RELATING TO SCHOOL SECURITY.

Requires the department of public safety rather than the department of education to carry out the initial and ongoing training of school security attendants after 6/30/02, subject to the availability of funding. Appropriates funds for the training of security attendants for school campuses.

RELATING TO THE AUDITOR.

Clarifies the confidential nature of Auditor's records in the education area.

RELATED TO LIMITED LIABILITY.

Limits liability of educational officers and teachers against any claims related to the Felix-Cayetano consent decree and to services for exceptional children.

RELATING TO INDEMNIFICATION.

Allows UH to indemnify a person, corporation, or entity when indemnity is required as a condition for obtaining research grants, benefits, services, interest in or right to use property, and other contractual benefits.

SB 2043

RELATING TO ADOPTION.

Establishes an advisory task force to study the consequences of integrating the practice of hanai into statutory law. Requires the task force to propose draft legislation for consideration for the 2004 legislature. Requires the advisory task force to submit an interim report to the 2003 legislature, and a final report to the 2004 legislature. Appropriates $1 to defray the costs of the advisory task force.

RELATING TO THE UNIFORM CHILD-CUSTODY JURISDICTION AND ENFORCEMENT ACT.

Creates the uniform child custody jurisdiction and enforcement act.

Appropriates funds for state commission to promote uniform laws, and to pay State's dues to National Conference of Commissioners on Uniform State Laws.

Allows admission of evidence in a domestic violence criminal action of defendant's commission of other domestic violence.

RELATING TO HAWAII PENAL CODE.

Clarifies sentencing provision in domestic abuse cases to delete reference to misdemeanor, to comport with the Hawaii supreme court decision in State v. Modica.

RELATING TO DOMESTIC VIOLENCE.

Disallows bail pending appeal of a conviction for domestic violence.

RELATING TO STALKING

Allows court to grant probation to violator and to order the person to refrain up to 5 years from stalking; allows court to order psychiatric evaluation of violator; establishes rebuttable presumption of stalking based on continuing conduct of violator after being requested by victim to refrain.

When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.
