                     HOUSE  CONCURRENT
                        RESOLUTION

  REQUESTING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO
    STUDY THE FEASIBILITY OF DESIGNATING KALAPAKI, HANAMAULU,
    AND HANALEI BAYS ON KAUAI AS MARINE FISHERIES MANAGEMENT
    AREAS.



 1        WHEREAS, the ocean has provided the people of this State
 2   with food on their tables as well as commercial and
 3   recreational opportunities; and
 4   
 5        WHEREAS, plummeting fish populations have been attributed
 6   to unrestricted use of long nets and gill nets in certain
 7   areas; and
 8   
 9        WHEREAS, long nets are commonly used as holding pens for
10   up to six days in certain bays and are known to be causes for
11   hundreds if not thousands of fish to die and wash up on shore
12   when the nets are retrieved; and
13   
14        WHEREAS, the use of these nets have reportedly been
15   responsible for ninety per cent catch reduction from Kaneohe
16   Bay in recent years; and
17   
18        WHEREAS, more and larger fish began showing back in Hilo
19   Bay after net fishing was restricted in 1988; now, therefore,
20   
21        BE IT RESOLVED by the House of Representatives of the
22   Twentieth Legislature of the State of Hawaii, Regular Session
23   of 1999, the Senate concurring, that the Department of Land and
24   Natural Resources is requested to determine the feasibility of
25   designating Kalapaki, Hanamaulu, and Hanalei Bays as Marine
26   Fisheries Management Areas including the restricted or
27   prohibited use of long nets and gill nets; and
28   
29        BE IT FURTHER RESOLVED that the Department of Land and
30   Natural Resources is requested to meet with members of Kauai's
31   fishing communities, both recreational and commercial, to
32   identify problem areas, recommend solutions, and to consider
33   the benefits of establishing marine fisheries management areas
34   for these bays; and

 1        BE IT FURTHER RESOLVED that the Department of Land and
 2   Natural Resources submit a report to the Legislature of its
 3   findings not less than twenty days prior to the convening of
 4   the Regular Session of 2000; and
 5   
 6        BE IT FURTHER RESOLVED that a certified copy of this
 7   Concurrent Resolution be transmitted to the Chairperson of the
 8   Board of Land and Natural Resources.
