RELATING TO GASOLINE.

Requires DBEDT to establish and publish each quarter a maximum wholesale gasoline price in the State based on the average price of crude oil prices in four markets. Prohibits major oil companies from charging more than this maximum price to retailers. Imposes civil penalties.

RELATING TO PETROLEUM.

Requires wholesale sellers of petroleum products to report quarterly to the attorney general regarding gross profit and loss statements for the previous quarter. Requires the attorney general to review these reports and bring appropriate legal action as necessary, including antitrust actions.

RELATING TO PUBLIC UTILITIES.

Regulates oil companies under the public utilities commission.

RELATING TO PETROLEUM PRODUCTS.

Requires wholesalers of petroleum products in Hawaii to report its earnings to DBEDT on the basis of total gross and net earnings and return on capital employed. Requires companies whose return on capital employed exceeds 15% to pay certain amounts into a petroleum overcharges special fund.

Requires, rather than just permits, DBEDT to provide information on the supply and pricing of petroleum products in the State.

Amends definition of "major marketer" to include any individual or corporation that operates more than 2 retail outlets selling gasoline.

Reduces the amount of time a manufacturer or jobber may operate a former dealer operated service station from 24 months to 90 days.

Increases the amount of the civil penalty for failing to provide timely statements and informational reports from $500 to $2,000 per day to $10,000 per day.

Requires the petroleum advisory council to present monthly reports to the governor on recommended fair prices in Hawaii.

Requires the petroleum advisory council to release quarterly reports on the excess profitability of Hawaii gasoline sellers as compared to benchmark markets.
