                     A BILL FOR AN ACT

RELATING TO FAMILY HEALTH SERVICES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Chapter 321, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§321- Availability of services and programs to people on
 
 5 limited incomes.  Any program or service established pursuant to
 
 6 parts IV (Children with special health needs), XIX (School health
 
 7 services), XXV (Maternal and child health program), XXVI
 
 8 (Prenatal health care), and XXVII (Infants and toddlers) of this
 
 9 chapter shall be provided, without any spend-down requirement, to
 
10 people who derive their income solely or largely from social
 
11 security, if they have a serious medical condition defined as
 
12 follows:
 
13           (1) Terminal illness--a licensed physician (preferably
 
14           the patient's own physician) has attested in writing
 
15           that due to the nature of the patient's condition, the
 
16           patient's life expectancy is expected to be six months
 
17           or less.
 
18           (2) Debilitating illness--the patient has a disease or
 
19           AIDS or related medical condition which prevents

 1           him/her from functioning independently and that he/she
 
 2           cannot do two or more of the following:
 
 3                (A) Communicate needs or wants;
 
 4                (B) Self feed;
 
 5                (C) Ambulate without the assistance of another
 
 6                person; or
 
 7                (D) Walk with or without the help of a device.
 
 8           (3) Life threatening illness--a licensed physician
 
 9           (preferably the patient's own physician) has attested
 
10           in writing that the patient has a condition held in
 
11           abeyance due to condition-specific medication or
 
12           treatment which if withheld from the patient, would
 
13           eventually lead to death (after first passing through
 
14           the aforementioned two categories of eligibility)."
 
15      SECTION 2.  Chapter 321, Hawaii Revised Statutes, are
 
16 amended by adding a new section to be appropriately designated
 
17 and to read as follows:
 
18      "§321-    Annual appropriation.  (a) Commencing with July 1,
 
19 1999, and every year thereafter, there shall be appropriated out
 
20 of the general revenues of the State of Hawaii the sum of $    ,
 
21 or so much thereof as may be necessary to carry out the
 
22 provisions of section 321-    , including matching any federal
 
23 funds to support individuals in the categories defined in said

 1 section.
 
 2      (b)  The sum appropriated shall be expended by the
 
 3 department of health for the purposes set forth in parts IV, XIX,
 
 4 XXV, XXVI, and XXVII of this chapter."
 
 5      SECTION 3.  New statutory material is underscored.
 
 6      SECTION 4.  This Act shall take effect upon its approval;
 
 7 provided that section 2 shall take effect on July 1, 1999.
