RELATING TO THE STATE BUDGET.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1                    PART I.  GENERAL PROVISIONS
 
 2      SECTION 1.  SHORT TITLE.  This Act shall be known and may be
 
 3 cited as the General Appropriations Act of 1999.
 
 4      SECTION 2.  DEFINITIONS.  Unless otherwise clear from the
 
 5 context, as used in this Act:
 
 6      (a)  "Program ID" means the unique identifier for the
 
 7 specific program, and consists of the abbreviation for the
 
 8 organization responsible for carrying out the program, followed
 
 9 by the organization number for the program.
 
10      (b)  "Expending agency" means the executive department,
 
11 independent commission, bureau, office, board, or other
 
12 establishment of the state government (other than the
 
13 legislature, Office of Hawaiian Affairs and judiciary), the
 
14 political subdivisions of the State, or any quasi-public
 
15 institution supported in whole or in part by state funds, which
 
16 is authorized to expend specified appropriations made by this
 
17 Act.  Abbreviations where used to denote the expending agency
 
18 shall mean the following:

 2      (c)  "Means of financing," or "MOF" means the source from
 
 3 which funds are appropriated, or authorized, as the case may be,
 
 4 to be expended for the programs and projects specified in this
 
 5 Act.  All appropriations are followed by letter symbols.  Such
 
 6 letter symbols, where used, shall have the following meaning:
 
 7      A    general funds
 
 8      B    special funds
 
 9      C    general obligation bond fund
 
10      D    general obligation bond fund with debt service cost to
 
11           be paid from special funds
 
12      E    revenue bond funds
 
13      J    federal aid interstate funds

 1      (d)  "Position ceiling" means the maximum number of
 
 2 permanent positions that an expending agency is authorized for a
 
 3 particular program during a specified period or periods, as
 
 4 denoted by an asterisk.
 
 5      (e)  "Capital project number" means the official number of
 
 6 the capital project, as assigned by the responsible organization.
 
 7                 PART II.  PROGRAM APPROPRIATIONS
 
 8      SECTION 3.  APPROPRIATIONS.  The following sums, or so much
 
 9 thereof as may be sufficient to accomplish the purposes and
 
10 programs designated herein, are hereby appropriated or
 
11 authorized, as the case may be, from the means of financing
 
12 specified to the expending agencies designated for the fiscal
 
13 biennium beginning July 1, 1999, and ending June 30, 2001.  The
 
14 total expenditures and the number of positions in each fiscal
 
15 year of the biennium shall not exceed the sums and the number
 
16 indicated for each year, except as provided elsewhere in this

 1            PART III.  PROGRAM APPROPRIATION PROVISIONS
 
 2 ECONOMIC DEVELOPMENT
 
 3      SECTION 4.  Provided that the department of business,
 
 4 economic development, and tourism shall submit a detailed action
 
 5 plan to consolidate the following programs in commerce and
 
 6 industry (BED 102):
 
 7      (1)  Business support division;
 
 8      (2)  Business development and marketing division; and
 
 9      (3)  Ocean resources branch;
 
10 and provided further that this report and implementing
 
11 legislation if necessary, shall be submitted to the legislature
 
12 no later than twenty days prior to the convening of the 2000
 
13 regular session.
 
14      SECTION 5.  Provided that of the general fund appropriation
 
15 for commerce and industry (BED 102), the sum of $100,000 for
 
16 fiscal year 1999-2000 shall be expended to match federal funds
 
17 dollar-for-dollar for the establishment of manufacturing
 
18 extension programs.
 
19      SECTION 6.  Provided that of the general fund appropriation
 
20 for commerce and industry (BED 102), the sum of $500,000 for
 
21 fiscal year 1999-2000 shall be expended to assist Hawaii-based
 
22 film companies in producing documentary films relating to the
 
23 Pacific region, and for co-production costs of locally-produced

 1 programming that achieves international recognition and can serve
 
 2 multiple tourism, marketing, and income-producing objectives.
 
 3      SECTION 7.  Provided that of the general fund appropriation
 
 4 for tourism (BED 113), the sum of $1,000,000 for fiscal year
 
 5 1999-2000 shall be expended by the Hawaii tourism authority for
 
 6 the purpose of supporting Hawaii's entry in the America's Cup
 
 7 race; provided further that no funds shall be made available for
 
 8 the event unless general funds are matched by private and/or
 
 9 tourism special funds on a 1:2 ratio; and provided further that a
 
10 report on the expenditure of these funds shall be submitted to
 
11 the legislature no later than twenty days prior to the convening
 
12 of the 2000 regular session.
 
13      SECTION 8.  Provided that of the general fund appropriation
 
14 for tourism (BED 113), the sum of $686,344 in fiscal year 1999-
 
15 2000 shall be deposited into the convention center operations
 
16 special fund to enable the Hawaii tourism authority to maintain
 
17 its financial stability.
 
18      SECTION 9.  Provided that for tourism (BED 113), the
 
19 convention center authority shall submit a detailed action plan
 
20 to minimize the operational shortfalls of the Hawaii convention
 
21 center and the resulting deficits in the convention center
 
22 operations special fund; and provided further that this report

 1 shall be submitted to the legislature no later than twenty days
 
 2 prior to the convening of the 2000 regular session.
 
 3      SECTION 10.  Provided that for tourism (BED 113), the
 
 4 department of business, economic development, and tourism shall
 
 5 submit a detailed report on its plans to reschedule the debt
 
 6 service of the Hawaii convention center; and provided further
 
 7 that this report shall be submitted to the legislature by July 2,
 
 8 1999.
 
 9      SECTION 11.  Provided that the high technology development
 
10 corporation (BED 143) shall submit a detailed action plan on its
 
11 role in the consolidation of state entities involved in the
 
12 development of high technology in Hawaii, including those
 
13 divisions and offices within the department of business, economic
 
14 development, and tourism related to high technology, the research
 
15 corporation of the University of Hawaii, the pacific
 
16 international center for high technology research, the Hawaii
 
17 information network corporation, the Hawaii strategic development
 
18 corporation, the office of technology transfer and economic
 
19 development at the University of Hawaii, and the four county
 
20 economic development boards; provided further that language for
 
21 appropriate legislation shall be developed to effectuate the
 
22 consolidation; and provided further that the report and
 
23 appropriate legislation shall be submitted to the legislature no

 1 later than twenty days prior to the convening of the 2000 regular
 
 2 session.
 
 3      SECTION 12.  Provided that of the general fund appropriation
 
 4 for forestry-products development (LNR 172), the sum of $20,000
 
 5 for fiscal year 1999-2000 shall be expended to host a trees for
 
 6 life forestry conference in Hawaii; provided further that no
 
 7 funds shall be made available for the conference unless matched
 
 8 on a 1:1 state to private ratio; and provided further that a
 
 9 report on the expenditure of these funds shall be submitted to
 
10 the legislature no later than twenty days prior to the convening
 
11 of the 2000 regular session.
 
12      SECTION 13.  Provided that of the general fund appropriation
 
13 for agricultural development and marketing (AGR 171), the sum of
 
14 $75,000 for fiscal year 1999-2000 shall be expended for the
 
15 development of new markets and the expansion of existing markets
 
16 for papaya in foreign countries.
 
17      SECTION 14.  Provided that of the general fund appropriation
 
18 for agribusiness development and research (AGR 161), the sum of
 
19 $994,913 for fiscal year 1999-2000 and the sum of $547,413 for
 
20 fiscal year 2000-2001 shall be expended as follows:

15      (1)  The department of agriculture shall submit an itemized
 
16           report which shall include, but not be limited to, the
 
17           progress being made with each specific commodity that
 
18           is funded for research, and projected funding, if
 
19           necessary, for the continuation of each of the research
 
20           projects with justification for recommended funding in
 
21           future years; and provided further that this report
 
22           shall be submitted to the legislature no later than

 1           twenty days prior to the convening of the 2000 and 2001
 
 2           regular sessions;
 
 3      (2)  The department of agriculture shall support efforts to
 
 4           seek and obtain grants and other funds for agricultural
 
 5           research and development;
 
 6      (3)  The chairperson of the board of agriculture shall
 
 7           expedite all projects under this section, especially
 
 8           emergency actions; and
 
 9      (4)  The sums appropriated shall be expended by the
 
10           department of agriculture for the purposes of this Act;
 
11           provided that:
 
12           (a)  The department of agriculture may require that any
 
13                funds made available under this Act be matched by
 
14                private funds; and
 
15           (b)  The department of agriculture is authorized to
 
16                transfer funds between projects under this section
 
17                or to other projects or commodities as deemed
 
18                necessary by the department of agriculture.
 
19      SECTION 15.  Provided that of the general fund appropriation
 
20 for agribusiness development and research (AGR 161), the sum of
 
21 $190,558 for fiscal year 1999-2000 and the sum of $190,558 for
 
22 fiscal year 2000-2001 shall be deposited into the Hawaii

 1 agricultural development revolving fund to be expended for the
 
 2 purposes of the fund.
 
