                     A BILL FOR AN ACT

RELATING TO CONTROLLED SUBSTANCES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 329-104, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  This section shall not prevent the disclosure, at the
 
 4 discretion of the administrator, of investigative information to:  
 
 5      (1)  [law] Law enforcement officers; investigative agents of
 
 6           federal, state, or county law enforcement agencies;
 
 7           prosecuting attorneys; or the attorney general, in
 
 8           furtherance of criminal investigations or prosecutions
 
 9           within their respective jurisdictions; provided that
 
10           the administrator has reasonable grounds to believe
 
11           that the disclosure of any information collected under
 
12           this part is in furtherance of an ongoing
 
13           investigation[.]; and
 
14      (2)  Registrants authorized under section 329-32 to
 
15           administer, prescribe, or dispense controlled
 
16           substances.
 
17 This information is confidential and shall be used as a tool to
 
18 prevent the improper or illegal use of controlled substances."

 1      SECTION 2.  There is appropriated out of the controlled
 
 2 substance registration revolving fund established section 329-59,
 
 3 Hawaii Revised Statutes the sum of $         or so much thereof
 
 4 as may be necessary for fiscal year 1999-2000 to provide for one
 
 5 full-time equivalent (1.00 FTE) data processing systems analyst
 
 6 IV position and other current expenses to carry out the purpose
 
 7 of this Act.
 
 8      The sum appropriated shall be expended by the department of
 
 9 pubic safety.
 
10      SECTION 3.  Statutory material to be repealed is bracketed.
 
11 New Statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect on July 1, 1999.
