                   A  BILL  FOR  AN  ACT

RELATING TO THE REVIEW OF THE SALARIES OF THE TRUSTEES OF THE
   OFFICE OF HAWAIIAN AFFAIRS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Act 358, Session Laws of Hawaii 1993,
 
 2 established a process for the periodic review of the salaries of
 
 3 the trustees of the office of Hawaiian affairs.  Beginning in
 
 4 1996, and in four-year increments thereafter, the governor was
 
 5 directed to appoint members to a salary review commission on or
 
 6 before November 30.  By the fortieth legislative day of the next
 
 7 regular legislative session, the salary review commission was
 
 8 directed to submit its recommendations for any salary adjustments
 
 9 to the legislature.  Through inadvertence, the initial salary
 
10 review commission was not appointed and the four-year review
 
11 cycle was not initiated.
 
12      The purpose of this Act is to re-establish the salary review
 
13 process for the trustees for the office of Hawaiian affairs.
 
14      SECTION 2.  Section 10-9.5, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "[[]�10-9.5[]]  Salary commission; established.(a)  There
 
17 is established a salary commission for the members of the board
 
18 of trustees for the office of Hawaiian affairs.  The salary
 
19 commission shall consist of seven members appointed by the

 1 governor on or before [November 30, 1996,] August 31, 1999, and
 
 2 every four years thereafter.  The members of the salary
 
 3 commission shall be selected from nominations submitted by native
 
 4 Hawaiian organizations as defined in section 673-2(c).  The
 
 5 members shall serve without compensation, but shall be entitled
 
 6 to reimbursement for necessary expenses while in the discharge of
 
 7 their duties and responsibilities.
 
 8      (b)  Before the [fortieth] twentieth legislative day of the
 
 9 [1997] regular session of 2000 and every four years thereafter,
 
10 the salary commission shall study and make recommendations for
 
11 the salary of the members of the board of trustees for the office
 
12 of Hawaiian affairs, and then shall be dissolved.  The
 
13 recommended salary shall be effective as of the date of the
 
14 recommendations unless the legislature disapproves the
 
15 recommendation by adoption of a concurrent resolution prior to
 
16 adjournment sine die of the legislative session in which the
 
17 recommendation is submitted."
 
18      SECTION 3.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
 
20      SECTION 4.  This Act shall take effect upon its approval.
