RELATING TO EDUCATION.

Provides several provisions to improve accountability, performance, efficiency, and effectiveness of the department of education and its services for students in need of health services.

RELATING TO THE FELIX CONSENT DECREE.

Expands the plaintiff class in the Felix consent decree to include an unborn child who is determined to be at risk of developing a condition that may qualify the child for education and mental health services anytime between birth and 20 years of age because of alcohol or drug abuse by a pregnant women.

RELATING TO THE FELIX CONSENT DECREE.

Requires the DOE to develop a linked accounting system that will enable state auditors and accountants and the legislature to determine the cost of Felix-related services with a generally acceptable degree of precision. Appropriates funds.

RELATING TO SPECIAL EDUCATION.

Appropriates funds for the department of education to develop a revised teacher allocation methodology and to compensate persons in newly created positions.

Adds violence against health care workers to assault in the second degree, and violence against an educational worker or health care worker to terroristic threatening in the first degree.

RELATING TO STUDENT LOANS FOR TEACHERS.

Creates an incentive for students to become teachers and to ensure that these graduates teach in our public schools.

RELATING TO THE HAWAII EDUCATOR LOAN PROGRAM.

Reduces period of forgiving loans from the Hawaii educator loan program from 10 years to 6 years by forgiving 10% for each of the first 5 years and 50 per cent for the 6th year; establishes an appropriation ceiling; and authorizes up to 5% of outstanding loans for administrative costs. Appropriates funds.

RELATING TO EDUCATION.

Allows the DOE to provide suitable student transportation to and from not-for-profit private and sectarian elementary schools and secondary schools, provided that eligibility for such transportation has been determined in a nondiscriminatory manner on the basis of neutral, secular criteria.

Authorizes the establishment of high school career and technical education programs within the DOE. Appropriates funds.

RELATING TO EDUCATION.

Defines, for statistical purposes, "teaching out-of-field" as teaching outside the areas of preparation indicated on an individual's license; and "out-of-field teacher" as an individual who is teaching outside the areas of preparation indicated on the individual's license.

Sets forth governance and management structure reform provisions for the department of education.

RELATING TO THE DEPARTMENT OF EDUCATION.

Changes the designation of district superintendents to area superintendents, and requires them to supervise delivery of administrative and instructional support services in their areas. Requires the board of education to determine the salaries of the deputy superintendent and area superintendents.

RELATING TO EDUCATIONAL ACCOUNTABILITY.

Holds students, educational professionals, and schools individually and collectively accountable for academic excellence, student safety and well-being, and civic responsibility by requiring establishment of an educational accountability system based on assessment, technical assistance, rewards, sanctions, and reporting.

RELATING TO EDUCATION.

Specifies the duties of the office of educational accountability, the school accountability and advisory panel, and school advisory councils. Abolishes school/community-based management.

MAKING AN APPROPRIATION FOR HIGHLANDS INTERMEDIATE SCHOOL.

Appropriates $300,000 to the DOE for the continuation of National Center on Education and the Economy based literacy efforts at Highlands intermediate school, including 6.00 FTE temporary teacher positions and other current expenses.
