Creates statewide licensure mechanism for retail tobacco sales that provides for licensing retail tobacco vendors, inspection and enforcement, adjudication of fines and penalties, training and education for retail merchants and public awareness of the State's statutes governing the sale of tobacco to minors. RELATING TO TOBACCO SALES TO MINORS

Substitutes "entity" for "person" relating to a negligent violation of selling a tobacco product to a minor. Defines "entity." Clarifies fine of $500 for a first offense is a mandatory minimum. Increases fine on minors from $10 to $50 for first offense and from $50 to $100 for subsequent offenses. (Takai)

RELATING TO MENTAL HEALTH, ALCOHOL, AND DRUG ABUSE

Requires mental illness benefits to be provided to minors to same extent as to adults; prohibits rate discrimination for minors; defines a minor; adds major depression to definition of serious mental illness as applied to minors; requires treatment as clinically necessary for minors for serious mental illness and alcohol and drug dependence benefits; repeals sunset of definition of "serious mental illness". Increases the marriage license fee from $50 to $90. Allocates $10 to the Vital Statistics Improvement Special Fund for upgrading the computer hardware and software for the vital statistics system. RELATING TO HOSPITAL LICENSING

Expedites the mandatory annual state licensing of hospitals by the department by accepting accreditation by the Joint Commission on Accreditation of Healthcare Organizations as evidence that a hospital, which pays for the accreditation process, demonstrates compliance with all licensing requirements of the State when the Department receives a certified copy of the organization's official accreditation report; and holds a current and valid license. RELATING TO CONTROL OF DISEASE

Allows the Department to enter into agreements with health care facilities and providers to assist with epidemic control activities. Requires individuals and entities to provided information needed to locate people suspected of having been exposed to a dangerous disease. Establishes protections for the rights of individuals quarantined to prevent transmission of a dangerous infectious disease and grants the Department authority to sequester contaminated articles.