 3      SECTION 16.  Provided that of the general fund appropriation
 
 4 for agribusiness development and research (AGR 161), the sum of
 
 5 $180,000 for fiscal year 1999-2000 shall be expended for the
 
 6 purpose of research on diseases and other problems afflicting
 
 7 taro throughout the State to be performed by the University of
 
 8 Hawaii college of tropical agriculture and human resources.
 
 9      SECTION 17.  Provided that of the general fund appropriation
 
10 for general support for economic development (BED 142), the sum
 
11 of $225,000 for fiscal year 1999-2000 shall be expended for the
 
12 purpose of establishing and operating a natural heritage data and
 
13 training center at the University of Hawaii center for
 
14 conservation research and training; provided further that
 
15 matching funds shall be provided by the private sector; and
 
16 provided further that if matching funds are not provided by the
 
17 private sector, the general funds for this purpose referred to in
 
18 this provision shall not be used for other purposes and shall be
 
19 lapsed to the general fund.
 
20 TRANSPORTATION
 
21      SECTION 18.  Provided that of the special fund
 
22 appropriations for the airports division (TRN 102-TRN 195), the
 
23 following sums specified for special repair and maintenance

 3      SECTION 19.  Provided that of the special fund
 
 4 appropriations for the airports division (TRN 102-TRN 195), that
 
 5 the department of transportation shall provide continued support
 
 6 for the hookipa aloha council program, and implement the made in
 
 7 Hawaii products program in the Hawaii state airports cultural
 
 8 master plan.
 
 9      SECTION 20.  Provided that of the special fund appropriation
 
10 for airports administration (TRN 195), the sum of $118,543,946
 
11 for fiscal year 1999-2000 and the sum of $122,619,105 for fiscal
 
12 year 2000-2001 shall be expended for the following purposes:

 9      SECTION 24.  Provided that of the special fund appropriation
 
10 for highways administration (TRN 595), the sum of $41,755,999 for
 
11 fiscal year 1999-2000 and the sum of $48,525,776 for fiscal year
 
12 2000-2001 shall be expended for the following purposes:

20      SECTION 25.  Provided that of the special fund appropriation
 
21 for general administration (TRN 995), the sum of $1,500,000 for
 
22 fiscal year 1999-2000 and the sum of $1,000,000 for fiscal year
 
23 2000-2001 shall be expended for the purpose of resolving all

 1 computer and information system problems that occur as a result
 
 2 of the year 2000 four-digit programming code; provided further
 
 3 that the department shall submit a report to the legislature no
 
 4 later than twenty days prior to the convening of the 2000 and
 
 5 2001 regular sessions regarding the resolution of these problems
 
 6 and procurement problems pointed out by the auditor in the
 
 7 Financial Audit of the Airports Division of the Department of
 
 8 Transportation(#99-8); and provided further that any funds not
 
 9 expended for this purpose shall be lapsed to the general
 
10 administration special fund.
 
11      SECTION 26.  Provided that the department of transportation
 
12 shall maintain competition in the selection of contractors and
 
13 adhere to the Hawaii Public Procurement Code and related
 
14 administrative rules on all computer related procurements; and
 
15 provided further that a detailed status report of its findings to
 
16 improve its procurement methods shall be submitted to the
 
17 legislature no later than twenty days prior to the convening of
 
18 the 2000 and 2001 regular sessions.
 
19 ENVIRONMENTAL PROTECTION
 
20      SECTION 27.  There is appropriated out of the natural area
 
21 reserve fund the sum of $425,000 for fiscal year 1999-2000 to be
 
22 placed in the general fund for forests and wildlife resources
 
23 (LNR 402); provided that of the general fund appropriation for

 1 forests and wildlife resources (LNR 402), the sum of $175,000 for
 
 2 fiscal year 1999-2000 shall be expended for miconia eradication
 
 3 on the island of Hawaii; provided further that the sum of $50,000
 
 4 for fiscal year 1999-2000 shall be expended for miconia
 
 5 eradication on Maui; provided further that the sum of $200,000
 
 6 shall be expended for west Maui watershed management or the Maui
 
 7 invasive species committee, or both; and provided further that
 
 8 funds expended for the Maui invasive species committee shall be
 
 9 used to match nonstate funds.
 
10 HEALTH
 
11      SECTION 28.  Provided that the department of health shall
 
12 not reduce the allocation of funding for STD/AIDS prevention
 
13 services (HTH 121) in a manner that may jeopardize the Ryan White
 
14 federal funds; provided further that the department of health
 
15 shall submit a report to the legislature itemizing the levels of
 
16 funding provided to all STD/AIDS prevention providers; and
 
17 provided further that the report shall be submitted to the
 
18 legislature no later than twenty days prior to the convening of
 
19 the 2000 regular session.
 
20      SECTION 29.  Provided that of the special fund appropriation
 
21 for maternal and child health services (HTH 550), the sum of
 
22 $3,500,000 in fiscal year 1999-2000 and the sum of $8,357,050 in
 
23 fiscal year 2000-2001 shall be expended by the healthy start

 1 program; and provided further that funds may be expended up to
 
 2 the ceiling amounts as specified and shall be contingent upon the
 
 3 availability of funds from the tobacco settlement.
 
 4      SECTION 30.  Provided that of the general fund appropriation
 
 5 for health resources administration (HTH 595), the sum of
 
 6 $750,000 for fiscal year 1999-2000 and the sum of $750,000 for
 
 7 fiscal year 2000-2001 shall be expended for primary health care
 
 8 services for the medically uninsured.
 
 9      SECTION 31.  Provided that of the special fund appropriation
 
10 for alcohol and drug abuse (HTH 440), the sum of $46,000 in
 
11 fiscal year 1999-2000 from the domestic violence prevention
 
12 special fund shall be earmarked for domestic violence programs
 
13 and/or services.
 
14 SOCIAL SERVICES
 
15      SECTION 32.  Provided that of the general fund appropriation
 
16 for health care payments (HMS 230), the sum of $1,000,000 for
 
17 fiscal year 1999-2000 shall be expended for modifications to the
 
18 medicaid management information system (MMIS); provided further
 
19 that any unexpended funds shall be lapsed to the general fund;
 
20 provided further that the department of human services shall
 
21 submit a report on expenditures, status, and projected needs for
 
22 the medicaid management information system and the Hawaii
 
23 automated welfare information system; and provided further that

 1 this report shall be submitted to the legislature no later than
 
 2 twenty days prior to the convening of the 2000 regular session.
 
 3      SECTION 33.  Provided that the child support enforcement
 
 4 services (ATG 500) shall prepare and submit a report that shall
 
 5 include, but not be limited to, the following information:
 
 6      (1) Status and measures of effectiveness of the
 
 7          implementation of the automated child support
 
 8          enforcement (KEIKI) system;
 
 9      (2) Effectiveness of the agency in addressing problems of
 
10          erroneous determinations, clients' inability to reach
 
11          child support enforcement agency staff by telephone, and
 
12          other client problems;
 
13      (3) Recommendations concerning the necessary measures to
 
14          further improve the performance of the child support
 
15          enforcement agency in meeting the needs of its clients;
 
16 provided further that the child support enforcement agency shall
 
17 submit a report to the legislature no later than twenty days
 
18 prior to the convening of the 2000 regular session. 
 
19      SECTION 34.  Provided that of the general fund appropriation
 
20 for the executive office on aging (HTH 904), the sum of $90,721
 
21 for fiscal year 1999-2000 shall be expended for the long-term
 
22 care volunteer ombudsman program; and provided further that the
 
23 executive office on aging shall submit a report to the

 1 legislature detailing the expenditure of funds no later than
 
 2 twenty days prior to the convening of the 2000 regular session.
 
 3      SECTION 35. Provided that of the general fund appropriation
 
 4 for federal maximization and community services (HMS 235), the
 
 5 sum of $200,000 for fiscal year 1999-2000 shall be expended for
 
 6 both grant writing and support staff to allow the office to serve
 
 7 as Hawaii's clearinghouse for state agencies to increase the
 
 8 amount of federal funds obtained by the State of Hawaii.
 
 9      SECTION 36.  Provided that of the general fund appropriation
 
10 for planning, development, management and general support for
 
11 Hawaiian homestead lands (HHL 602), the sum of $76,020 for fiscal
 
12 year 1999-2000 shall be expended to maintain and upkeep the
 
13 Nanakuli homestead cemetery. 
 
14      SECTION 37.  Provided that of the general fund appropriation
 
15 for planning, development, management and general support for
 
16 Hawaiian homestead lands (HHL 602), the sum of $242,736 for
 
17 fiscal year 1999-2000 shall be used to continue the Waianae coast
 
18 community benchmarking pilot project as authorized by Act 314,
 
19 Session Laws of Hawaii 1997.
 
20      SECTION 38.  Provided that of the general fund appropriation
 
21 for general support for health care payments (HMS 902), the sum
 
22 of $1,000,000 for fiscal year 1999-2000 may be expended for both
 
23 medical and psychiatric initial evaluations and reevaluations;

 1 and provided further that any unexpended funds shall be lapsed to
 
 2 the general fund.
 
 3 EDUCATION
 
 4      SECTION 39.  Provided that of the general fund appropriation
 
 5 for school based budgeting (EDN 100), the sum of $943,364 for
 
 6 fiscal year 1999-2000 shall be expended for the youth challenge
 
 7 program conducted by the department of defense; and provided
 
 8 further that the department of education shall submit a report to
 
 9 the legislature detailing the impact of these funds no later than
 
10 twenty days prior to the convening of the 2000 regular session.
 
11      SECTION 40.  Provided that of the general fund appropriation
 
12 for school based budgeting (EDN 100), the sum of $20,000 for
 
13 fiscal year 1999-2000 shall be made available for the Hawaiian
 
14 entrepreneurial school; and provided further that the provision
 
15 of these funds shall be matched on a 1:1 general fund to private
 
16 fund ratio.
 
