                   A  BILL  FOR  AN  ACT

RELATING TO ASBESTOS REMOVAL.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 342P, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "§342P-    Criteria for asbestos removal in public
 
 5 buildings.  No state funds shall be used to remove asbestos-
 
 6 containing material from public buildings, including educational
 
 7 facilities, unless one or more of the following conditions exist:
 
 8      (1)  The removal is required under the Asbestos Hazard
 
 9           Emergency Response Act, 15 U.S.C. 2641-2654, Title II
 
10           of the Toxic Substance Control Act, Public Law 94-469,
 
11           or the Clean Air Act, 42 U.S.C. 7401 et seq.;
 
12      (2)  The removal is incidental to normal building
 
13           maintenance, repair, renovation, or remodeling; or
 
14      (3)  After visual and physical inspection, air monitoring
 
15           indicates that the average airborne asbestos
 
16           concentration exceeds 0.01 asbestos fibers longer than
 
17           five microns per cubic centimeter of air, calculated as
 
18           an eight-hour time weighted average, and measured by
 
19           either optical phase contrast microscopy or

 1           transmission electron microscopy; provided that if both
 
 2           measurement techniques are utilized, the measurement
 
 3           made by transmission electron microscopy shall
 
 4           control."
 
 5      SECTION 2.  New statutory material is underscored.
 
 6      SECTION 3.  This Act shall take effect upon its approval.
