                   A  BILL  FOR  AN  ACT
RELATING TO STATUTORY REVISION:  AMENDING, REENACTING, OR
   REPEALING VARIOUS PROVISIONS OF THE HAWAII REVISED STATUTES
   AND THE SESSION LAWS OF HAWAII FOR THE PURPOSE OF CORRECTING
   ERRORS AND REFERENCES, CLARIFYING LANGUAGE, AND DELETING
   OBSOLETE OR UNNECESSARY PROVISIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 53-7, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�53-7 Urban renewal projects in disaster areas.
 
 4 Notwithstanding any other provisions of this chapter, where the
 
 5 council of a county certifies that an area within the county is
 
 6 in need of renewal, redevelopment, or rehabilitation as a result
 
 7 of a seismic wave, flood, fire, hurricane, earthquake, storm,
 
 8 volcanic activity, explosion, or other catastrophe, natural or of
 
 9 human origin (herein called "disaster area") respecting which the
 
10 governor of the State has certified the need for disaster
 
11 assistance under Public Law 875, Eighty-first Congress (64 Stat.
 
12 1109), or other federal law, the council of a county may approve
 
13 an urban renewal plan and an urban renewal project with respect
 
14 to the area without regard to:
 
15      (1)  The provisions of this chapter as follows:  [paragraphs
 
16           (10) and (16) of] the definitions of "redevelopment
 
17           area" and "urban area" in section 53-1; the proviso of
 
18           the first sentence of paragraph (4) of section 53-5;

 1           the requirements for housing of displaced families,
 
 2           approval of the plan by planning commission, public
 
 3           hearings and findings required by the county council
 
 4           prior to the approval of the plan as contained in
 
 5           section 53-6, provided that the limitation of time in
 
 6           which to contest validity of the proceedings or of the
 
 7           renewal plan provided in section 53-6 in the case of an
 
 8           urban renewal project for disaster areas shall be
 
 9           twenty days instead of thirty days; the exceptions set
 
10           forth in the second sentence of section 53-20; the
 
11           proviso of the second sentence of section 53-21; and
 
12      (2)  Any of the provisions of this chapter requiring public
 
13           hearings or requiring that the urban renewal plan
 
14           conform to the master plan for the development of the
 
15           county or locality as a whole, or that the urban
 
16           renewal area be a slum area, or a blighted,
 
17           deteriorated, or deteriorating area, or that the urban
 
18           renewal area be predominantly residential in character
 
19           or be developed or redeveloped for residential use.
 
20      In the preparation, planning, financing, acquisition, and
 
21 disposal of real property, and the execution generally of an
 
22 urban renewal project for disaster areas, a redevelopment agency
 
23 shall have all of the rights, powers, privileges, and immunities

 1 conferred upon the agency by this chapter including any amendment
 
 2 thereof or addition thereto, or by any other law, in the same
 
 3 manner as though all provisions of law relating to urban renewal
 
 4 projects were applicable to the redevelopment and renewal of the
 
 5 disaster areas as in this section provided, subject to the
 
 6 exceptions hereinabove set forth."
 
 7      SECTION 2.  Section 53-53, Hawaii Revised Statutes, is
 
 8 amended to read as follows:
 
 9      "�53-53  Powers with respect to urban renewal.  A
 
10 redevelopment agency shall have all the powers necessary or
 
11 convenient to undertake and carry out all urban renewal plans and
 
12 urban renewal projects, including the authority to acquire and
 
13 dispose of property, to issue bonds and other obligations, to
 
14 borrow and accept grants from the federal government or any other
 
15 source, and to exercise the other powers which this chapter
 
16 confers on an agency with respect to redevelopment projects.  For
 
17 the purposes of this part in connection with the planning and
 
18 undertaking of any urban renewal plan or urban renewal project,
 
19 the agency, the county, and all public and private officers,
 
20 agencies, and bodies shall have all the rights, powers,
 
21 privileges, and immunities which they have with respect to a
 
22 redevelopment plan or redevelopment project, in the same manner
 
23 as though all of the provisions of part I of this chapter

 1 applicable to a redevelopment plan or redevelopment project were
 
 2 therein expressly made applicable to an urban renewal plan or
 
 3 urban renewal project; and for such purposes as used in part I
 
 4 and in this part elsewhere than in this section, except where the
 
 5 context clearly indicates such meaning to be inappropriate or as
 
 6 otherwise expressly provided in this section:
 
 7      (1)  The word "redevelopment" (elsewhere than in
 
 8           [[paragraph] (13) of] section 53-1) means "urban
 
 9           renewal";
 
10      (2)  The word "slum" and the word "blighted" (elsewhere than
 
11           in [[paragraph] (3) of] section 53-1) mean "blighted,
 
12           deteriorated, or deteriorating";
 
13 provided (A) that nothing in this part shall be deemed to change
 
14 the meaning of the terms "local redevelopment agency" or
 
15 "agency," or the corporate name of any local redevelopment
 
16 agency; and (B) that the finding by the council that the project
 
17 area is a blighted area prescribed by section 53-6 shall not be
 
18 required.
 
