RELATING TO HARBORS.

Allows DOT to enter into capital advancement contracts with private developers for harbor facility public improvements that cost up to $2,000,000 without legislative approval. Allows DOT to enter into such contracts up to $5,000,000 with legislative approval.

Transfers certain PSC taxes to the harbor special fund for the improvement of cruise ship facilities.

RELATING TO THE HAWAII PORT AUTHORITY.

Establishes Hawaii port authority and directs authority, in consultation with other affected state agencies, to propose specific actions to be taken for the transition of power to the authority.

Allows design-build construction proposals to be submitted. Requires development of a short list of offerors from whom proposals will be requested. Requires purchasing agency to pay unsuccessful offerors $5,000 plus one per cent of the project construction cost to allow the State to use certain designs submitted in a technically responsive proposal.

Allows purchasing agencies to use nongovernmental employee reviewers in reviewing the procurement of design professional services.

Provides for the implementation of a performance-based budgeting system by all state executive departments and agencies. Requires the legislative analyst to assist the legislature in evaluating the performance data that are required of departments and programs involved in performance-based budgeting.

Creates a new felony for sale or manufacturer of deceptive identification documents.

Gives taxpayers an aircraft operating lease investment income tax credit that is deductible from the net income tax liability of a lessee of an aircraft under an operating lease.

RELATING TO WHARFAGE.

Directs department of transportation to fix wharfage rates that apply fairly to all cargo shipped through Oahu.