17      SECTION 41.  Provided that of the general fund appropriation
 
18 for school based budgeting (EDN 100), the sum of $20,000 in
 
19 fiscal year 1999-2000 shall be provided for the Puuwai Momi
 
20 housing tutoring project for the purpose of assisting
 
21 economically-challenged students from Aiea High School and Aiea

 1      SECTION 42.  Provided that the department of education shall
 
 2 classify all counselors that service students in the Felix-class
 
 3 in a manner similar to the twelve-month social worker
 
 4 classification; and provided further that this twelve-month
 
 5 classification shall not apply to existing counselors classified
 
 6 as ten-month employees.
 
 7      SECTION 43.  Provided that of the general fund appropriation
 
 8 for school support (EDN 400), the sum of $511,500 for fiscal year
 
 9 1999-2000 shall be expended to continue the implementation of
 
10 electronic point-of-sale meal purchase systems in all department
 
11 of education schools in order to eliminate the overt
 
12 identification of students who receive reduced-price or free
 
13 meals, increase the number of students eating meals, facilitate
 
14 the collection of funds, and eliminate many of the problems
 
15 associated with students' handling of money; provided further
 
16 that the department may offer no greater than a five per cent
 
17 discount for the monthly prepayment of meals for the purpose of
 
18 encouraging prepayment in order to reduce the workload burden
 
19 placed upon staff; provided further that the department shall
 
20 prioritize the expected increases in federal reimbursements for
 
21 meals served for the implementation of point-of-sale systems in
 
22 all remaining schools; provided further that the department shall
 
23 submit a report detailing the status of point-of-sale system

 1 implementation in all schools, average number of students eating
 
 2 meals in each payment category, and federal reimbursements
 
 3 received; and provided further that this report shall be

 5 the convening of the 2000 and 2001 regular sessions.
 
 6      SECTION 44.  Provided that the department of education shall
 
 7 submit a report to the legislature identifying all ten-month,
 
 8 twelve-month, and other employees in adult education, and their
 
 9 corresponding salary levels; provided further that the department
 
10 shall develop a plan to convert the existing ten-month adult
 
11 education operation into a twelve-month operation; and provided
 
12 further that this report and plan shall be submitted to the
 
13 legislature no later than twenty days prior to the convening of
 
14 the 2000 regular session.
 
15 HIGHER EDUCATION
 
16      Section 45.  Provided that of the general fund appropriation
 
17 for the University of Hawaii, Manoa (UOH 100), the sum of $50,000
 
18 for fiscal year 1999-2000 shall be expended for geography
 
19 education/training, and developing educators to promote local
 
20 implementation of national geography standards, and to assist the
 
21 department of education in aligning Hawaii content and
 
22 performance standards with national geography standards; and

 1 provided further that no funds shall be expended unless matched
 
 2 dollar-for-dollar by the National Geographic Society.
 
 3      SECTION 46.  Provided that of the general fund appropriation
 
 4 for the University of Hawaii, Manoa (UOH 100) John A. Burns
 
 5 school of medicine, the sum of $100,000 for fiscal year 1999-2000
 
 6 and the sum of $100,000 for fiscal year 2000-2001 shall be
 
 7 expended as state match for federal funds for the federally
 
 8 funded area health education center program. 
 
 9      SECTION 47.  Provided that of the general fund appropriation
 
10 for the University of Hawaii, Manoa (UOH 100), the sum of
 
11 $140,750 for fiscal year 1999-2000 shall be expended for the
 
12 Hawaii Institute for Educational Partnerships.
 
13      SECTION 48.  Provided that the University of Hawaii, Manoa
 
14 (UOH 100), shall submit a report on its progress in seeking
 
15 additional private, federal or other funds to continue the
 
16 operations of the John A. Burns school of medicine to the
 
17 legislature by July 2, 1999.
 
18      SECTION 49.  Provided that of the general fund appropriation
 
19 for small business development (UOH 220), the sum of $735,000 for
 
20 fiscal year 1999-2000 and the sum of $735,000 for fiscal year
 
21 2000-2001 shall be used as a state match for federal funds to
 
22 operate the small business development center and business
 
23 research library.

 1      SECTION 50.  Provided that of the general fund appropriation
 
 2 for the University of Hawaii, West Oahu (UOH 700), the sum of

 4 fiscal year 2000-2001 shall be expended to meet the statutory
 
 5 purposes of the center for labor education and research.
 
 6      SECTION 51.  Provided that of the general fund appropriation
 
 7 for the University of Hawaii, community colleges (UOH 800), the
 
 8 sum of $2,500 for fiscal year 1999-2000 and the sum of $2,500 for
 
 9 fiscal year 2000-2001 shall be made available to be established
 
10 as a separate account for a protocol fund to be expended at the
 
11 discretion of the senior vice president and chancellor for
 
12 community colleges.
 
13 CULTURE AND RECREATION
 
14      SECTION 52.  Provided that of the general fund appropriation
 
15 for performing and visual arts events (AGS 881), the sum of
 
16 $200,000 for fiscal year 1999-2000 shall be expended for the
 
17 purpose of funding the Okinawan centennial celebration commission
 
18 and its activities.
 
19      SECTION 53. Provided that of the general fund appropriation
 
20 for performing and visual arts events (AGS 881), the sum of
 
21 $200,000 for fiscal year 1999-2000 shall be expended for a
 
22 historical Chinese center to provide educational and cultural

 1      SECTION 54.  Provided that of the general fund appropriation
 
 2 for performing and visual arts events (AGS 881), the sum of
 
 3 $100,000 for fiscal year 1999-2000 shall be expended to develop
 
 4 performance standards and a strategic plan for arts education;
 
 5 and provided that the state foundation on culture and the arts
 
 6 shall, in consultation with the department of education:
 
 7      (1)  Review, revise, and complete by June 1, 2000, the
 
 8           Hawaii content and performance standards in the arts
 
 9           for grades K-12 as recommended by the Hawaii commission
 
10           on performance standards and adopted by the board of
 
11           education in accordance with Act 334, Session Laws of
 
12           Hawaii 1991; and
 
13      (2)  Develop a statewide strategic plan for grades K-12 arts
 
14           education that incorporates and integrates the arts
 
15           content and performance standards established in
 
16           paragraph (1).  The plan shall address:
 
17           (a)  Curriculum development for classroom instruction;
 
18           (b)  Professional development for educators and
 
19                artists; and
 
20           (c)  The methodology and mechanisms by which
 
21                implementation and attainment of fine arts content
 
22                and performance standards can be ascertained and
 
23                assessed;

 1 provided further that the state foundation on culture and the
 
 2 arts shall also consult with the colleges of education and the

 5 for Arts Education, and other organizations and individuals in
 
 6 these matters; and provided further that the state foundation on
 
 7 culture and the arts shall submit an annual report to the
 
 8 legislature of its efforts to implement the provisions of this
 
 9 section no later than twenty days prior to the convening of each
 
10 regular session from 2000 to 2005.
 
11      SECTION 55.  Provided that of the special fund appropriation
 
12 for spectator events and shows-aloha stadium (AGS 889), the sum
 
13 of $2,500 for fiscal year 1999-2000 and the sum of $2,500 for
 
14 fiscal year 2000-2001 may be made available to be established as
 
15 a separate account for a protocol fund to be expended at the
 
16 discretion of the stadium manager for promotion and other
 
17 stadium-related purposes.
 
18 PUBLIC SAFETY
 
19      SECTION 56.  Provided that of the general fund appropriation
 
20 for general administration (PSD 900), the sum of $20,046,400 for
 
21 fiscal year 1999-2000 and the sum of $20,046,400 for fiscal year
 
22 2000-2001 shall be expended for the transportation and necessary
 
23 operating costs of housing approximately 1,189 inmates in fiscal

 1 year 1999-2000 and approximately 1,189 inmates in fiscal year
 
 2 2000-2001 in mainland based correctional facilities; provided

 5 department of public safety shall submit a report itemizing
 
 6 expenditures to the legislature no later than twenty days prior
 
 7 to the convening of the 2000 and 2001 regular sessions.
 
 8      SECTION 57.  Provided that the department of public safety
 
 9 shall submit a detailed staffing plan to the legislature no later
 
10 than twenty days prior to the convening of the 2000 regular
 
11 session including but not limited to a listing of and number of
 
12 full-time equivalent vacancies by means of financing and funding
 
13 amounts and how and when the department intends to fill its
 
14 permanent/temporary/unbudgeted temporary positions; provided
 
15 further that the plan shall include but not be limited to how the
 
16 department intends to prevent its overtime cost overruns, ways to
 
17 better manage its staffing needs per facility statewide and
 
18 reasons for the vacancies and remedies to address the problems;
 
19 provided further that fiscal year 2000-2001 funding for vacancies
 
20 shall be contingent upon the staffing plan update and plan for
 
21 improvement, and that the report shall include remedial actions
 
22 undertaken to curtail and reduce the hours of overtime and any
 
23 other problems; and provided further that a report detailing the

 1 improvements to correct the department's overtime and vacancy
 
 2 deficiencies shall be submitted to the legislature no later than

 4      SECTION 58.  Provided that the auditor shall conduct a
 
 5 management and financial audit of the department of public safety
 
 6 to include, but not be limited to, the department's planning,
 
 7 management, staffing, and expenditures for facilities, contracts,
 
 8 litigation, and other operational requirements; and provided
 
 9 further that the auditor shall submit a report of findings and
 
10 recommendations to the legislature no later than twenty days
 
11 prior to the convening of the 2000 regular session.
 