19      In addition to the surveys and plans which an agency
 
20 otherwise may make, an agency may make (1) plans for carrying out
 
21 a program of voluntary repair and rehabilitation of buildings and
 
22 improvements, and (2) plans for the enforcement of laws, codes,
 
23 and regulations relating to the use of land and the use and

 1 occupancy of buildings and improvements, and to the compulsory
 
 2 repair, rehabilitation, demolition, or removal of buildings and
 
 3 improvements.  The agency may develop, test, and report methods
 
 4 and techniques, and carry out demonstrations and other
 
 5 activities, for the prevention and the elimination of slums and
 
 6 other urban blight."
 
 7      SECTION 3.  Section 76-28, Hawaii Revised Statutes, is
 
 8 amended by amending the title to read as follows:
 
 9      "�76-28  [Notices] Forms required of appointing
 
10 authorities."  
 
11      SECTION 4.  Section 291-11.5, Hawaii Revised Statutes, is
 
12 amended by amending subsection (e) to read as follows:           
 
13      "(e)  Violation of this section shall be considered an
 
14 offense as defined under section 701-107(5) and shall subject the
 
15 violator to the following penalties:
 
16      (1)  For a first conviction, the person shall:
 
17           (A)  Be fined not more than $100; 
 
18           (B)  Be required by the court to attend a child
 
19                passenger restraint system safety class conducted
 
20                by the division of driver education; provided
 
21                that:
 
22                (i)  The class may include video conferences as
 
23                     determined by the administrator of the

 1                     division of driver education as an
 
 2                     alternative method of education; and
 
 3               (ii)  The class shall not exceed four hours; and
 
 4           (C)  Pay a $50 driver education assessment as provided
 
 5                in section 286G-3;
 
 6      (2)  For a conviction of a second offense, the person shall:
 
 7           (A)  Be fined not more than $200;
 
 8           (B)  Be required by the court to attend a child
 
 9                passenger restraint system safety class not to
 
10                exceed four hours in length conducted by the
 
11                division of driver education if the person has not
 
12                previously attended such a class; and
 
13           (C)  Pay a $50 driver education assessment as provided
 
14                in section 286G-3 if the person has not previously
 
15                attended a child passenger [[]restraint[]] system
 
16                safety class conducted by the division of driver
 
17                education; and
 
18      (3)  For a conviction of a third or subsequent offense, the
 
19           person shall:
 
20           (A)  Be fined not more than $500;
 
21           (B)  Be required by the court to attend a child
 
22                passenger restraint system safety class not to
 
23                exceed four hours in length conducted by the

 1                division of driver education if the person has not
 
 2                previously attended such a class; and
 
 3           (C)  Pay a $50 driver education assessment as provided
 
 4                in section 286G-3 if the person has not previously
 
 5                attended a child passenger [[]restraint[]] system
 
 6                safety class conducted by the division of driver
 
 7                education."    
 
 8      SECTION 5.  Section 291C-133, Hawaii Revised Statutes, is
 
 9 amended by amending the title to read as follows:                
 
10      "[[]�291C-133  Waste material falling from motor
 
11 vehicles.[]]"
 
12      SECTION 6.  Section 323D-82, Hawaii Revised Statutes, is
 
13 amended to read as follows:
 
14      "[[]�323D-82[]]  Maintenance of services.  A person who has
 
15 acquired or is engaged in the acquisition of a hospital shall not
 
16 substantially reduce [[]or[]] eliminate direct patient care
 
17 services at the hospital below the levels at which those services
 
18 were available at the time of the acquisition, without first
 
19 giving written notice of the planned reduction or elimination to
 
20 the agency and receiving the agency's approval, prior to
 
21 implementing the reduction or elimination of services."
 
