DESCRIPTION:
Deletes the unfeasible rigid time provision which mandates that
no less than 50% of each school day be devoted to oral
expression, written composition, and the spelling of the English
language.  Ensures that school must continue to teach these
basics and prepare students in accordance with statewide

                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-1128, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  The department shall regulate the courses of study to
 
 4 be pursued in all grades of public schools and classify them by
 
 5 methods the department deems proper; provided that:
 
 6      (1)  The course of study and instruction [in the first eight
 
 7           grades] shall be [so] regulated [that not less than
 
 8           fifty per cent of the study and instruction in each
 
 9           school day is devoted to the oral expression, the
 
10           written composition, and the spelling of the English
 
11           language, except for special projects using the
 
12           Hawaiian language as approved by the board;] in
 
13           accordance with the statewide performance standards
 
14           established under section 302A-201;
 
15      (2)  All pupils shall be progressively competent in the use
 
16           of computer technology; and
 
17      (3)  The course of study and instruction for the first
 
18           twelve grades shall enable all students to meet

 1           progressive standards of competency in a language in
 
 2           addition to English.
 
 3      For the purposes of this subsection, the terms
 
 4 "progressively competent in the use of computer technology" and
 
 5 "progressive standards of competency in a language in addition to
 
 6 English" shall be defined by the board through rules adopted
 
 7 pursuant to chapter 91, with reference to relevant national or
 
 8 international standards of competency.  Notwithstanding
 
 9 paragraphs (2) and (3) to the contrary, the board, through rules
 
10 adopted pursuant to chapter 91, shall formulate statewide
 
11 educational policies allowing the superintendent to exempt
 
12 certain students from the requirements of paragraphs (2) and
 
13 (3)."
 
14      SECTION 2.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 3.  This Act shall take effect upon its approval.