12      SECTION 59.  Provided that of the general fund appropriation
 
13 for amelioration of physical disasters (DEF 110), the sum of
 
14 $150,000 for fiscal year 1999-2000 and the sum of $150,000 for
 
15 fiscal year 2000-2001 shall be expended for temporary cash flow
 
16 shortfalls pending receipt of federal funds; and provided further
 
17 that the general fund shall be reimbursed by the amounts provided
 
18 herein upon receipt of such federal funds.
 
19 INDIVIDUAL RIGHTS
 
20      SECTION 60.  Provided that conveyances and recordings (LNR
 
21 111), shall submit a detailed report by means of financing on the
 
22 progress towards completion of equipment modernization in the
 
23 bureau of conveyances; and provided further that this report

 5 for the office of the governor (GOV 100), the sum of $14,031 for
 
 6 fiscal year 1999-2000 and the sum of $14,031 for fiscal year
 
 7 2000-2001 shall be expended for the governor's "contingency fund"
 
 8 pursuant to section 37-71(f), Hawaii Revised Statutes; and
 
 9 provided further that such funds may be transferred to other
 
10 programs and agencies and allotted, with the approval of the
 
11 governor, to meet contingencies as they arise.
 
12      SECTION 62.  Provided that of the general fund appropriation
 
13 for the office of the governor (GOV 100), the sum of $65,647 for
 
14 fiscal year 1999-2000 and $65,647 for fiscal year 2000-2001 shall
 
15 be expended for Council of State Government dues.
 
16      SECTION 63.  Provided that of the general fund appropriation
 
17 for program planning, analysis and budgeting (BUF 101), the sum
 
18 of $213,919,464 for fiscal year 1999-2000 and the sum of
 
19 $214,352,463 for fiscal year 2000-2001 shall be expended for
 
20 health fund premiums for actives and retirees; provided further
 
21 that these funds shall not be expended for any other purpose;
 
22 provided further that any unexpended funds shall be lapsed to the
 
23 general fund; and provided further that the department of budget

 8 counsel; provided further that these funds shall not be expended
 
 9 for any other purpose; provided further that any unexpended funds
 
10 shall be lapsed to the general fund; and provided further that
 
11 the department of budget and finance shall submit a report of all
 
12 expenditures under this section to the legislature no later than
 
13 twenty days prior to the convening of the 2000 and 2001 regular
 
14 sessions.
 
15      SECTION 65.  Provided that of the general fund appropriation
 
16 for program planning, analysis and budgeting (BUF 101), the sum
 
17 of $2,400,000 for fiscal year 1999-2000 and the sum of $2,400,000
 
18 for fiscal year 2000-2001 shall be expended for witness fees and
 
19 related expenses; provided further that these funds shall not be
 
20 expended for any other purpose; provided further that any
 
21 unexpended funds shall be lapsed to the general fund; and
 
22 provided further that the department of budget and finance shall
 
23 submit a report of all expenditures under this section to the

 6 fiscal year 2000-2001 shall be expended for the Bishop Museum.
 
 7      SECTION 67.  Provided that the office of the governor shall
 
 8 manage all State aggregate expenditures appropriated for the
 
 9 purpose of administering and delivering special education and
 
10 child and adolescent mental health services for the State, as
 
11 required by the judiciary and the departments of the attorney
 
12 general, education, health, and human services; provided further
 
13 that a special education/Felix/child and adolescent mental health
 
14 program (GOV 200), shall be created for the management of these
 
15 funds; provided further that the office of the governor shall be
 
16 responsible for reviewing requests for funds by the judiciary and
 
17 the departments of the attorney general, education, health, and
 
18 human services and allocating approved requests for funds via
 
19 interdepartmental transfers; and provided further that the
 
20 funding of cost overruns shall be the responsibility of the
 
21 expending agency.
 
22      SECTION 68.  Provided that of the general funds provided to
 
23 special education/Felix/child and adolescent mental health (GOV

 1 200), the sum of $3,941,443 for fiscal year 1999-2000 and

 5 for special education/Felix/child and adolescent mental health
 
 6 (GOV 200), the sum of $4,538,025 for fiscal year 1999-2000 and
 
 7 the sum of $6,250,185 for fiscal year 2000-2001 shall be expended
 
 8 for early intervention and preventive services for infants and
 
 9 toddlers, including, but not limited to, the zero-to-three
 
10 program.
 
11      SECTION 70.  Provided that of the general fund appropriation
 
12 for special education/Felix/child and adolescent mental health
 
13 (GOV 200), the sum of $1,088,207 for fiscal year 1999-2000 and
 
14 the sum of $1,088,207 for fiscal year 2000-2001 shall be used for
 
15 Felix class youths with developmental disabilities. 
 
16      SECTION 71.  Provided that of the general fund appropriation
 
17 for special education/Felix/child and adolescent mental health
 
18 (GOV 200), the sum of $1,564,242 for fiscal year 1999-2000 and
 
19 the sum of $1,564,242 for fiscal year 2000-2001 shall be expended
 
20 by the department of education for home/hospital instruction.
 
21      SECTION 72.  Provided that of the general fund appropriation
 
22 for special education/Felix/child and adolescent mental health
 
23 (GOV 200), the sum of $128,925 in fiscal year 1999-2000 and the

 1 sum of $128,925 in fiscal year 2000-2001 shall be expended for

 3      SECTION 73.  Provided that of the general fund appropriation

 5 (GOV 200), the sum of $86,918,498 for fiscal year 1999-2000 and
 
 6 the sum of $89,297,094 for fiscal year 2000-2001 shall be
 
 7 expended by the department of health to provide mental health
 
 8 services for children ages 3-20 years; and provided further that
 
 9 the department of health may transfer funds to the department of
 
10 education for allocation to the school districts and complexes
 
11 that are ready to provide school based services.
 
12      SECTION 74.  Provided that of the general fund appropriation
 
13 for special education/Felix/child and adolescent mental health
 
14 (GOV 200), the sum of $1,657,808 in fiscal year 1999-2000 and the
 
15 sum of $1,657,808 in fiscal year 2000-2001 shall be expended by
 
16 the department of education for behavior management services.
 
17      SECTION 75.  Provided that of the general fund appropriation
 
18 for special education/Felix/child and adolescent mental health
 
19 (GOV 200), the sum of $143,048,713 for fiscal year 1999-2000 and
 
20 $156,589,587 for fiscal year 2000-2001 shall be distributed on a
 
21 pro-rata basis to each school district to provide instructional
 
22 and program support to Individuals with Disabilities Education
 
23 Act (IDEA) students; provided further that based on the projected

 1 IDEA student enrollment of 22,400 in fiscal year 1999-2000, the
 
 2 per pupil costs distributed to each district shall be not less
 
 3 than $5,018 and based on the projected IDEA student enrollment of
 
 4 23,000 in fiscal year 2000-2001, the per pupil costs distributed
 
 5 to each district shall be not less than $5,330; and provided
 
 6 further that funds in addition to the pro-rata share shall be
 
 7 provided for children that require private school placement or
 
 8 services that far exceed the pro-rata cost.
 
 9     SECTION 76.  Provided that the Felix operations
 
10 management office shall coordinate, prepare, and submit a
 
11 status report of the State's progress in meeting the
 
12 requirements of the Felix v. Cayetano consent decree;
 
13 provided further that this report shall include, but not
 
14 be limited to, the following:
 
15     (1) An accounting of all decree related
 
16         appropriations, allocations, and expenditures by
 
17         means of financing and by organizational unit
 
18         within each department;
 
19     (2) Status of the State's progress toward, or
 
20         maintenance of, compliance with the requirements
 
21         of the consent decree including, but not limited

16         (e) Range and types of services available to
 
17             children and adolescents with mental health
 
18             needs served by the departments of education

20     (3) An independent evaluation of the policies and
 
21         procedures of the department of education to
 
22         identify and assess children who are receiving

 1         shall include an evaluation of a statistically
 
 2         significant random sampling of individualized
 
 3         education plans and/or modification plans to

 6 provided further that the report shall be submitted to the
 
 7 legislature thirty days after the end of each quarter
 
 8 during fiscal biennium 1999-2001; and provided further
 
 9 that this section shall sunset on June 30, 2001.
 
10      SECTION 77.  Provided that of the tax revenues deposited
 
11 into the integrated tax information management system special
 
12 fund for supporting services revenue collection (TAX 107), the
 
13 sum of $5,145,940 for fiscal year 1999-2000 shall be expended for
 
14 contract payments for the design, development, and implementation
 
15 of the integrated tax information management system; and provided
 
16 further that funds from this appropriation shall only be expended
 
17 from the increase in the amount of taxes, interests, and
 
18 penalties collected and attributable to the implementation of the
 
19 integrated tax information management system; and provided
 
20 further that the department of taxation shall submit a report to
 
21 the legislature no later than twenty days prior to the convening
 
22 of the 2000 and 2001 regular sessions as provided for in Act 273,
 
23 Session Laws of Hawaii 1996.

 1      SECTION 78.  Provided that of the general fund appropriation
 
 2 for financial administration (BUF 115), the sum of $378,949,913

 4 year 2000-2001 shall be expended for interest and principal on
 
 5 general obligation bonds; provided further that these funds shall
 
 6 not be expended for any other purpose; provided further that any

13 for financial administration (BUF 115), the sum of $5,000 for
 
14 fiscal year 1999-2000 and the sum of $5,000 for fiscal year
 
15 2000-2001 shall be made available to be established as a separate
 
16 account for a bond improvement protocol fund to be expended at
 
17 the discretion of the director of finance for promotion and
 
18 improvement of the state and counties' bond ratings and sales.
 