22      SECTION 7.  Section 342P-28, Hawaii Revised Statutes, is
 
23 amended to read as follows:

 1      "�342P-28  Fees.  The director may establish reasonable fees
 
 2 for the issuance of notifications, certificates, licenses,
 
 3 permits, and variances to cover the cost of issuance thereof, and
 
 4 for the implementation and enforcement of the terms and
 
 5 conditions of permits and variances not including court costs or
 
 6 other costs associated with any formal enforcement action.  The
 
 7 fees shall be deposited to the credit of the asbestos and lead
 
 8 abatement special fund [[]or[]] noise, radiation, and indoor air
 
 9 quality special fund." 
 
10      SECTION 8.  Section 351-62.6, Hawaii Revised Statutes, is
 
11 amended by amending subsection (a) to read as follows:           
 
12      "(a)  The court shall impose a compensation fee upon every
 
13 convicted defendant who is or will be able to pay the
 
14 compensation fee.  The amount of the compensation fee shall be
 
15 commensurate with the seriousness of the offense as follows:
 
16      (1)  Not less than $100 nor more than $500 for conviction of
 
17           a felony;
 
18      (2)  $50 for conviction of a misdemeanor; and
 
19      (3)  $25 for conviction of a petty misdemeanor.
 
20 The compensation fee shall be separate from any fine that may be
 
21 imposed under section 706-640 and shall be in addition to any
 
22 other disposition under this chapter; provided that the court
 
23 shall waive the imposition of a compensation fee if the defendant

 1 is unable to pay the compensation fee.  Moneys from the
 
 2 compensation fees shall be deposited into the [[]crime victim
 
 3 compensation special fund[]] under section 351-62.5."
 
 4      SECTION 9.  Section 351-64.5, Hawaii Revised Statutes, is
 
 5 amended by amending subsection (b) to read as follows:
 
 6      "(b)  The person liable shall, in the discretion of the
 
 7 commission, either repay any amount to the crime victim
 
 8 compensation [[]special fund[]] or have such amount deducted from
 
 9 any future compensation payable to the person under this
 
10 chapter."
 
11      SECTION 10.  Section 351-70, Hawaii Revised Statutes, is
 
12 amended to read as follows:
 
13      "�351-70  Annual report.  The commission shall transmit
 
14 annually to the governor and to the director of public safety, at
 
15 least thirty days prior to the convening of the legislature a
 
16 report of its activities under this chapter including a brief
 
17 description of the facts in each case, and the amount, if any, of
 
18 compensation awarded, and the names of attorneys and health care
 
19 providers where they are the applicants.  The director of public
 
20 safety shall, within five days after the opening of the
 
21 legislative session, transmit the report, together with a
 
22 tabulation of the total amount of compensation awarded during the
 
23 prior fiscal year and an estimate of the amount that is

 1 reasonably estimated to be required for the next fiscal year, and
 
 2 a legislative bill to appropriate funds for the crime victim
 
 3 compensation [[]special fund[]] for the next fiscal year.  The
 
 4 commission shall provide upon request of the governor, the
 
 5 director of public safety, or the legislature, the relevant data,
 
 6 including the names of all applicants for compensation, under
 
 7 this chapter." 
 
 8      SECTION 11.  Section 351-84, Hawaii Revised Statutes, is
 
 9 amended by amending subsection (b) to read as follows:
 
10      "(b)  Moneys deposited into the special account shall be
 
11 used first as provided in section 351-83, if necessary, and then
 
12 to reimburse the crime victim compensation [[]special fund[]] for
 
13 payments made pursuant to this chapter for the crime committed by
 
14 the convicted person."
 
15      SECTION 12.  Section 354D-12, Hawaii Revised Statutes, is
 
16 amended by amending subsection (b) to read as follows:
 
17      "(b)  Proceeds and wages owed to a qualified, able-bodied
 
18 inmate from the sale of goods or services that were produced by
 
19 the qualified, able-bodied inmate under a program authorized by
 
20 this chapter shall be held in an account maintained by the
 
21 department and paid:
 
22      (1)  To the crime victim compensation [[]special fund[]] on
 
23           a quarterly basis in amounts representing not less than

 1           five per cent nor more than twenty per cent of the
 
 2           earnings of all inmates in the State incarcerated for a
 
 3           violent crime listed in section 351-32; provided that
 
 4           these payments shall be mandatory and shall in no way
 
 5           relate to any claim filed under chapter 351; and
 
 6           provided further that the director shall submit timely
 
 7           annual reports to the legislature and the crime victim
 
 8           compensation commission on the amounts paid pursuant to
 
 9           this paragraph during the previous fiscal year;
 
10      (2)  To support the qualified, able-bodied inmate's
 
11           dependents in amounts deemed appropriate by the
 
12           department after consultation with the department of
 
13           human services;
 
14      (3)  Into trust funds that may be established for the
 
15           qualified, able-bodied inmate and shall be payable upon
 
16           the inmate's release; and
 
17      (4)  Into the correctional industries revolving fund, for
 
18           costs incident to the qualified, able-bodied inmate's
 
19           confinement in an amount determined by the department,
 
20           but not to exceed twenty per cent of the proceeds and
 
21           wages." 
 
