RELATING TO THE LABOR AND INDUSTRIAL RELATIONS APPEALS BOARD.

Allows one member of the Labor and Industrial Relations Appeals Board to decide on motions except motions to dismiss or for summary judgment. Authorizes LIRAB to appoint hearing officers. Specifies that all board members be attorneys.

RELATING TO CONTESTS OF OCCUPATIONAL SAFETY AND HEALTH MATTERS.

Transfers the responsibilities from the Labor and Industrial Relations Appeals Board to handle contests of citations of proposed penalty orders to the Hawaii Labor Relations Board.

Authorizes employees to appeal a decision for which the employer pays for costs of the proceedings if the employer loses.

RELATING TO AMENDMENTS TO ACT 253, SESSION LAWS OF HAWAII 2000.

Allows the Director to certify that new or amended administrative rules, policies, standards, guidelines, ordinances, executive orders, directives, or provisions in a collective bargaining agreement are in place, and that the effective dates of the repeal of existing statutes and administrative rules or the effective dates of new statutes and administrative rules shall be the date of certification for a specific jurisdiction.

RELATING TO TEMPORARY HEALTH INSURANCE FOR UNEMPLOYED PERSONS.

Clarifies Act 6, Third Special Session Laws of Hawaii 2001, regarding reimbursement of payments. Specifically provides that the expenditure of money appropriated shall be for the period beginning after September 11, 2001 and ending on June 30, 2002 or when the money runs out, whichever is sooner.

RELATING TO LANGUAGE.

Creates a commission on language access and appropriates funds to develop and implement systems by which limited English-speaking persons can access services, activities, and programs within each department.

RELATING TO GOVERNMENT.

Provides for the regulation of privatization contracts, including providing for a review of contract costs, monitoring and enforcement of privatization services, and public access to information. Requires annual reports to include an evaluation of the efficiency and effectiveness of services provided.

RELATING TO PUBLIC WORKS PROJECTS.

Maintains a fair public works bidding process by clarifying that the provisions of chapter 104 apply regardless of whether prevailing wage, overtime, and other requirements are stated in a contract or specifications, and that omission from a contract cannot be used as a defense by a contractor who is found in violation.

RELATING TO THE WAGE AND HOUR LAW.

Increases the amount of guaranteed monthly compensation required to exempt an individual from minimum wage, overtime and record keeping requirements under the Hawaii Wage and Hour Law.