19      SECTION 80.  Provided that of the general fund appropriation
 
20 for financial administration (BUF 115), the sum of $1,760,751 for
 
21 fiscal year 1999-2000 and the sum of $1,760,751 for fiscal year
 
22 2000-2001 shall be expended to meet the requirements of the
 
23 uniform disposition of unclaimed property program pursuant to

 6 deposits of all unclaimed property into the general fund and the

10      SECTION 81.  Provided that of the general fund appropriation
 
11 for legal services (ATG 100), the sum of $250,000 for fiscal year
 
12 1999-2000 and the sum of $250,000 for fiscal year 2000-2001 shall
 
13 be expended to continue representing the University of Hawaii in
 
14 lawsuits filed against the University of Hawaii prior to July 1,
 
15 1998 and in matters routinely handled by the department of the
 
16 attorney general, including areas of tort defense, collections
 
17 and opinions on matters of statewide concern; provided further
 
18 that the value of legal services furnished by the department of
 
19 the attorney general shall be measured in attorney hours at the
 
20 regular rate charged to other State agencies; provided further
 
21 that the department of the attorney general shall furnish the
 
22 appropriate level of support services to coincide with the
 
23 attorney hours; and provided further that for legal services

 5 for legal services (ATG 100), the sum of $27,500 for fiscal year
 
 6 1999-2000 and the sum of $33,200 for fiscal year 2000-2001 shall
 
 7 be expended for Hawaii's contribution to the costs of the
 
 8 National Conference of Commissioners on Uniform State Laws and
 
 9 the State commission's attendance at the annual meeting of the
 
10 national conference for fiscal years 2000 and 2001.
 
11      SECTION 83.  Provided that of the general fund appropriation
 
12 for work force attraction, selection, classification and
 
13 effectiveness (HRD 102), the sum of $4,981,226 for fiscal year

22 submitted to the legislature no later than twenty days prior to

 1      SECTION 88.  Provided that of the general fund appropriation
 
 2 for office leasing (AGS 223), the sum of $13,815,521 for fiscal

 4 2001 shall be expended for leasing of private office space, and
 
 5 all other costs associated with the office leasing program; and
 
 6 provided that beginning in fiscal year 1999-2000 the department
 
 7 shall reduce leased square footage on Oahu by a minimum of twenty
 
 8 per cent by June 30, 2000 (exclusive of the Hemmeter building

18          PART IV.  CAPITAL IMPROVEMENT PROGRAM PROJECTS
 
19      SECTION 89.  CAPITAL IMPROVEMENT PROJECTS AUTHORIZED.  The
 
20 sums of money appropriated or authorized in part II of this Act
 
21 for capital improvements shall be expended for the projects
 
22 listed below.  Accounting of the appropriations by the department
 
23 of accounting and general services shall be based on the projects

15                    PART VI. ISSUANCE OF BONDS
 
16      SECTION 132.  GOVERNOR'S DISCRETIONARY POWERS.  When it is
 
17 deemed in the public interest of the State, the governor, in his
 
18 discretion, is authorized to use general fund savings or balances
 
19 determined to be available from authorized general fund program
 
20 appropriations to finance capital improvement projects authorized
 
21 in this Act or any other act currently authorized by the
 
22 legislature, where the method of financing is designated to be
 
23 the general obligation bond fund.  Any law or provision to the
 
24 contrary notwithstanding, the governor may replace general
 
25 obligation bond funds appropriated for capital improvement

 1 projects with general obligation reimbursable bond funds, when
 
 2 the expenditure of such general obligation reimbursable bond
 
 3 funds is deemed appropriate for the project.
 
 4      SECTION 133.  AIRPORT REVENUE BONDS.  The department of
 
 5 transportation is authorized to issue airport revenue bonds for
 
 6 airport capital improvement program projects authorized in part
 
 7 II and listed in part IV of this Act and designated to be
 
 8 financed by revenue bond funds or by general obligation bond
 
 9 funds with debt service cost to be paid from special funds, in
 
10 such principal amount as shall be required to yield the amounts
 
11 appropriated for such capital improvements program projects, and,
 
12 if so determined by the department and approved by the governor,
 
13 such additional principal amount as may be deemed necessary by
 
14 the department to pay interest on such airport revenue bonds
 
15 during the estimated period of construction of the capital
 
16 improvements program project for which such airport revenue bonds
 
17 are issued, to establish, maintain, or increase reserves for the
 
18 airport revenue bonds and to pay the expenses of issuance of such
 
19 bonds.  The aforementioned airport revenue bonds shall be issued
 
20 pursuant to the provisions of part III of chapter 39, Hawaii
 
21 Revised Statutes, as the same may be amended from time to time.
 
22 The principal of and interest on airport revenue bonds, to the
 
23 extent not paid from the proceeds of such bonds, shall be payable

 1 solely from and secured solely to the revenues from airports and
 
 2 related facilities under the ownership of the State or operated
 
 3 and managed by the department and the aviation fuel taxes levied
 
 4 and paid pursuant to sections 243-4(a)(2) and 248-8, Hawaii
 
 5 Revised Statutes, or such parts of either thereof as the
 
 6 department may determine, including rents, landing fees, and
 
 7 other fees or charges presently or hereafter derived from or
 
 8 arising through the ownership, operation, and management of
 
 9 airports and related facilities and the furnishing and supplying
 
10 of the services thereof.  The expenses of the issuance of such
 
11 airport revenue bonds shall to the extent not paid from the
 
12 proceeds of such bonds shall be paid from the airport revenue
 
13 fund.
 
14      The governor, in his discretion, is authorized to use the
 
15 airport revenue fund to finance those projects authorized in part
 
16 II and listed in part IV of this Act where the means of financing

18      SECTION 134.  HARBOR REVENUE BONDS.  The department of
 
19 transportation is authorized to issue harbor revenue bonds for
 
20 harbor capital improvement program projects authorized in part II
 
21 and listed in part IV of this Act and designated to be financed
 
22 by revenue bond funds or by general obligation bond funds with
 
23 debt service cost to be paid from special funds, in such

 1 principal amount as shall be required to yield the amounts
 
 2 appropriated for such capital improvement program projects, and,
 
 3 if so determined by the department and approved by the governor,
 
 4 such additional amounts as may be deemed necessary by the
 
 5 department to pay interest on such revenue bonds during the
 
 6 estimated construction period of the capital improvement project
 
 7 for which such harbor revenue bonds are issued, to establish,
 
 8 maintain, or increase reserves for the harbor revenue bonds or
 
 9 harbor revenue bonds heretofore authorized (whether authorized
 
10 and issued or authorized and still unissued), and to pay the
 
11 expenses of issuance of such bonds.  The aforementioned harbor
 
12 revenue bonds shall be issued pursuant to the provisions of part
 
13 III of chapter 39, Hawaii Revised Statutes, as the same may be
 
14 amended from time to time.  The principal of and interest on
 
15 harbor revenue bonds, to the extent not paid from the proceeds of
 
16 such bonds, shall be payable solely from and secured solely by
 
17 the revenues derived from harbors and related facilities under
 
18 the ownership of the State or operated and managed by the
 
19 department, including rents, mooring, wharfage, dockage, and
 
20 pilotage fees, and other fees or charges presently or hereafter
 
21 derived from or arising through the ownership, operation, and
 
22 management of harbor and related facilities and the furnishing
 
23 and supplying of the services thereof.  The expenses of the

 1 issuance of such harbor revenue bonds shall, to the extent not
 
 2 paid from the proceeds of such bonds, be paid from the harbor
 
 3 special fund.
 
 4      The governor, in his discretion, is authorized to use the
 
 5 harbor revenue fund to finance those projects authorized in part
 
 6 II and listed in part IV of this Act where the means of financing
 
 7 is designated to be by harbor revenue bond funds.
 
 8      SECTION 135.  HIGHWAY REVENUE BONDS.  The department of
 
 9 transportation is authorized to issue highway revenue bonds for
 
10 highway capital improvement projects authorized in part II and
 
11 listed in part IV of this Act and designated to be financed by
 
12 revenue bond funds or by general obligation bond funds with the
 
13 debt service cost to be paid from special funds, in such
 
14 principal amount as shall be required to yield the amounts
 
15 appropriated for such capital improvement projects, and, if so
 
16 determined by the department and approved by the governor, such
 
17 additional principal amount as may be deemed necessary by the
 
18 department to pay interest on such highway revenue bonds during
 
19 the estimated period of construction of the capital improvement
 
20 project for which such highway revenue bonds are issued, to
 
21 establish, maintain, or increase reserves for such highway
 
22 revenue bonds or highway revenue bonds heretofore authorized
 
23 (whether authorized and issued or authorized and still unissued),

 1 and to pay all or any part of the expenses related to the
 
 2 issuance of such highway revenue bonds.  The aforementioned
 
 3 highway revenue bonds shall be issued pursuant to the provisions
 
 4 of part III of chapter 39, Hawaii Revised Statutes, as the same
 
 5 may be amended from time to time.  The principal of and interest
 
 6 on such highway revenue bonds, to the extent not paid from the
 
 7 proceeds of such highway revenue bonds, shall be payable from and
 
 8 secured by the revenues derived from highways and related
 
 9 facilities under the ownership of the State or operated and
 
10 managed by the department, from the highway fuel taxes, vehicle
 
11 weight taxes, and vehicle registration fees, levied and paid
 
12 pursuant to sections 243-4, 248-8, 249-31, and 249-33, Hawaii
 
13 Revised Statutes, and federal moneys received by the State or any
 
14 department thereof which are available to pay principal of and/or
 
15 interest on indebtedness of the State, or such part of any
 
16 thereof as the department may determine, and other user taxes,
 
17 fees, or charges currently or hereafter derived from or arising
 
18 through the ownership, operation, and management of highways and
 
19 related facilities and the furnishing and supplying of the
 
20 services thereof.  The expenses related to the issuance of such
 
21 highway revenue bonds, to the extent not paid from the proceeds
 
22 of such bonds, shall be paid from the state highway fund.