22      SECTION 13.  Section 431:14A-103, Hawaii Revised Statutes,
 
23 is amended by amending subsection (f) to read as follows:
 
24      "(f)  The company is exempt from participation, and shall

 1 not join, contribute financially to, nor be entitled to the
 
 2 protection of, any plan, association, guaranty, insolvency fund,
 
 3 [[]or education[]] and training fund authorized or required by
 
 4 this chapter.  Notwithstanding the foregoing exemptions,
 
 5 beginning January 1, 2008, the company shall participate in the
 
 6 property and liability insurance guaranty association, pursuant
 
 7 to sections 431:16-101 to 431:16-117; provided that the company
 
 8 shall meet the surplus requirements applicable to all other
 
 9 domestic insurers under chapter 431 effective January 1, 2008."
 
10      SECTION 14.  Section 468M-17, Hawaii Revised Statutes, is
 
11 amended by amending the title to read as follows:
 
12      "[[]�468M-17[]]  Rules [and regulations]."  
 
13      SECTION 15.  Section 485-16, Hawaii Revised Statutes, is
 
14 amended by amending subsection (b) to read as follows:
 
15      "(b)  This section shall not apply to any dealer that is
 
16 registered under the Securities Exchange Act of 1934 or to an
 
17 investment adviser that maintains its principal place [[]of
 
18 business[]] in a state other than this State; provided the
 
19 investment adviser is registered in the state where it maintains
 
20 its principal place of business and is in compliance with that
 
21 state's recordkeeping requirements, if any.  The commissioner may
 
22 require:
 
23      (1)  The filing of any financial or operational report that

 1           is required to be filed under the Securities Exchange
 
 2           Act of 1934 or under the laws of the state where an
 
 3           investment adviser maintains its principal place of
 
 4           business; and 
 
 5      (2)  The production of any document, in accordance with the
 
 6           procedures set forth in subsection (a), required to be
 
 7           maintained by a dealer registered under the Securities
 
 8           Exchange Act of 1934 or by the state in which an
 
 9           investment adviser maintains its principal place of
 
10           business." 
 
11      SECTION 16.  Section 571-84, Hawaii Revised Statutes, is
 
12 amended by amending subsection (e) to read as follows:
 
13      "(e)  The records of any police department, and of any
 
14 juvenile crime prevention bureau thereof, relating to any
 
15 proceedings authorized under section 571-11 shall be confidential
 
16 and shall be open to inspection and use only by persons whose
 
17 official duties are concerned with this chapter, except as
 
18 provided in subsections (d)[, (f), and (j)] and (f) or as
 
19 otherwise ordered by the court."
 
20      SECTION 17.  Section 706-646, Hawaii Revised Statutes, is
 
21 amended by amending subsection (2) to read as follows:
 
22      "(2)  The court may order the defendant to make restitution
 
23 for losses suffered by the victim or victims as a result of the

 1 defendant's offense.  The court may order restitution to be paid
 
 2 to the [[]crime victim compensation commission[]] in the event
 
 3 that the victim has been given an award for compensation under
 
 4 chapter 351."
 
 5      SECTION 18.  Section 709-906, Hawaii Revised Statutes, is
 
 6 amended by amending the title to read as follows:
 
 7      "�709-906  Abuse of family [and] or household members;
 
 8 penalty."  
 
