                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL PERFORMANCE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the only states which
 
 2 have experienced significant increases in student achievement are
 
 3 those that implement comprehensive accountability systems that
 
 4 hold all parties accountable for performance in appropriate ways.
 
 5 Contrary to the critics, Hawaii's public schools are not the
 
 6 worst in the nation.  However, they are not the best either and
 
 7 the legislature takes no comfort in the fact that Hawaii's
 
 8 schools are average.  Hawaii's education system needs to improve
 
 9 over its past performance.  Over the next several years, public
 
10 schools need to develop ways to measure and improve student,
 
11 teacher, and system performance.
 
12      The purpose of this Act is to require the establishment of a
 
13 comprehensive accountability system that will identify the roles
 
14 and responsibilities of all partners to the education process,
 
15 identify means of assessing performance, and invoke appropriate
 
16 action based upon that performance.  This comprehensive
 
17 accountability system includes programs which provide for student
 
18 and school assessments.
 
19      SECTION 2.  Section 302A-1004, Hawaii Revised Statutes, is

 1 amended to read as follows:
 
 2      "[[]�302A-1004[]]  Educational assessment and
 
 3 accountability; annual reports.  (a)  The department shall
 
 4 establish a comprehensive system of educational accountability to
 
 5 motivate and support the improved performance of students and the
 
 6 education system.  This accountability system shall:
 
 7      (1)  Link authority and adequate resources to
 
 8           responsibility;
 
 9      (2)  Define clear roles for all parties and lines of
 
10           responsibility and mutual obligation;
 
11      (3)  Involve fair and adequate assessment against agreed
 
12           upon goals;
 
13      (4)  Invoke appropriate actions (assistance, rewards, or
 
14           sanctions) for observed performance;
 
15      (5)  Involve a student assessment program that is explicitly
 
16           aligned with the Hawaii content and performance
 
17           standards and embodies high and rigorous expectations
 
18           for the attainment of all students; and
 
19      (6)  Involve a comprehensive school profile or report card
 
20           for each school, which shall include, but not be
 
21           limited to, student performance measures, school
 
22           attendance, drop-out rates, and parental involvement.
 
23           These reports shall be made available annually to the

 1           board, the governor, the legislature, the parents, and
 
 2           the general public.
 
 3      Beginning with the 2001-2002 school year, the department
 
 4 shall submit to the legislature, the governor, and the board of
 
 5 education at least twenty days prior to the convening of each
 
 6 regular legislative session a report of the specifics of the
 
 7 design of the comprehensive accountability system, as well as the
 
 8 fiscal requirements and legislative actions necessary to create
 
 9 the accountability system.
 
10      [(a)] (b)  The department shall submit to the legislature
 
11 and to the governor, at least twenty days prior to the convening
 
12 of each regular legislative session, an educational status report
 
13 that includes but is not limited to the following:
 
14      (1)  Results of school-by-school assessments of educational
 
15           outcomes, including reference to such student
 
16           performance standards and school-by-school assessment
 
17           models as may be developed by the commission on
 
18           performance standards and adopted by the board[;].
 
19           This paragraph is repealed on June 30, 2001;
 
20      (2)  Summaries of school improvement plans;
 
21      (3)  Summary descriptions of the demographic makeup of the
 
22           schools, with indications of the range of these
 
23           conditions among schools within Hawaii;

 1      (4)  Comparisons of conditions affecting Hawaii's schools
 
 2           with the conditions of schools in other states; and
 
 3      (5)  Other such assessments as may be deemed appropriate by
 
 4           the board.
 
 5      [(b)] (c)  The department shall provide electronic access to
 
 6 computer-based financial management, student information, and
 
 7 other information systems to the legislature and the auditor.
 
 8 The auditor shall submit to the legislature and the governor, at
 
 9 least twenty days prior to the convening of each legislative
 
10 session, a fiscal accountability report that includes but is not
 
11 limited to the following:
 
12      (1)  The financial analysis of expenditures by the
 
13           department with respect to the following areas:
 
14           (A)  Administration;
 
15           (B)  Facilities and operations;
 
16           (C)  Teacher support and development;
 
17           (D)  Pupil support;
 
18           (E)  Instructional support; and
 
19           (F)  Classroom instruction; and
 
20      (2)  The measures of accuracy, efficiency, and productivity
 
21           of the department, districts, and schools in delivering
 
22           resources to the classroom and the student."
 
23      SECTION 3.  The department of education shall submit a

 1 report on the findings and recommendations of the design of the
 
 2 comprehensive accountability system referred to in section 2 of
 
 3 this Act, to the legislature, and to the governor, at least
 
 4 twenty days prior to the convening of the regular legislative
 
 5 session of 2000.  This report shall include, but not be limited
 
 6 to, the essential elements of the design, a timeline for its
 
 7 implementation, the legislative actions necessary to enable
 
 8 implementation, as well as a fiscal note describing resources
 
 9 necessary to execute the designs.  The department of education
 
10 shall submit a report on the status of the implementation of the
 
11 comprehensive accountability system to the legislature, and to
 
12 the governor, at least twenty days prior to the convening of the
 
13 regular legislative session of 2001.
 
14      SECTION 4.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 5.  This Act shall take effect upon its approval.
