                   A  BILL  FOR  AN  ACT

RELATING TO HUMAN RESOURCES MANAGEMENT IN STATE GOVERNMENT. 



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 76, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§76-    Demonstration projects.  (a)  The director of human
 
 5 resources development, with the approval of the governor, may
 
 6 conduct demonstration projects to determine whether a specific
 
 7 change in human resource management procedures, methods,
 
 8 policies, or statutes would result in improved human resource
 
 9 management within the State.
 
10      (b)  Prior to implementing any demonstration project, the
 
11 director shall develop a plan that identifies the purposes of the
 
12 project, the methodology to be used, the duration of the project,
 
13 the methodology and criteria for evaluation of the project, and,
 
14 if applicable, the cost of the project.
 
15      (c)  The conduct of demonstration projects shall not be
 
16 limited by chapters 76 and 77 and existing civil service rules
 
17 and procedures, except that no project shall waive or abridge
 
18 equal employment opportunity rights or those prohibiting
 
19 discrimination based on race, sex, age, religion, color,

 1 ancestry, politics, physical or mental disability, marital
 
 2 status, or sexual orientation.
 
 3      (d)  If any project has a significant impact on existing
 
 4 employees, consultation with appropriate exclusive
 
 5 representatives prior to implementation shall be required.  If
 
 6 any project involves modification of any terms and conditions of
 
 7 a valid collective bargaining agreement, an agreement amending
 
 8 those specifics must be negotiated with the exclusive
 
 9 representative, prior to implementation.
 
10      (e)  The director, through the office of the governor, shall
 
11 submit an annual report to the legislature on any approved
 
12 demonstration projects, including the plan, status, and, as
 
13 applicable, results of the project for its information."
 
14      SECTION 2.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 3.  This Act shall take effect upon its approval and
 
17 shall be repealed on June 30, 2002.
