                     A BILL FOR AN ACT

PROPOSING AN AMENDMENT TO ARTICLE III, SECTIONS 4 AND 5, OF THE
   HAWAII CONSTITUTION, TO ESTABLISH LEGISLATIVE TERM LIMITS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  The purpose of this Act is to propose amendments
 
 2 to article III, section 4, of the Constitution of the State of
 
 3 Hawaii to limit state senators to three four-year terms and state
 
 4 representatives to five two-year terms.
 
 5      SECTION 2.  Article III, section 4, of the Constitution of
 
 6 the State of Hawaii is amended to read as follows:
 
 7                    "ELECTION OF MEMBERS; TERM
 
 8      Section 4.  Each member of the legislature shall be elected
 
 9 at an election.  If more than one candidate has been nominated
 
10 for election to a seat in the legislature, the member occupying
 
11 that seat shall be elected at a general election.  If a candidate
 
12 nominated for a seat at a primary election is unopposed for that
 
13 seat at the general election, the candidate shall be deemed
 
14 elected at the primary election.  The term of office of a member
 
15 of the house of representatives shall be two years [and the];
 
16 provided that no member shall serve for more than five two-year
 
17 terms beginning after January 1, 2002.  The term of office of a
 
18 member of the senate shall be four years[.]; provided that no
 
19 member shall serve for more than three four-year terms beginning

 1 after January 1, 2002.  The term of a member of the legislature
 
 2 shall begin on the day of the general election at which elected
 
 3 or if elected at a primary election, on the day of the general
 
 4 election immediately following the primary election at which
 
 5 elected.  For a member of the house of representatives, the terms 
 
 6 shall end on the day of the general election immediately
 
 7 following the day the member's term commences.  For a member of
 
 8 the senate, the term shall end on the day of the second general
 
 9 election immediately following the day the member's term
 
10 commences."
 
11      SECTION 2.  The question to be printed on the ballot shall
 
12 be as follows:
 
13      "Shall state senators be limited to serving three four-year
 
14 terms, and state representatives be limited to serving five two-
 
15 year terms beginning after January 1, 2002?"
 
16      SECTION 3.  Constitutional material to be repealed is
 
17 bracketed.  New constitutional material is underscored.
 
18      SECTION 4.  This amendment shall take effect upon compliance
 
19 with article XVII, section 3, of the Constitution of the State of
 
20 Hawaii.