 1 The governor, in his discretion, is authorized to use moneys in
 
 2 the state highway fund to finance those highway capital
 
 3 improvement projects authorized in part II and listed in part IV
 
 4 of this Act where the means of financing is designated to be by
 
 5 revenue bond funds.
 
 6      SECTION 136.  SMALL BOAT HARBOR REVENUE BONDS.  The
 
 7 department of land and natural resources is authorized to issue
 
 8 small boat harbor revenue bonds for small boat harbor capital
 
 9 improvement projects authorized in part II and listed in part IV
 
10 of this Act and designated to be financed by revenue bond funds
 
11 or by general obligation bond funds with debt service cost to be
 
12 paid from special funds.  The principal amount of such bonds
 
13 shall be sufficient to yield the amounts appropriated for such
 
14 capital improvements, and, if so determined by the department and
 
15 approved by the governor, such additional amounts as may be
 
16 deemed necessary by the department to pay interest on such
 
17 revenue bonds during the construction period of the capital
 
18 improvement project for which such small boat harbor revenue
 
19 bonds are issued, to establish, maintain, or increase reserves
 
20 for the small boat harbor revenue bonds, and to pay the expenses
 
21 for the issuance of such bonds.  The aforementioned small boat
 
22 harbor revenue bonds shall be issued pursuant to the provisions
 
23 of part III of chapter 39, Hawaii Revised Statutes, as the same

 1 may be amended from time to time. The principal of and interest
 
 2 on the small boat harbor revenue bonds, to the extent not paid
 
 3 from the proceeds of such bonds, shall be payable solely from and
 
 4 secured solely by the revenues from small boat harbors and
 
 5 related facilities under the ownership of the State or operated
 
 6 and managed by the department.  The revenues shall include rents,
 
 7 mooring, wharfage, dockage, and permit fees, and other fees or
 
 8 charges presently or hereafter derived from or arising throughout
 
 9 the ownership and operation of small boating activities and the
 
10 furnishing and supplying of the services thereof.  The expenses
 
11 of the issuance of such small boat harbor revenue bonds shall, to
 
12 the extent not paid from the proceeds of such bonds, be paid from
 
13 the harbor special fund.
 
14      SECTION 137.  PUBLIC FACILITY REVENUE BONDS.  The Hawaii
 
15 community development authority is authorized to issue revenue
 
16 bonds for public facility projects authorized in part II and
 
17 listed in part IV of this Act and designated to be financed by
 
18 revenue bond funds or by general obligation bond funds with the
 
19 debt service cost to be paid from special funds.  The principal
 
20 amount of such bonds shall be sufficient to yield the amounts
 
21 appropriated to construct, acquire, remodel, furnish, and equip
 
22 any public facility, including acquisition of the site thereof.
 
23 Additionally, if so determined by the authority and approved by

 1 the governor, the principal amount of such bonds shall be in an
 
 2 additional amount deemed necessary by the authority to pay
 
 3 interest on such revenue bonds during the estimated period of
 
 4 construction of the capital improvement project for which such
 
 5 public facility revenue bonds are issued, to establish, maintain,
 
 6 or increase reserves for such public facility revenue bonds, and
 
 7 to pay all or any part of the expenses related to the issuance of
 
 8 such public facility revenue bonds.  The aforementioned public
 
 9 facility revenue bonds shall be issued pursuant to the provisions
 
10 of part III of chapter 39, Hawaii Revised Statutes, as the same
 
11 may be amended from time to time.  The principal of and interest
 
12 on such public facility revenue bonds, to the extent not paid
 
13 from the proceeds of such public facility revenue bonds, shall be
 
14 payable from and secured by the revenues derived from the public
 
15 facility for which the revenue bonds are issued, including
 
16 revenue derived from insurance proceeds and reserve accounts and
 
17 earnings therein.
 
18      SECTION 138.  CONVENTION CENTER REVENUE BONDS.  The
 
19 convention center authority is authorized to issue convention
 
20 center revenue bonds for capital improvement projects authorized
 
21 in part II and listed in part IV of this Act and designated to be
 
22 financed by revenue bond funds or by general obligation bond
 
23 funds with the debt service cost to by paid from special funds,

 1 in such principal amount as shall be required to yield the
 
 2 amounts appropriated for such capital improvement projects, and,
 
 3 if so determined by the authority and approved by the governor,
 
 4 such additional principal amount as may be deemed necessary by
 
 5 the authority to pay interest on such convention center revenue
 
 6 bonds during the estimated period of construction of the capital
 
 7 improvement project for which such convention center revenue
 
 8 bonds are issued, to establish, maintain, or increase reserves
 
 9 for such convention center revenue bonds, and to pay all or any
 
10 part of the expenses related to the issuance of such convention
 
11 center revenue bonds.  The aforementioned convention center
 
12 revenue bonds shall be issued pursuant to the provisions of part
 
13 III of chapter 39, Hawaii Revised Statutes, as the same may be
 
14 amended from time to time.  The principal of and interest on such
 
15 convention center revenue bonds, to the extent not paid from the
 
16 proceeds of such convention center revenue bonds, shall be
 
17 payable from and secured by revenues available pursuant to
 
18 section 237D-6.5, Hawaii Revised Statues, by the revenues derived
 
19 from a convention center facility or facilities and related
 
20 facilities under the ownership of the State or operated and
 
21 managed by the authority, and other rates, rents, fees, or
 
22 charges currently or hereafter derived from or arising through
 
23 the ownership, operation, and management of convention center

 1 facilities and related facilities and the furnishing and
 
 2 supplying of the services thereof.
 
 3      SECTION 139.  HAWAIIAN HOME LANDS REVENUE BONDS.  The
 
 4 department of Hawaiian home lands is authorized to issue Hawaiian
 
 5 home lands revenue bonds for Hawaiian home lands capital
 
 6 improvement projects authorized in part II and listed in part IV
 
 7 of this Act and designated to be financed by revenue bond funds
 
 8 or by general obligation bond funds with debt service cost to be
 
 9 paid from special funds, in such principal amount as shall be
 
10 required to yield the amounts appropriated for such capital
 
11 improvements, and, if so determined by the department and
 
12 approved by the governor, such additional amounts as may be
 
13 deemed necessary by the department to increase reserves for the
 
14 Hawaiian home lands revenue bonds and to pay the expenses of the
 
15 issuance of such bonds.  Notwithstanding any limitations
 
16 contained in any prior authorization of Hawaiian home lands
 
17 revenue bonds, the aforementioned Hawaiian home lands revenue
 
18 bonds and all prior authorized revenue bonds shall be issued
 
19 pursuant to the provisions of part III of chapter 39, Hawaii
 
20 Revised Statutes, as the same may be amended from time to time.
 
21 The principal of and interest on Hawaiian home lands revenue
 
22 bonds, to the extent not paid from the proceeds of such bonds,
 
23 shall be payable from and secured by the revenues from Hawaiian

 1 home lands, revenues from available lands and related facilities
 
 2 under the ownership of the State or operated and managed by the
 
 3 department or such parts of either thereof as the department may
 
 4 determine, including rents and other fees or charges presently or
 
 5 hereafter derived from or arising through the ownership,
 
 6 operation, and management of Hawaiian home lands, available lands
 
 7 and related facilities.  The expenses of the issuance of such
 
 8 Hawaiian home lands revenue bonds, to the extent not paid from
 
 9 the proceeds of such bonds, shall be paid from the Hawaiian home
 
10 lands special fund.
 
11      The governor, in the governor's discretion, is authorized to
 
12 use the Hawaiian home lands special fund to finance those
 
13 projects authorized in part II and listed in part IV of this Act
 
14 where the means of financing is designated to be by the Hawaiian
 
15 home lands revenue bond funds.
 