 9      SECTION 19.  Section 712A-4, Hawaii Revised Statutes, is
 
10 amended to read as follows:
 
11      "�712A-4  Covered offenses.  Offenses for which property is
 
12 subject to forfeiture under this chapter are:
 
13      (a)  All offenses which specifically authorize forfeiture;
 
14      (b)  Murder, kidnapping, gambling, criminal property damage,
 
15           robbery, bribery, extortion, theft, unauthorized entry
 
16           into motor vehicle, burglary, money laundering,
 
17           [[]trademark counterfeiting,[]] insurance fraud,
 
18           promoting a dangerous, harmful, or detrimental drug, or
 
19           commercial promotion of marijuana, which is chargeable
 
20           as a felony offense under state law;
 
21      (c)  The manufacture, sale, or distribution of a controlled
 
22           substance in violation of chapter 329, promoting
 
23           detrimental drugs or intoxicating compounds, promoting

 1           pornography, promoting pornography for minors, or
 
 2           promoting prostitution, which is chargeable as a felony
 
 3           or misdemeanor offense, but not as a petty misdemeanor,
 
 4           under state law; and
 
 5      (d)  The attempt, conspiracy, solicitation, coercion, or
 
 6           intimidation of another to commit any offense for which
 
 7           property is subject to forfeiture."
 
 8      SECTION 20.  Act 240, Session Laws of Hawaii 1991, is
 
 9 amended by amending section 4 to read as follows:
 
10      "SECTION 4.  This Act shall take effect upon its approval[,
 
11 and shall be repealed on June 30, 1993]."
 
12      SECTION 21.  Act 53, Session Laws of Hawaii 1998, is amended
 
13 by amending the prefatory language in section 1 to read as
 
14 follows:
 
15      "SECTION 1.  Section [76-28,] 76-56, Hawaii Revised
 
16 Statutes, is amended to read as follows:"
 
17      SECTION 22.  Act 78, Session Laws of Hawaii 1998, is amended
 
18 by amending the prefatory language in section 3 to read as
 
19 follows:
 
20      "SECTION 3.  Act 202, Session Laws of Hawaii [1998,] 1988,
 
21 as amended by Act 111, Session Laws of Hawaii 1994, is amended by

 7      "SECTION 6.  Section 501-20, Hawaii Revised Statutes, is
 
 8 amended by adding five new [definition] definitions to be
 
 9 appropriately inserted and to read as follows:
 
10      "[�501-20  Definitions.  As used in this chapter, unless the
 
11 context otherwise requires:]
 
12      "Apartment lease" means an apartment lease, a condominium
 
13 conveyance document, an apartment deed and ground lease, or other
 
14 instrument which has been registered pursuant to section 501-121
 
15 and which leases or subleases a condominium apartment or its
 
16 appurtenant undivided interest in the land of a condominium
 
17 project established or existing under the condominium property
 
18 act or at common law.
 
19      "Leasehold time share interest" means a time share interest
 
20 consisting of an undivided interest in an apartment lease.
 
21      "Notice of time share plan" means a notice of time share
 
22 plan as that term is defined in chapter 514E.
 
23      "Time share interest" means a time share interest as that

 1 term is defined in chapter 514E.
 
 2      "Time share plan" means a time share plan as that term is
 
 3 defined in chapter 514E.""
 
 4      SECTION 25.  Act 229, Session Laws of Hawaii 1998, is
 
 5 amended by amending the prefatory language in section 1 to read
 
 6 as follows:
 
 7      "SECTION 1.  Chapter 323F, Hawaii Revised Statutes, is
 
 8 amended by adding [three] two new sections to be appropriately
 
 9 designated and to read as follows:"
 
10      SECTION 26.  Act 242, Session Laws of Hawaii 1998, is
 
11 amended by amending the prefatory language in section 7 to read
 
12 as follows:
 
13      "SECTION 7.  Section 342P-5, Hawaii Revised Statutes, is
 
14 amended by amending the title and subsections (a) and (b) to read
 
15 as follows:"   
 
16      SECTION 27.  Act 311, Session Laws of Hawaii 1998, is
 
17 amended by amending the prefatory language in section 15 to read
 
18 as follows:
 
19      "SECTION 15.  Section 321-27, Hawaii Revised Statutes, is
 
20 amended [by amending its title and subsections (a) and (b)] to

22      SECTION 28.  This Act shall be amended to conform to all
 
23 other acts passed by the legislature during this regular session

 1 of 1999, whether enacted before or after the effective date of
 
 2 this Act, unless the other acts specifically provide otherwise.
 
 3      SECTION 29.  Statutory material to be repealed is bracketed.
 
 4 New statutory material is underscored.
 
 5      SECTION 30.  This Act shall take effect upon its approval;
 
 6 provided that:
 
 7      1.   Section 20, amending section 4 of Act 240, Session Laws
 
 8           of Hawaii 1991, shall not affect the amendments made by
 
 9           section 1 of Act 240, Session Laws of Hawaii 1991;
