                   A  BILL  FOR  AN  ACT

RELATING TO THE ISSUANCE OF CERTIFICATES OF IDENTIFICATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to:
 
 2      (1)  Remove the requirement of displaying specific mandatory
 
 3           fields on the certificate of identification (more
 
 4           commonly known as the state identification card), such
 
 5           as the social security number, issue date, attorney
 
 6           general's signature, and registrar's signature, thereby
 
 7           leaving the design of the card to the discretion of the
 
 8           attorney general and allowing the possible use of an
 
 9           identification number other than the social security
 
10           number; and
 
11      (2)  Change the designated fingerprints to be obtained and
 
12           retained by the attorney general.
 
13      SECTION 2.  Section 846-28, Hawaii Revised Statutes, is
 
14 amended to read as follows:
 
15      "�846-28  Information to be secured.  The department of the
 
16 attorney general shall require, collect, secure, make, and
 
17 maintain a record of the following items of information so far as
 
18 it is practicable to secure the same, with respect to each
 
19 applicant for registration:

 1      (1)  The name of the person applying to be registered
 
 2           (hereinafter called the "registrant" or "applicant"),
 
 3           the street and number or address of the applicant's
 
 4           place of permanent residence, and the applicant's
 
 5           residence and business telephone numbers, if any;
 
 6      (2)  The applicant's occupation and any pertinent data
 
 7           relating thereto;
 
 8      (3)  The applicant's [nationality or] racial extraction;
 
 9      (4)  The applicant's citizenship;
 
10      (5)  The date and place of the applicant's birth;
 
11      (6)  The applicant's personal description including sex,
 
12           height, weight, hair, eyes, complexion, build, scars,
 
13           and marks;
 
14      (7)  The applicant's right [thumbprint] and left index
 
15           fingerprints or, if the applicant has no right [thumb,]
 
16           index finger or left index finger, other identifying
 
17           imprint as specified by rules of the department;
 
18           provided that this requirement shall not apply to
 
19           minors until they reach the age of three years;
 
20      (8)  The name, relationship, and address of the nearest
 
21           relative or other person to be notified in case of
 
22           sickness, accident, death, emergency, or need of the
 
23           applicant, if such notification is desired; and

 1      (9)  The social security number of the applicant."
 
 2      SECTION 3.  Section 846-30, Hawaii Revised Statutes, is
 
 3 amended to read as follows:
 
 4      "�846-30  Identification certificates; form.  The department
 
 5 of the attorney general, after taking the [thumbprint]
 
 6 fingerprints of each registrant as provided in this part (except
 
 7 as otherwise provided in the case of children under three years
 
 8 of age), and after securing the information required by or
 
 9 pursuant to this part, shall issue to each registrant a
 
10 certificate of identification in such form, and with such
 
11 information, as the attorney general deems necessary and
 
12 practicable[, the certificate to contain, among other things:
 
13 the registrant's social security number; the date of issue; the
 
14 legal name, residence, citizenship, date of birth, the
 
15 registrant's signature, a facsimile signature of the attorney
 
16 general, a facsimile signature of the officer or employee issuing
 
17 the certificate (to be designated as the "administrator of the
 
18 data center"), the name and address of the person to be notified
 
19 in case of need, and such other personal identification data as
 
20 the attorney general deems necessary and practicable]."
 
21      SECTION 4.  Statutory material to be repealed is bracketed.
 
22 New statutory material is underscored.
 
23      SECTION 5.  This Act shall take effect upon its approval.