16      SECTION 140.  HOUSING REVENUE BONDS.  The housing and
 
17 community development corporation of Hawaii is authorized to
 
18 issue housing revenue bonds for housing capital improvement
 
19 projects authorized in part II and listed in part IV of this Act
 
20 and designated to be financed by revenue bond funds in such
 
21 principal amounts as shall be required to yield the amounts
 
22 appropriated for such capital improvements, and, if so determined
 
23 by the corporation and approved by the governor, such additional

 1 amounts as may be deemed necessary by the corporation to increase
 
 2 reserves for the housing revenue bonds and to pay the expenses of
 
 3 the issuance of such bonds.  The aforementioned housing revenue
 
 4 bonds shall be issued pursuant to the provisions of part III of
 
 5 chapter 39, Hawaii Revised Statutes, as the same may be amended
 
 6 from time to time.  The principal of and interest on housing
 
 7 revenue bonds, to the extent not paid from the proceeds of such
 
 8 bonds, shall be payable and secured by revenues from housing and
 
 9 related facilities under the ownership of the State or operated
 
10 and managed by the department or such parts of either thereof as
 
11 the department may determine, including rents and other fees or
 
12 charges presently or hereafter derived from or arising through
 
13 the ownership, operation, and management of housing and related
 
14 facilities.
 
15      SECTION 141.  HOSPITAL REVENUE BONDS.  The Hawaii health
 
16 systems corporation is authorized to issue hospital revenue bonds
 
17 for hospital capital improvements program projects authorized in
 
18 part II and listed in part IV of this Act and designated to be
 
19 financed by revenue bond funds, in such principal amount as shall
 
20 be required to yield the amounts appropriated for such capital
 
21 improvements program projects, and, if so determined by the
 
22 corporation and approved by the governor, such additional
 
23 principal amount as may be deemed necessary by the corporation to

 1 pay interest on such hospital revenue bonds during the estimated
 
 2 period of construction of the capital improvements program
 
 3 project for which such hospital revenue bonds are issued, to
 
 4 establish, maintain, or increase reserves for such hospital
 
 5 revenue bonds, and to pay all or any part of the expenses related
 
 6 to the issuance of such hospital revenue bonds.  The
 
 7 aforementioned hospital revenue bonds shall be issued pursuant to
 
 8 the provisions of part III of chapter 39, Hawaii Revised
 
 9 Statutes, as the same may be amended from time to time, except
 
10 that such bonds shall be issued in the name of the corporation
 
11 and not in the name of the State.  The principal of and interest
 
12 on such hospital revenue bonds, to the extent not paid from the
 
13 proceeds of such hospital revenue bonds, shall be payable from
 
14 and secured by the revenues derived from facilities under the
 
15 ownership of the corporation or operated and managed by the
 
16 corporation, or such parts of either thereof as the corporation
 
17 may determine, including other moneys, rates, rents, fees, or
 
18 charges currently or hereafter derived from or arising through
 
19 the ownership, operation, and management of hospitals and related
 
20 facilities and the furnishing and supplying of the services
 
21 thereof.  The expenses related to the issuance of such hospital
 
22 revenue bonds, to the extent not paid from the proceeds of such

 1 bonds, shall be paid from the facility administration fund of the
 
 2 corporation.
 
 3                  PART VII.   SPECIAL PROVISIONS
 
 4      SECTION 142.  Provided that to the extent that the sums
 
 5 appropriated for the payment of principal and interest on general
 
 6 obligation bonds are insufficient to meet and pay all such
 
 7 obligations when due in accordance with the terms of such bonds,
 
 8 the governor shall direct the utilization of any or all
 
 9 appropriations available or unexpended from any other State
 
10 program, as the first charge for the payment of principal and
 
11 interest of the bonds when due; and provided further that the
 
12 legislature, under procedures established in section 10 of
 
13 article III of the Hawaii State Constitution, shall meet in
 
14 special session to comply with the provisions of section 12 of
 
15 article VII of the Hawaii State Constitution, which pledge the
 
16 full faith and credit of the State for the payment of principal
 
17 and interest on all general obligation and reimbursable general
 
18 obligation bonds; provided that the governor shall report to the
 
19 legislature no later than thirty days prior to the convening of
 
20 the regular sessions of 2000 and 2001 on the use of this section.
 
21      SECTION 143.  All general obligation bond funds used for a
 
22 public undertaking, improvement, or system, designated by the
 
23 letter (D), shall have the bond principal and interest reimbursed

 1 from the special fund in which the net revenue, or net user tax
 
 2 receipts, or combination of both, of such public undertaking,
 
 3 improvement, or system, are deposited or credited.  Bonds issued
 
 4 for irrigation and housing projects shall be reimbursed, as
 
 5 provided by section 174-21 and chapter 201E, Hawaii Revised
 
 6 Statutes, respectively.
 
 7      The governor is authorized to use, at the governor's
 
 8 discretion, the state highway fund, the harbor special fund, the
 
 9 boating special fund, the airport revenue fund, the special land
 
10 and development fund, the economic development special fund, or
 
11 other appropriate special fund, to finance the respective public
 
12 undertaking, improvement, or system described above and
 
13 authorized in this Act, where the means of financing is
 
14 designated to be by general obligation bond fund with debt
 
15 service cost to be paid from the funds; provided that the
 
16 governor shall submit a report to the legislature on such changes
 
17 in the means of financing of such projects.
 
18      SECTION 144.  Any law or any provision of this Act to the
 
19 contrary notwithstanding, the appropriations made for capital
 
20 improvement projects authorized under this Act shall not lapse at
 
21 the end of the fiscal biennium for which the appropriation is
 
22 made; provided that all general funded, general obligation, and
 
23 reimbursable general obligation bond funded appropriations made

 1 to be expended in fiscal biennium 1999-2001 which are
 
 2 unencumbered as of June 30, 2002, shall lapse as of that date;
 
 3 provided further that this lapsing date shall also apply to prior
 
 4 appropriations for projects that qualify for federal aid
 
 5 financing and/or reimbursement.
 
 6      SECTION 145.  The governor may supplement funds for any cost
 
 7 element for a capital improvement project authorized under this
 
 8 Act by transferring such sums as may be needed from the funds
 
 9 appropriated for other cost elements of the same project, by this
 
10 Act or by any other prior or future Act which has not lapsed; and
 
11 provided further that the total expenditure of funds for all cost
 
12 elements shall not exceed the total appropriations for that
 
13 project.
 
14      SECTION 146.  In the event that authorized appropriations
 
15 specified for capital improvement projects listed in this Act or
 
16 in any other act currently authorized by the legislature are
 
17 insufficient, and where the source of funding for the project is
 
18 designated as special funds, general obligation bond fund with
 
19 debt service cost to be paid from special funds, revenue bond
 
20 funds, or revolving funds, the governor may make supplemental
 
21 allotments from the special fund responsible for cash or debt
 
22 service payments for the projects or transfer unrequired balances
 
23 from other unlapsed projects in this or prior appropriation acts

 1 which authorized the use of special funds, general obligation
 
 2 bond fund with debt service costs to be paid from special funds,
 
 3 revenue bond funds, or revolving funds; provided that such
 
 4 supplemental allotments shall not be used to increase the scope
 
 5 of the project; provided further that such supplemental
 
 6 allotments shall not impair the ability of the fund to meet the
 
 7 purposes for which it was established; and provided further that
 
 8 the governor shall submit a report to the legislature no later
 
 9 than thirty days prior to the convening of the 2000 and 2001
 
10 regular sessions.
 
11      SECTION 147.  Where it has been determined that changed
 
12 conditions, such as a reduction in the particular population
 
13 being served, permit the reduction in the scope of a capital
 
14 improvement project described in this Act, the governor may
 
15 authorize such reduction of project scope; and provided that the
 
16 governor shall submit a report to the legislature no later than
 
17 thirty days prior to the convening of the 2000 and 2001 regular
 
18 sessions.
 
19      SECTION 148.  In releasing funds for capital improvement
 
20 projects, the governor shall consider the legislative intent and
 
21 the objectives of the user agency and its programs, the scope and
 
22 level of the user agency's intended service, and the means,
 
23 efficiency, and economics by which the project will meet the

 1 objectives of the user agency and the State.  Agencies
 
 2 responsible for construction shall take into consideration the
 
 3 objectives of the user agency, its programs, the scope and level
 
 4 of the user agency's intended service and construct the
 
 5 improvement to meet the objectives of the user agency in the most
 
 6 efficient and economical manner possible.
 
 7      SECTION 149.  With the approval of the governor, designated
 
 8 expending agencies for capital improvement projects authorized in
 
 9 this Act may delegate to other state or county agencies the
 
10 implementation of such projects when it is determined by all
 
11 involved agencies and parties that it is advantageous to do so;
 
12 and provided that a summary report shall be submitted to the
 
13 legislature detailing all designated projects as of December 31
 
14 and June 30 for each fiscal year.
 
15      SECTION 150.  Where county capital improvement projects are
 
16 partially or totally funded by state grants-in-aid as authorized
 
17 in this Act or any other act of the legislature, this fact should
 
18 be appropriately acknowledged during construction and upon
 
19 completion of these projects.
 
20      SECTION 151.  The governor may authorize the expenditure of
 
21 funds for capital improvement projects not previously authorized
 
22 in this Act to cope with the effects of recession, unemployment,
 
23 natural disasters, unforeseen emergencies, and for any federal

 1 aid portion of any capital improvement project described in this
 
 2 Act where application for such aid has been made and approval has
 
 3 been unexpectedly denied; provided that the effects of recession,
 
 4 unemployment, natural disaster, emergencies, or unexpected denial
 
 5 of federal aid create an urgent need to pursue a course of action
 
 6 which is in the best interest of the State; and provided further
 
 7 that the governor shall use the project adjustment fund
 
 8 authorized in part II and described in part IV to accomplish the
 
 9 purposes of this section.
 
