Defines "industrial hemp".  Allows privately-funded industrial
hemp research to be conducted in Hawaii under certain conditions

                   A  BILL  FOR  AN  ACT

RELATING TO AGRICULTURE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to allow privately
 
 2 funded industrial hemp research to be conducted in Hawaii when
 
 3 the State department of public safety issues a controlled
 
 4 substance registration, and the United States Department of
 
 5 Justice, Drug Enforcement Administration, issues a federally-
 
 6 controlled substance registration for research on the agronomic
 
 7 potential of industrial hemp.
 
 8      SECTION 2.  As used in this Act, unless the context
 
 9 otherwise requires:
 
10      "Industrial hemp" and "cannabis" means the schedule I
 
11 substance marijuana as defined in section 329-1, Hawaii Revised
 
12 Statutes.
 
13      SECTION 3.  (a)  The State may allow privately-funded
 
14 industrial hemp research to be conducted in Hawaii when the State
 
15 department of public safety issues a controlled substance
 
16 registration, and the United States Department of Justice, Drug
 
17 Enforcement Administration, issues a federally-controlled
 
18 substance registration for research on the agronomic potential of
 
19 industrial hemp.

 1      (b)  The department of public safety, in cooperation with
 
 2 the Drug Enforcement Administration, shall monitor all phases of 
 
 3 this research.
 
 4      (c)  All agronomic data derived from the privately-funded
 
 5 industrial hemp research allowed by this Act and maintained by a
 
 6 government agency shall not be subject to disclosure pursuant to
 
 7 chapter 92F, Hawaii Revised Statutes, when data is proprietary in
 
 8 nature and disclosure of it would frustrate a legitimate
 
 9 government function.
 
10      SECTION 4.  This Act shall take effect upon its approval,
 
11 and shall be repealed on June 30, 2002.
