DESCRIPTION:
Allows the disclosure of investigative information collected
through the electronic prescription accountability system to
dentists, physicians, osteopaths, and podiatrists who are
registered with the department of public safety to administer,

                     A BILL FOR AN ACT

RELATING TO CONTROLLED SUBSTANCES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 329-104, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  This section shall not prevent the disclosure, at the
 
 4 discretion of the administrator, of investigative information to:
 
 5 [law] (1) Law enforcement officers[;], investigative agents of
 
 6           federal, state, or county law enforcement agencies[;],
 
 7           prosecuting attorneys[;], or the attorney general, [in
 
 8           furtherance of criminal investigations or prosecutions
 
 9           within their respective jurisdictions;] provided that
 
10           the administrator has reasonable grounds to believe
 
11           that the disclosure of any information collected under
 
12           this part is in furtherance of an ongoing criminal
 
13           investigation[.] or prosecution; or
 
14      (2)  Registrants authorized under chapters 448, 453, 460,
 
15           and 463E who are registered to administer, prescribe,
 
16           or dispense controlled substances; provided that the
 
17           information disclosed relates only to the registrant's
 
18           own patient.

 1 Information disclosed to a registrant under this section shall be
 
 2 transmitted by certified mail or a similar means requiring the
 
 3 registrant's signature for delivery of the information."
 
 4      SECTION 2.  There is appropriated out of the controlled
 
 5 substance registration revolving fund the sum of $50,862, or so
 
 6 much thereof as may be necessary for fiscal year 1999-2000, for
 
 7 one full-time equivalent (1.00 FTE) data processing systems
 
 8 analyst IV position and other current expenses to carry out the
 
 9 purpose of this Act.  The sum appropriated shall be expended by
 
10 the department of public safety.
 
11      SECTION 3.  Statutory material to be repealed is bracketed.
 
12 New statutory material is underscored.
 
13      SECTION 4.  This Act shall take effect on July 1, 1999.