10      SECTION 152.  No appropriation authorized in this Act for
 
11 expenditure by a political subdivision of this State shall be
 
12 considered to be a mandate to undertake new programs or to
 
13 increase the level of services under existing programs of that
 
14 political subdivision.  If any appropriation authorized in this
 
15 Act constitutes such a mandate within the provisions of section 5
 
16 of article VIII of the Hawaii State Constitution, such
 
17 authorization shall be void and, in the case of capital
 
18 improvement appropriations designated to be financed from the
 
19 general obligation bond fund, the total general obligation bonds
 
20 authorized for such projects shall be correspondingly decreased.
 
21      SECTION 153.  Whenever the expending agency to which an
 
22 appropriation is made is changed due to legislation enacted
 
23 during any session of the legislature which affects the

 1 appropriations made by this Act, the governor shall transfer the
 
 2 necessary funds and positions to the proper expending agency; and
 
 3 provided that the governor shall submit a report of all such
 
 4 transfers to the legislature no later than thirty days prior to
 
 5 the convening of the 2000 and 2001 regular sessions.
 
 6      SECTION 154.  There is hereby appropriated out of the public
 
 7 trust fund created by section 5(f) of the Admissions Act (Public
 
 8 Law No. 86-3) the total amount of the proceeds from the sale or
 
 9 other disposition of any lands, and the income therefrom granted
 
10 to the State by section 5(b) or later conveyed to the State by
 
11 section 5(e), with the exception of such proceeds covered under
 
12 section 171-19, Hawaii Revised Statutes, to be disposed of by the
 
13 board of land and natural resources, and with the exception of
 
14 such proceeds to be expended by the office of Hawaiian affairs
 
15 under chapter 10, Hawaii Revised Statutes, in order to reimburse
 
16 the general fund for the appropriation made in part II of this
 
17 Act to the department of education for the support of public
 
18 schools, to the extent such proceeds are realized for the period
 
19 beginning July 1, 1999 to June 30, 2001.  The above proceeds
 
20 shall be exclusive of the amount disposed of under the provisions
 
21 of the Hawaiian Homes Commission Act of 1920, as amended.
 
22      SECTION 155.  All grants to private organizations in this
 
23 Act are made in accordance with the standard that the private

 1 programs so funded yield direct benefits to the public and
 
 2 accomplish public purposes.
 
 3      SECTION 156.  Any law or provision to the contrary
 
 4 notwithstanding, in allotting funds for social welfare programs,
 
 5 education programs, and other programs and agencies having
 
 6 appropriations which are based on population and workload data as
 
 7 specified in the executive budget document, only so much as is
 
 8 necessary to provide the level of services intended by the
 
 9 legislature shall be allotted by the department of budget and
 
10 finance.  For this purpose, agencies concerned shall reduce
 
11 expenditures below appropriations under procedures prescribed by
 
12 the department of budget and finance in the event that actual
 
13 population and workload trends are less than the figures so
 
14 specified.
 
15      SECTION 157.  With the approval of the director of finance,
 
16 the department of health may transfer to the department of human
 
17 services funds appropriated to the department of health for the
 
18 care and treatment of patients whenever the department of human
 
19 services can utilize such funds to match federal funds which may
 
20 be available to help finance the cost of outpatient, hospital, or
 
21 skilled nursing home care of indigents or medical indigents.
 
22      SECTION 158.  The department of human services is authorized
 
23 to enter into agreements with the department of health to furnish

 1 outpatient, hospital, and skilled nursing home care of indigents
 
 2 or medical indigents and to pay the department of health for such
 
 3 care.  With the approval of the director of finance, the
 
 4 department of health may deposit part of such receipts into the
 
 5 appropriations from which the transfers were made.
 
 6      SECTION 159.  In the event that unanticipated federal
 
 7 funding cutbacks diminish or curtail essential, federally-funded
 
 8 state programs, the governor may utilize savings as determined to
 
 9 be available from other state programs for the purpose of
 
10 maintaining such programs until the next legislative session.
 
11      SECTION 160.  The governor is hereby authorized to establish
 
12 five permanent positions during each year of the fiscal biennium
 
13 1999-2001 to be allocated by the governor to any of the program
 
14 areas included in this Act as deemed proper; provided further
 
15 that no positions shall be established under this section to
 
16 implement any collective bargaining agreement signed after the
 
17 legislature adjourns sine die; and provided further that the
 
18 governor shall submit a report to the legislature on the creation
 
19 of all such positions no later than thirty days prior to the
 
20 convening of the 2000 and 2001 regular sessions.
 
21      SECTION 161.  In the event the State should assume the
 
22 direct operation of any non-governmental agency receiving state
 
23 funds under the provisions of this Act, all such funds shall

 1 constitute a credit to the State against the costs of acquiring
 
 2 all or any portion of the property, real, personal, or mixed, of
 
 3 such non-governmental agency.  This credit shall be applicable
 
 4 regardless of when such acquisition takes place.
 
 5      SECTION 162.  Where any agency is authorized by general law
 
 6 to secure funds or other property from private organizations or
 
 7 individuals to be expended or utilized in connection with any
 
 8 authorized program, the agency, with the governor's approval, may
 
 9 enter into such undertaking, provided that the provisions of the
 
10 undertaking comply with applicable State constitutional and
 
11 statutory requirements.
 
12      SECTION 163.  Except as otherwise provided by general law,
 
13 negotiations for the purchase of land by state agencies shall be
 
14 subject to the approval of the governor and the department of
 
15 land and natural resources, or other appropriate agency; and
 
16 provided further that private lands may be acquired for the
 
17 purpose of exchange for federal lands when the department of land
 
18 and natural resources and the governor determine that such
 
19 acquisition and exchange are necessary for the completion of any
 
20 project specifically authorized by this Act.
 
21      SECTION 164.  Provided that statewide savings my be
 
22 transferred to the forest wildlife resource program (LNR 402),
 
23 for fire suppression purposes; provided further that funding

 1 shall not exceed $300,000 in each fiscal year of fiscal biennium
 
 2 1999-2001; and provided further that the department of land and
 
 3 natural resources shall submit a report detailing such transfers
 
 4 to the legislature no later than thirty days prior to the
 
 5 convening of the 2000 and 2001 regular sessions.
 
 6      SECTION 165.  The governor is authorized to transfer savings
 
 7 as may be available from the appropriated funds of any programs
 
 8 in this Act to supplement the appropriation for any other program
 
 9 in this Act to cope with the effects of recession, unemployment,
 
10 natural disasters, and other unforeseen emergencies; provided
 
11 that the effects of recession, unemployment, natural disaster, or
 
12 such emergencies create an urgent need to pursue a course of
 
13 action which is in the best interest of the State; and provided
 
14 further that the legislature shall be notified in writing of such
 
15 transfer of funding no later than fourteen days after the
 
16 transfer is made.
 
17      SECTION 166.  Except as otherwise provided, or except as
 
18 prohibited by specific grant conditions, all federal or non-
 
19 general fund reimbursements received by state programs shall be
 
20 returned to the general fund, or other appropriate program fund;
 
21 and provided further that the department of budget and finance
 
22 shall submit a report to the legislature no later than thirty

 1 days prior to the convening of the 2000 and 2001 regular
 
 2 sessions.
 
 3      SECTION 167.  Provided that, of the respective appropriation
 
 4 for each principal state department as defined by section 26-4,
 
 5 Hawaii Revised Statutes, the sum of $2,500 for fiscal year 1999-
 
 6 2000 and the sum of $2,500 for fiscal year 2000-2001 shall be
 
 7 made available in each department to be established as a separate
 
 8 account for a protocol fund to be expended at the discretion of
 
 9 the executive heads of such departments which are respectively
 
10 known as its directors, chairpersons, comptroller, adjutant-
 
11 general, superintendent, librarian, president, and attorney
 
12 general.
 
13      SECTION 168.  With the approval of the governor, agencies
 
14 that use appropriations authorized in part II of this Act for
 
15 audit services, may delegate that responsibility and transfer
 
16 funds authorized for that purpose to the internal post audit
 
17 program (AGS 104), when it is determined by such agencies that it
 
18 is advantageous to do so.
 
19      SECTION 169.  With the approval of the governor, expending
 
20 agencies that use appropriations authorized in part II of this
 
21 Act for repair and alterations may delegate responsibility and
 
22 transfer funds to the construction program (AGS 221), for the

 1 implementation of such repair and alterations, when it is
 
 2 determined by such agencies that it is advantageous to do so.
 
 3       PART VIII.  MISCELLANEOUS AND EFFECTIVE DATE
 
 4     SECTION 170.  MISCELLANEOUS.   If any portion of this
 
 5 Act or its application to any person, entity, or
 
 6 circumstance is held to be invalid for any reason, then
 
 7 the legislature declares that the remainder of the Act and
 
 8 each and every other provision thereof shall not be
 
 9 affected thereby.  If any portion of a specific
 
10 appropriation is held to be invalid for any reason, the
 
11 remaining portion shall be expended to fulfill the
 
12 objective of such appropriation to the extent possible.
 
13     SECTION 171.  In the event manifest clerical,
 
14 typographical, or other mechanical errors found in this
 
15 Act, the governor is hereby authorized to correct such
 
16 errors.
 
17     SECTION 172.  Material to be repealed is bracketed.
 
18 New material in prior enacted laws is underscored.
 
19     SECTION 173.  EFFECTIVE DATE.  This Act shall take
 
20 effect on July 1, 1999.
