearly states that the use of
 9   ceded land revenues for any other purpose constitutes a breach
10   of trust, for which the State may be sued by the United States;
11   and
12   
13        WHEREAS, to date, the public schools have not directly
14   received any ceded land moneys; and
15   
16        WHEREAS, the Office of Hawaiian Affairs, which is charged
17   with the betterment of native Hawaiians, receives one-fifth, or
18   twenty per cent, of ceded land revenues; and
19   
20        WHEREAS, the Department of Education and the University of
21   Hawaii should receive no less for the support and management of
22   the public schools and the state university system; now,
23   therefore,

25        BE IT RESOLVED by the House of Representatives of the
26   Twentieth Legislature of the State of Hawaii, Regular Session
27   of 1999, the Senate concurring, that the Department of
28   Education and the University of Hawaii are encouraged to
29   present their claim to the Governor for direct receipt of
30   twenty per cent of ceded land revenues to support public lower
31   and higher education; and
32   
33        BE IT FURTHER RESOLVED that it is the intent of the
34   Legislature that the Department of Education and the University
35   of Hawaii pursue their fair share of the ceded land claims; and

 1        BE IT FURTHER RESOLVED that certified copies of this
 2   Concurrent Resolution be transmitted to the Chairperson of the
 3   Board of Education, the Superintendent of Education, the
 4   Chairperson of the Board of Regents, and the President of the
 5   University of Hawaii.
