Madam and Sir:

 

     Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 874, H.D. 3, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO CHILD PERFORMERS,"

 

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

 

     The purpose of this measure is to provide some protection of a child performer's earnings by:

 

     (1)  Establishing for a minor in theatrical employment with a gross income of at least $5,000 on a project or $20,000 in a calendar year the requirement for:

 

          (A)  A parent or legal guardian of the minor to establish a trust account for the minor with an independent third-party trustee; and

 

          (B)  The employer of the minor to deposit a portion of the minor's earnings into the trust account until the minor becomes an adult; and

 

     (2)  Making misappropriation or fraudulent use of funds within the trust account a breach of fiduciary duty subject to penalties.

 

     Your Committee on Conference has amended this measure by:

 

     (1)  Changing its effective date to upon approval; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 874, H.D. 3, S.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 874, H.D. 3, S.D. 2, C.D. 1.
